Minimum Wage/Overtime/Call In/Piecework

Where do I find out about minimum wages, overtime, call in pay, and pay for piecework?

Minimum Wage
If you are an employee under the Employment Standards Act, that is, if you are not a member of a labour union, or if you are an employer with employees who have no union, then you may want to know more about the Minimum Wage Order.

What the Minimum Wage Order Does
The Minimum Wage Order sets wage rates. A wage rate is the amount of money an employer pays an employee for each hour of work.
Also, the Minimum Wage Order sets Employment Standards for the following:

  • the cost of uniforms
  • the cost of board, lodging and meals
Overtime
Any time an employee works more than 48 hours in one week is overtime. If an employee must work overtime, the employer must pay that employee at one and one-half times the employee's regular rate of pay.

Call In
If you are an employee and you are called in to work outside your regular work hours, your employer must pay you for at least three hours work.

Waiting on the Owner's Premises
An employer who asks or tells an employee to wait at the place of work must consider that time as work time.

Piece Work
Many employers in PEI pay employees by the amount they produce and not by the hour. This arrangement is called "piecework". An employer cannot pay an employee less for piecework than that employee would have earned at the minimum wage for the number of hours worked.
