ANTHRAX COMPENSATION TERMS AND CONDITIONS, NO. 2

Her Excellency the Governor General in Council, on the recommendation of the Minister of Agriculture and Agri-Food and the Treasury Board, pursuant to Vote 35 of the Estimates of the Department of Agriculture referred to in section 2 of Appropriation Act No. 2, 1974, Vote 30 of the Estimates of the Department of Agriculture and Agri-Food, Canadian Food Inspection Agency referred to in paragraph 2(a) of Appropriation Act No. 1, 2006-2007 and any other Appropriation Act that authorizes payments of compensation under terms and conditions approved by the Governor in Council to owners of animals that have died as a result of anthrax, hereby approves the annexed Anthrax Compensation Terms and Conditions, No. 2.

interpretation

1. In these terms and conditions, "Minister" means the Minister of Agriculture and Agri-Food.

2. Subject to sections 3 to 5, the Minister may pay compensation to the owner of an animal that dies after March 31, 2006 as a result of anthrax.

3. The maximum amount of compensation per animal that the Minister may pay is

(a) for cattle, $500;

(b) for horses, $350;

(c) for sheep, $100;

(d) for swine, $100;

(e) for goats, $100;

(f) for bison, $500;

(g) for cervids, $350;

(h) for alpacas, $100; and

(i) for llamas, $100.

4. No payment of compensation in respect of an animal may be made by the Minister unless the Minister has received a certificate signed by a veterinary inspector under the Health of Animals Act certifying that

(a) the animal died as a result of anthrax; and

(b) the premises where the animal died have been cleaned and disinfected.

5. The maximum amount that the Minister may pay to the owner of an animal under these terms and conditions is reduced by any amount paid to the owner in respect of the animal under the Anthrax Compensation Terms and Conditions, approved by Order in Council P.C. 1974-2292 of October 22, 1974.

6. The Anthrax Compensation Terms and Conditions, approved by Order in Council P.C. 1974-2292 of October 22, 1974, are repealed.
