Initiating an Appeal

What information do I need to appeal a Reconsideration decision?

To file an appeal to a Review Tribunal, you must send the OCRT an appeal letter within 90 days of receiving the decision letter from SDC. For more information, see How to Appeal.

If you live outside of Canada, before we can schedule your hearing you must complete:

What do I do if I'm over the 90 day appeal period allowed for appealing the Reconsideration decision made by SDC?

If you are over the 90 day appeal period in appealing the Reconsideration decision, send the OCRT an appeal letter with a full explanation of the reasons why you are late. The Commissioner will determine if you have a valid reason for being late. See How to Appeal.

I no longer wish to appeal, what do I do?

A1.4

You may withdraw from your appeal before your hearing. You should be aware that withdrawing your appeal has consequences. We recommend that you call your Client Service Officer before withdrawing so that we can explain the possible consequences. To officially withdraw, you must send a signed letter to OCRT stating that you wish to withdraw your appeal.
