DANDY DAN’S FISH MARKET LTD. CHARGED WITH VIOLATIONS OF FEDERAL ENVIRONMENTAL AND FISHERIES ACTS

ST. JOHN’S, NL, July 25, 2003 - Environment Canada today filed two charges against a Ship Harbour company for alleged violations of the Canadian Environmental Protection Act (CEPA 1999) and the Canadian Fisheries Act. The two charges were laid against Dandy Dan’s Fish Market Ltd. as a result of an alleged disposal of a large quantity of fish waste without a CEPA 1999 permit and in a manner that contravened the federal Fisheries Act.

Environment Canada alleges that on or about July 10th, 2002 at or near Ship Harbour, Dandy Dan’s Fish Market Ltd. did dispose of waste or other matter in an area referred to in paragraphs 122(2)(a) to (e) of the Canadian Environmental Protection Act, 1999 without the disposal being done in accordance with a Canadian Permit, thereby committing an offence contrary to section 125(1) - 272(2)(b) of the Canadian Environmental Protection Act, 1999.

Environment Canada also alleges that on or about July 10th, 2002 at or near Ship Harbour, Dandy Dan’s Fish Market Ltd. did leave or deposit or cause to be thrown, left or deposited, on the shore, beach or bank of any water, or on the beach between the high and low water mark, remains or offal of fish or of marine animals, thereby committing an offence contrary to sections 36(1)(b) – 40(2)(a) of the federal Fisheries Act.

The first court appearance in this case is scheduled for August 11, 2003.
