IN THE MATTER OF AN EMERALD ASH BORER INFESTATION IN THE COUNTY OF LAMBTON IN THE PROVINCE OF ONTARIO;
AND
PURSUANT TO SUBSECTION 15(3)
OF THE PLANT PROTECTION ACT, S.C. 1990, C. 22;
THE COUNTY OF LAMBTON EMERALD ASH BORER INFESTED PLACES DECLARATION AND ORDER
IT IS HEREBY DECLARED THAT the County of Lambton in the Province of Ontario is infested with the Emerald Ash Borer (Agrilus planipennis);
AND IT IS HEREBY ORDERED THAT:
Interpretation
- In this order,
“Movement Certificate” means a certificate referred to in Part III of the Plant Protection Regulations, SOR/95-212;
“inspector” means a person designated as an inspector pursuant to section 21 of the Plant Protection Act;
“pest” means the Emerald Ash Borer (Agrilus planipennis) in all its life stages;
“regulated articles” are trees, nursery stock, logs, lumber, wood packaging or dunnage, wood or bark, wood chips or bark chips of the genus Fraximus (commonly known as Ash), as well as firewood of all species;
“conveyance” means any mode of transport including aircraft, carriage, motor vehicle, trailer, railway car, vessel, cargo container or other contrivance used to move persons or things;
“control zone” means the County of Lambton in the Province of Ontario, as depicted in Schedule “A” appended hereto;
Prohibitions or Restrictions of Movement
(1) No person, except an inspector, shall move the pest into or out of the control zone unless authorized beforehand to do so in writing by an inspector under and in accordance with a Movement Certificate.
(2) Subject to subsection (4), no person, except an inspector, shall move regulated articles out of the control zone unless authorized beforehand to do so in writing by an inspector and in accordance with a Movement Certificate.
(3) Subject to subsection (4), no person, except an inspector, shall move, or cause to be moved, any conveyance that is transporting regulated articles out of the control zone, unless authorized beforehand to do so in writing by an inspector under and in accordance with a Movement Certificate.
(4) No person shall move regulated articles through the control zone during the months of April, May, June, July, August or September unless they are transported without undue delay in a conveyance that is sealed or closed in a secure manner that prevents them from becoming infested by the pest.
