Emergency Response Information for Air Operators

Notice Summary

Issue

Provision of appropriate information to the Pilot-in-Command in accordance with the provisions of Part 7;4.8 of the International Civil Aviation Organization Technical Instructions (ICAO TI's) for use in emergency response to accidents and incidents that occur on board an aircraft which involve dangerous goods.

Position

The following documents are suitable for meeting the requirements of Part 7;4.8 of the ICAO TI's:

  • For all types of operations, "Emergency Response Guidance for Aircraft Incidents Involving Dangerous Goods (ICAO Doc. 9481)"; or,

For 703 and helicopters operations, the following documents are a suitable alternative to ICAO Doc. 9481:

  • 2004 Emergency Response Guidebook (ERG2004) or the appropriate extract
  • an MSDS providing information equal to that found in the ERG2004

Note: There is a copyright governing the use of the ICAO Doc 9481.

All - Even though not required by regulation, air operators operating solely pursuant to TDGR Sections 12.9, 12.12, 12.14, 12.15, 12.16 are encouraged to have the following documents available to the pilot-in-command to assist in an emergency situation:

  • VFR - ERG2004, or
  • IFR - ICAO Doc 9481

Introduction

This Notice pertains to the provision of appropriate information to the Pilot-in-Command for use in emergency response to accidents and incidents, which involve dangerous goods requiring a transport document, and is of importance to Air Operators.

Regulatory Text

The Transportation of Dangerous Goods Regulations (TDGR), and, by reference, the International Civil Aviation Organization Technical Instructions for the Safe Transport of Dangerous Goods by Air (ICAO TI's), 2005/2006 regulate the transport of dangerous goods to, from and within Canada.

TDGR

Paragraph 12.1 (1) - General Requirements

"A person who handles, offers for transport, or transports dangerous goods by aircraft between Canada and another country must do so in accordance with the ICAO Technical Instructions and the following provisions of these regulations..."

ICAO TI's, 2005/2006

"7;4.8 - The operator must ensure that for consignments for which a dangerous goods transport document is required by these Instructions, appropriate information is immediately available at all times for use in emergency response to accidents and incidents involving dangerous goods in air transport. The information must be available to the pilot-in-command and can be provided by:

  1. the ICAO Emergency Response Guidance for Aircraft Incidents Involving Dangerous Goods (ICAO Doc. 9481); or
  2. any other document which provides similar information concerning the dangerous goods on board.

Documents providing appropriate emergency response information

In the case of all operations done in accordance with Section 12.1 of the TDGR

  • ICAO Doc. 9481 must be used unless otherwise specified in this Notice.

In the case of cargo or passenger carrying aircraft referred to in Subpart 3 of Part VII of the Canadian Aviation Regulations (CARs) and helicopter operations the following documents are suitable alternatives to ICAO Doc. 9481:

  • The 2004 Emergency Response Guidebook (ERG2004) or extracts from the Guide pertaining to those dangerous goods requiring a transport document to be transported on board the aircraft at any one time
  • an MSDS providing information equal to the 2004 ERG.

Air operators operating solely pursuant to Sections 12.9, 12.12, 12.14, 12.15 and 12.16 of the TDGR

Even though not required by regulation, air operators operating solely pursuant to Sections 12.9, 12.12, 12.14, 12.15 and 12.16 shall be encouraged to have the following documents available to the pilot-in-command:

  • if VFR - 2004 ERG, or
  • if IFR - ICAO Doc 9480
