Vol. 139, No. 25 December 14, 2005 Registration CUSTOMS TARIFF Order Amending the Schedule to the Customs Tariff, 2005-4 P.C. 2005-2187 November 22, 2005 Her Excellency the Governor General in Council, on the recommendation of the Minister of Finance, pursuant to section 82 of the Customs Tariff (see footnote a), hereby makes the annexed Order Amending the Schedule to the Customs Tariff, 2005-4. ORDER AMENDING THE SCHEDULE TO THE CUSTOMS TARIFF, 2005-4 AMENDMENTS 1. The List of Tariff Provisions set out in the schedule to the Customs Tariff (see footnote 1)is amended as set out in Part 1 of the schedule to this Order. 2. The List of Tariff Provisions set out in the schedule to the Act is amended by adding, in numerical order, the tariff provision set out in Part 2 of the schedule to this Order. COMING INTO FORCE 3. This Order comes into force on the day on which it is registered. SCHEDULE PART 1 AMENDMENTS TO THE LIST OF TARIFF PROVISIONS 1. The Description of Goods of tariff item No. 4412.14.10 is replaced by the following: --- 5-ply and 7-ply hardwood plywood for use as backing in the manufacture of hardwood plywood panels for flooring 2. The Description of Goods of tariff item No. 4412.14.90 is replaced by the following: --- Other 3. The Description of Goods of tariff item No. 5402.20.20 is amended by replacing the reference to "1450 decitex" with a reference to "1700 decitex". 4. The Description of Goods of tariff item No. 5407.51.20 is amended by replacing the reference to "Five-harness satin weave fabrics" with a reference to "Satin weave fabrics". 5. The Description of Goods of tariff item No. 5407.52.20 is amended by replacing the reference to "Five-harness satin weave fabrics" with a reference to "Satin weave fabrics". 6. The Description of Goods of tariff item No. 9931.00.00 is amended by replacing the reference to "March 31, 2006" with a reference to "March 31, 2008". 7. The Description of Goods of tariff item No. 9994.00.00 is replaced by the following: Articles of heading 39.18, 39.20, 39.21, 39.25, 39.26, 40.08, 40.16, 44.21, 46.01, 48.14, 48.21, 51.11, 51.12, 52.08, 52.09, 52.10, 52.11, 52.12, 53.09, 53.10, 53.11, 54.01, 54.07, 54.08, 55.12, 55.13, 55.14, 55.15, 55.16, 56.03, 56.07, 57.02, 57.03, 57.05, 58.01, 58.02, 58.03, 58.04, 58.05, 58.06, 58.08, 58.09, 58.10, 58.11, 59.03, 59.04, 59.05, 59.06, 60.01, 60.02, 60.03, 60.04, 60.05, 60.06, 63.02, 63.07, 70.19, 73.15, 73.26 or 76.16, to be marked, torn, perforated or otherwise treated so as to be unsuitable for sale or for use except as commercial samples, specified or provided by a customer at arm's length, for use in the manufacture of sample books, sample cards, sample chain sets, sample boards, sample boxes, sample displays and sample stack sets. PART 2 ADDITION OF TARIFF PROVISION
REGULATORY IMPACT ANALYSIS STATEMENT (This statement is not part of the Order.) Description The Order Amending the Schedule to the Customs Tariff, 2005-4, removes the tariff on ultra high molecular weight polyethylene resins for use in the manufacture of medical orthopaedic implants and parts for snowmobiles, all terrain vehicles, industrial sweepers, agricultural equipment, railway rolling stock and equipment, water treatment equipment and conveyor systems. In addition, the Order amends certain tariff items as follows: - to permanently extend duty-free treatment for 5-ply and 7-ply hardwood plywood used in the manufacture of plywood panels for hardwood flooring; - to include additional textile fabrics in the list of fabrics eligible for duty-free entry when used in the manufacture of commercial samples in tariff item No. 9994.00.00; - to increase decitex measurements applicable to high tenacity multifilament polyester yarns which are allowed duty-free entry; - to remove the "five-harness" requirement on satin weave fabrics used in the manufacture of brides' white or off-white wedding dresses; and - to extend tariff item No. 9931.00.00 which allows duty-free entry of certain customer-specified fabrics when used in the manufacture of upholstered furniture, in its current form, for an additional two-year period. Alternatives There is no practical alternative for amending the schedule to the Customs Tariff. It is longstanding practice to use Order in Council authority to reduce or remove customs duties on goods used in the production of other goods. An Order made pursuant to section 82 of the Customs Tariff is the appropriate and timely method to assist Canadian manufacturers in competing more effectively in both the domestic and export markets. Benefits and Costs Manufacturers using these inputs will benefit from lower input costs. It is estimated that the revenue foregone to the Government as a result of this Order will be $7,249,313. Consultation Detailed consultations were undertaken with all interested parties expected to be affected by the proposed amendments. There is no opposition to the proposals. Compliance and Enforcement Compliance is not an issue. The Canada Border Services Agency is responsible for the administration of custom and tariff legislation and regulations.
