Agreement Respecting the National Air Pollution Surveillance (NAPS) Program Memorandum of Understanding (MOU)

Notice is hereby given that the Minister of the Environment ("the Minister") has negotiated the annexed proposed agreement with provincial and territorial governments, with the exception of Nunavut. The Minister is publishing the proposed agreement in accordance with subsection 9(2) of the Canadian Environmental Protection Act, 1999 (S.C. 1999, c. 33).

The National Air Pollution Surveillance program has been in existence since 1969 and has operated without a formal agreement. The Report of the Commissioner of the Environment and Sustainable Development for 2000 recommended that an agreement be put in place. This has now been negotiated using the Statement of Principles to Guide Cooperative Arrangements on Monitoring and Reporting developed by the Canadian Council of the Ministers of the Environment (CCME). The CCME Deputy Ministers accepted in principle the proposed agreement on April 15, 2003. The Ministers intend to sign the agreement upon completion of their respective internal processes to secure authority to enter into the agreement (winter 2004).

MEMORANDUM OF UNDERSTANDING

CANADA-WIDE NATIONAL AIR POLLUTION
SURVEILLANCE PROGRAM

BETWEEN

The Government of Canada (hereinafter referred to as "EC")

AND

The Provinces of Alberta, British Columbia, Manitoba, New Brunswick, Newfoundland and Labrador, Nova Scotia, Ontario, Prince Edward Island, Quebec, Saskatchewan, and the Northwest Territories, the territory of Nunavut, and the territory of Yukon (hereinafter referred to as "The Provinces and Territories")

THE PARTIES HEREBY AGREE AS FOLLOWS:

WHEREAS the Parties have been collaborating in exchanging information and data to facilitate the National Air Pollution Surveillance (NAPS) Program for a number of years without the benefit of a written Memorandum of Understanding;

WHEREAS this Memorandum of Understanding (hereinafter defined and referred to as "MOU") is to be based on collaboration and on the principle of equitable sharing of costs and work subject to each Party's limited available resources;

WHEREAS all Parties want this MOU to follow the principles found in the Canadian Council of Ministers of the Environment ("CCME") Statement of Principles to Guide Cooperative Arrangements on Environmental Monitoring and Reporting, which states that all Parties have equal standing, will act in a transparent manner, and will respect each Party's jurisdiction, needs, capabilities, and mandate;

IN CONSEQUENCE WHEREOF, the Parties agree as follows:

1. DEFINITIONS

In this MOU, the terms below shall have the following meanings:

"Canada-wide Air Quality Database" means a federally managed collection of data generated from the NAPS Program, as well as other air quality data generated at air monitoring sites owned and operated by the Parties to this MOU;

"Designated NAPS Site" means a site approved for inclusion in the NAPS network by EC and the province or territory in which the site is located, as specified in the appropriate annex to this MOU;

"Effective Date" means April 1, 2001;

"Fiscal Year" means the period from April 1 in any year to March 31 in the following calendar year;

"NAPS Data" means raw data collected from Designated NAPS Sites;

"NAPS Program" means the sum of the Parties' activities involved in collecting, managing, and disseminating air quality data from Designated NAPS Sites as detailed in the Annexes to this MOU;

"Performance-based Methods" means a method for measuring an air quality parameter that is based on a desired performance specification rather than a strict procedure or product; and

"Quality-assured Data" means data that has been reviewed by the Party who is the originator of the data to ensure that it meets acceptable standards of accuracy and precision consistent with the standards found in the manual entitled National Air Pollution Surveillance Network Quality Assurance and Quality Control Guidelines, Report Series No. PMD 95-8, Environmental Technology Centre, Environment Canada, Ottawa, 1995, as modified from time to time.

2. PURPOSE OF THE MOU

2.1 The purpose of this MOU is to

(a) outline the general terms and conditions of cooperation between the Parties in the overall management and support of the NAPS Program;

(b) outline each Party's roles and responsibilities in collecting, processing, managing, analyzing, and reporting air quality data from Designated NAPS Sites;

(c) identify operational responsibilities of the Parties in acquiring, installing, operating, and maintaining monitoring equip-ment at Designated NAPS sites;

(d) facilitate cooperation between the Parties in monitoring and reporting activities in order to

    (i) support air quality data needs of the NAPS Program, the Canada-wide Standards, the Canada/US Agreement on Air Quality, the Canadian Air Quality Prediction Program, and other joint air quality initiatives that may arise;
    (ii) maintain an air quality monitoring network that effectively monitors pollutants of national interest in ambient air;
    (iii) coordinate air quality monitoring activities of mutual interest, optimize air quality monitoring and data management resources in meeting air quality program and policy needs, and maximize the effectiveness of the NAPS Program;
    (iv) strive for the collection of Quality-assured Data on air quality that is consistent with published NAPS Program guidelines;
    (v) maintain a Canada-wide Air Quality Database;
    (vi) maintain high scientific standards;
    (vii) support development of Performance-based Methods for air quality monitoring where practicable;
    (viii) seek standardization in the collection of air quality data through the development and application of common monitoring and data management methods and procedures, including criteria for location of monitoring sites and training of operators;
    (ix) exchange data on an equitable, timely, and mutually beneficial basis in accordance with each Party's respective jurisdiction and scope of activities while also respecting the scientific value of the data, legislation and intellectual property rights of the Parties; and

(e) harmonize air quality data acquisition, processing, and exchange methods among the Parties and where practicable ensure cooperation and coordination of operations carried out under the MOU.

3. ROLES AND RESPONSIBILITIES: EC

3.1 EC's roles and responsibilities under this MOU will be to

(a) participate with The Provinces and Territories in the overall management of the NAPS Program and network;

(b) identify potential Designated NAPS Sites based on priorities identified collectively by the Parties and select Designated NAPS Sites in agreement with The Provinces and Territories for effective delivery of the NAPS Program;

(c) co-ordinate a national quality assurance and audit program which includes provision of calibration services, monitoring station and system audits, and interlaboratory studies;

(d) provide ambient air quality monitoring and sampling equipment for Designated NAPS Sites to enable a national view of air quality; this includes the cost of maintaining EC equipment deployed at Designated NAPS Sites when the cost of a component is equal to or in excess of five hundred dollars ($500);

(e) provide technical training and support to the other Parties;

(f) provide centralized laboratory analyses for the NAPS Program at the Environmental Technology Centre in Ottawa;

(g) co-ordinate negotiations between the Parties for the development and validation of new Performance-based Methods for air quality monitoring;

(h) maintain the Canada-wide Air Quality Database which will be located at the Environmental Technology Centre in Ottawa. The data in the database will be available to all Parties, either on request or via the internet when the Web site is developed and functional;

(i) conduct research and development and special studies in air quality monitoring, sampling, and chemical analysis in consultation with The Provinces and Territories;

(j) convene regular meetings of Parties to the MOU;

(k) co-ordinate national data analysis initiatives;

(l) publish timely annual data reports and reports on national air quality; and

(m) lead the collaborative development of an annual NAPS Program work plan and report in consultation with other Parties to the MOU.

4. ROLES AND RESPONSIBILITIES: The Provinces and Territories

4.1 The Provinces' and Territories' roles and responsibilities will be to

(a) participate with EC in the overall management of the NAPS Program;

(b) provide locations for Designated NAPS Sites selected by The Provinces and Territories;

(c) maintain and operate Designated NAPS Sites and instruments in accordance with the terms of this MOU; this includes the cost of maintaining EC's equipment deployed at Designated NAPS Sites when the cost of a component is less than five hundred dollars ($500);

(d) provide data collection and validation for Designated NAPS Sites as listed in the Annexes to this MOU;

(e) support the development of standards and Performance-based Methods for air quality monitoring;

(f) strive to provide Quality Assured Data to EC within six (6) months of collection for inclusion in the Canada-wide Air Quality Database; and

(g) share information and data and conduct special studies in air quality monitoring in consultation with the Parties.

5. MEETINGS, WORK PLANS, AND REPORTING

5.1 Annual Management Meetings

(a) The Parties agree to hold a meeting or conference call of NAPS Program managers designated in Schedule A or their representatives at least once a year. The Parties agree that attendance at these meetings is very important, although not mandatory.

(b) Commencing on the Effective Date of this MOU and every alternate year thereafter, if a face-to-face meeting is required by the Parties, the annual management meetings are to be hosted by EC either in Ottawa or in Toronto. A provincial or territorial Party selected by the provinces and territories will act as co-chair for a period of two (2) years. The co-chair or other province or territory will host one of the two annual meetings during their term. The Parties agree that each Party will host a meeting. The Parties further agree that the hosting Party will provide and be financially responsible for secretariat services for the meeting.

(c) EC will serve as co-chair of the NAPS Program managers meetings and will provide a secretariat function between annual meetings.

(d) Agendas for the meetings of the NAPS Program managers will include issues related to the implementation of this MOU and the overall management and effectiveness of the network and database, including technology transfer.

5.2 Technical Meetings

The Parties will also hold technical meetings, on an as-needed basis, to discuss specific technical difficulties or issues that may arise during the term of this MOU. The Parties will create technical committees that will, for example, help to develop Performance-based Methods for measuring air quality.

5.3 Work Plans

A proposed NAPS Program work plan will be prepared annually by EC for review and approval by the Parties prior to or as soon as possible after the start of the Fiscal Year to which the plan will apply.

5.4 Reporting on the MOU

The Parties to this MOU will report to the public by the NAPS Program Web site and to CCME on current NAPS Program activities and plans for the future development and operation of the NAPS Program. EC will be responsible for preparing a draft annual report for consideration of and finalization by the Parties.

6. OWNERSHIP AND SHARING OF DATA

Subject to the Parties' respective obligations, which may arise pursuant to applicable federal and provincial legislation, policies, and contractual obligations, the Parties agree that

(a) NAPS Data that is obtained by a Party using equipment deployed by EC at Designated NAPS Sites belongs to that Party. Notwithstanding this right of ownership, the Parties agree that a Party that owns the data will make best efforts to share it fully and freely among the Parties within six (6) months after it was obtained and disseminate it to the public as soon as is practicable. The Parties agree that all NAPS Data will be stored in the Canada-wide Air Quality Database;

(b) laboratory data obtained by EC by means of gravimetric or chemical analysis will belong to EC. Notwithstanding this right of ownership, EC agrees that it will share this gravimetric and chemical analysis data fully and freely among the Parties within six (6) months after it was obtained and disseminate it to the public as soon as is practicable;

(c) subject to paragraph (d), the owner of the NAPS Data obtained under (a) and laboratory data obtained under (b) hereby grants the other Parties non-exclusive and non-restricted rights to use the NAPS Data and laboratory data, including the right to publish it or have it published. It is understood and agreed by the Parties that all Parties have the right to use the NAPS Data on Web sites and in publications;

(d) the NAPS Data, laboratory data, acquisition methods, expertise, or any other information shared under this MOU shall not be disseminated for commercial purposes to any person or organization without the written consent of the Parties that own the NAPS Data, laboratory data, acquisition methods, expertise, or any other information;

(e) the sharing of data covered by this MOU does not preclude the development of other federal-provincial agreements that may be required to support other programs and applications; and

(f) the Parties will provide reciprocal credit and recognition to the Party who provided the data or information by, for example, indicating on Web sites, in publications, and where otherwise warranted such statement of acknowledgment, copyright, and logos identifying the Party who provided the data.

7. OBLIGATIONS UNDER THIS MOU

7.1 The Parties agree and understand that this MOU constitutes an administrative agreement between the Parties and nothing in this MOU is to be construed as creating any financial, legal or contractual relations between the Parties enforceable by a court of competent jurisdiction. This MOU is entered into solely for the purposes of sharing information and better management of financial and technical resources of the Parties, which will result in more effective monitoring of air quality in Canada.

7.2 A Party that produces data shall not in any way be held responsible for the way the data is used by another Party, or for the errors that could be contained in the data, or any direct or indirect damage that could be caused by use of the data.

7.3 Each Party agrees to notify the other Parties in writing as soon as possible if, due to circumstances beyond its control, it cannot meet the general terms and conditions of co-operation contained in the MOU. In that case, the Parties, with the defaulting Party's consent, will collectively consider actions that might be taken to assist the defaulting Party to honour this MOU.

8. TERMS OF THE MOU

8.1 This MOU will take effect on the Effective Date and will terminate five (5) years from the Effective Date.

8.2 Unless otherwise agreed to by the Parties, the Parties agree to review this MOU before six (6) months prior to its termination with the intent to renew it.

8.3 A Party may withdraw from this MOU by providing the other Parties with three (3) months written notice confirming its intention to withdraw.

8.4 The Parties agree that should a Party to the MOU withdraw,

(a) the data made available up until the official withdrawal date shall remain available to all the other Parties; and

(b) EC will remove within sixty (60) days all monitoring and sampling equipment provided under 3.1(d) from Designated NAPS Sites.

9. ANNEXES AND AMENDMENTS

9.1 The Parties will carry out this MOU in accordance with the terms and conditions herein and any applicable specifications found in the annexes. For greater certainty, it is agreed that the annexes to this MOU form part of this MOU.

9.2 Subject to Article 9.3, this MOU may be amended at any time with the written consent of all Parties.

9.3 The Parties agree that, for any proposed amendments made to an annex or annexes to this MOU, only the written consent of the Parties affected by the amendments will be required. For the purpose of amending annexes, those persons holding the positions identified in Schedule A to this MOU may sign on behalf of the Parties.

9.4 The Parties agree that applicable provisions in any one annex will be available for negotiation in annexes with other Parties.

4. EC will provide a dilution calibrator for the Alberta air monitoring network.

BRITISH COLUMBIA ANNEX

Delivery of the NAPS Program within British Columbia is a collaborative undertaking by the Government of British Columbia and the Greater Vancouver Regional District. The Greater Vancouver Regional District has been delegated provincial responsibilities for air quality monitoring through the B.C. Waste Management Act and through Letters Patent under the B.C. Municipal Act. British Columbia, for the purposes of meeting responsibilities under this MOU, has consulted with and received the concurrence of the Greater Vancouver Regional District with respect to the terms and conditions contained in the BC Annex. Such arrangements will not discharge British Columbia of its responsibilities under this MOU.

EC Responsibilities

1. EC is in agreement with the list of Designated NAPS Sites and NAPS monitoring equipment in British Columbia as identified in Table 1.

2. EC, subject to availability of resources, will provide new and replacement monitoring equipment as identified and prioritized in Table 2 at existing or newly Designated NAPS Sites in British Columbia.

3. EC, subject to availability of resources, will provide filter media and laboratory analysis for VOC, particulate mass and speciation monitoring, TEOM ACCU, dichotomous sampling, PAH/HAPS/aldehyde and other monitoring programs identified in Table 3.

4. EC quarterly will make available to British Columbia laboratory analytical data for discrete samples collected from sites identified in Table 3.

5. EC will provide laboratory based quality assurance/quality control calibration services for equipment and gases as specified in the most current annual work plan.

6. EC will provide audits of NAPS monitoring equipment at Designated NAPS Sites as specified in the most current annual work plan.

7. EC will provide technical consultative services as needed for the maintenance, repair and calibration of NAPS equipment.

British Columbia Responsibilities

1. British Columbia is in agreement with the list of Designated NAPS Sites and NAPS monitoring equipment in British Columbia as identified in Table 1.

2. British Columbia, subject to availability of resources, will install, operate and provide routine repair and maintenance on NAPS monitoring equipment at existing or newly Designated NAPS Sites as listed in Tables 1 and 2.

3. British Columbia, subject to availability of resources, will collect, process, quality assure, quality control and archive data from NAPS equipment operating at existing or newly Designated NAPS Sites as listed in Tables 1 and 2.

4. British Columbia will strive to achieve and maintain NAPS siting criteria for NAPS equipment identified at existing and newly Designated NAPS Sites as listed in Tables 1 and 2.

5. British Columbia will install, operate and return to EC at British Columbia's expense, sampling media (filters, canisters, cartridges, etc.) from NAPS VOC and particulate monitors as identified in Tables 1, 2 and 3, as appropriate. Sampling will occur on a mutually agreed schedule and sampling media will be returned to EC as soon as practicable after the sample has been collected.

6. British Columbia will provide a minimum of biannual audits of NAPS monitoring equipment at Designated NAPS Sites identified in Table 1 and at sites identified in Table 2, as they become active Designated NAPS Sites.

7. British Columbia will make available to EC, in a timely manner, raw and/or quality-controlled continuous data from NAPS monitoring equipment at Designated NAPS Sites identified in Table 1 and from equipment identified in Table 2 as they become operational at existing or newly Designated NAPS Sites.

8. British Columbia will provide technical consultative services to EC, as needed, in the management of NAPS Data and the operation, maintenance, repair and calibration of NAPS monitoring equipment at Designated NAPS Sites identified in Table 1 and for equipment identified in Table 2 as they become operational.

In the following tables, LFV refers to the Lower Fraser Valley Air Quality Monitoring Network, operated by the Greater Vancouver Regional District on behalf of themselves and the Fraser Valley Regional District.

Manitoba Responsibilities

1. Selection of Designated NAPS Sites in consultation with EC.

2. Installation, operation and maintenance of continuous and non-continuous NAPS equipment.

3. Replacement of defective components costing less than $500.

4. Installation and replacement of filters for non-continuous NAPS monitors.

5. Return of filters, canisters, cartridges, etc. to EC for analysis.

6. Automated collection, processing, quality control and archiving of hourly NAPS Data.

7. Allow EC near real-time access to NAPS hourly air quality data, as per mutually agreed arrangements.

8. Provision of quality assured continuous NAPS Data to EC within ninety (90) days of data collection.

NEW BRUNSWICK ANNEX

The Annex will be reviewed annually and may be revised with the agreement of both Parties.

EC Responsibilities

1. EC agrees to supply to New Brunswick new instrumentation as listed in Table 2 before March 31, 2003.

2. EC agrees to replace any defective component valued at $500 or more from any NAPS instruments listed in Table 1 and new instruments listed in Table 2.

3. EC agrees to replace NAPS instruments that fail due to rust out, obsolescence or other inherent limitation causing inadequate performance.

4. EC will provide sampling media for non-continuous samplers, including filters, VOC canisters, and filter packs, for the equipment at Designated NAPS Sites.

5. EC will analyze the exposed sample media and provide the analytical results to New Brunswick within three months following receipt of sample or as soon as is practicable thereafter.

6. EC will provide laboratory-based calibration services for quality assurance equipment and gases.

7. EC will provide compressed gas cylinders for instrument testing and calibration, as required.

8. EC will conduct selected field audits at the Designated NAPS Sites listed in Table 1.

9. EC will provide technical consultative service as required in instrument maintenance, calibration and repair.

10. EC will support New Brunswick in the operation of monitoring sites providing real time ozone and fine particulate data required for the Air Quality Prediction Program, as prescribed in the Letter of Agreement between EC and New Brunswick dated September 26, 2002.

New Brunswick Responsibilities

1. New Brunswick will install, operate, and provide routine repair and maintenance on NAPS instruments at the Designated NAPS Sites listed in Tables 1 and 2.

2. New Brunswick will collect, process, perform quality control and archive data collected from continuous monitoring instruments operating at the Designated NAPS Sites listed in Tables 1 and 2 and at New Brunswick Sites listed in Table 3 and forward the preceding year's quality-assured data to EC by March 31 each year, or as soon as is practicable thereafter.

3. New Brunswick will install sampling media in non-continuous sampling equipment at Designated NAPS Sites listed in Table 1 and will return the sampling media, at its own expense, to EC for analysis.

4. New Brunswick will provide real-time data to EC, Atlantic Region, from ozone and fine particulate monitoring sites in New Brunswick to support the Air Quality Prediction Program.

NEWFOUNDLAND AND LABRADOR ANNEX

The Annex is to be reviewed annually and revised as appropriate to keep information current and to formalize a work plan for each Fiscal Year.

EC Responsibilities

1. EC will support as herein provided the stations listed in Table I as Designated NAPS Sites.

2. EC, subject to availability of resources, will provide new monitoring equipment, whether to increase monitoring capacity or replace existing equipment due to "rust-out", to the Designated NAPS Sites as outlined in Table I.

3. EC, subject to availability of resources, will provide equipment such as data-loggers to the Designated NAPS Sites where EC requires data in a timely fashion to support Air Quality Prediction Programs.

4. EC will provide summa canisters, PAH sampling filters and laboratory analysis for the Designated NAPS Sites conducting VOC and PAH monitoring as listed in Table I. EC agrees to provide the analytical results to Newfoundland and Labrador as soon as is practicable.

5. EC will provide laboratory-based calibration services for equipment and gases to ensure quality assurance as specified in annual work plans.

6. EC will provide field audits for the equipment at the Designated NAPS Sites as specified in annual work plans.

7. EC will provide technical consultative services, as needed, in maintenance, repair and calibration of equipment at Designated NAPS Sites.

8. EC will place all data received from Newfoundland and Labrador in a national database and will utilize this data in preparation of annual summary reports.

Newfoundland and Labrador Responsibilities

1. Newfoundland and Labrador will operate the Designated NAPS Sites listed in Table I, including automated collection, processing, quality control and archiving of hourly data, and forward the air monitoring data as soon as is practicable to EC.

2. Newfoundland and Labrador, subject to availability of resources, will provide routine repair and maintenance on NAPS Program monitoring equipment at Designated NAPS Sites identified in Table I.

3. Newfoundland and Labrador will install the monitoring equipment and return at its own expense to EC as soon as practicable the sampling media (filters, canisters) from VOC and PAH monitoring as listed in Table I.

4. Newfoundland and Labrador will conduct routine calibration of monitoring equipment at Designated NAPS Sites identified in Table I.

5. Newfoundland and Labrador will provide access to real time data for the Air Quality Prediction Program from Designated NAPS Sites indicated in Table I.

NORTHWEST TERRITORIES ANNEX

EC Responsibilities

1. EC will support as herein provided the stations listed in Table 1 as Designated NAPS Sites. EC will provide the equipment listed in Table 2, for the Designated NAPS Sites, to the Northwest Territories by March 2002.

2. Further, EC plans to provide the equipment as listed in Table 3 in the Fiscal Years 2002, 2003 and 2004. This is to be confirmed by means of annual work plans to be agreed upon by EC and the Northwest Territories by June 30 each year.

3. EC will provide sampling media (filters, filter packs and summa canisters) to measure various chemicals at the sites listed in Table 1 to support air toxics monitoring. EC will analyse these sample media and provide the analytical results to the Northwest Territories as soon as practicable.

4. EC will provide laboratory-based calibration services for quality assurance equipment and gases as determined in annual work plans.

5. EC will provide daily continuous analyser calibration supplies (zero scrubbers, compressed gas span cylinders) as determined in annual work plans.

6. EC will provide field audits as determined in annual work plans.

7. EC will provide assistance in instrument maintenance, calibration and repair training where required and as determined in annual work plans.

8. EC will place all the data received from the Northwest Territories in the Canada-wide Air Quality Database (CWAQ) and all the data in CWAQ will be available to the Northwest Territories.

Northwest Territories Responsibilities

1. The Northwest Territories will operate the Designated NAPS Sites as listed in Table 1, including automated collection, processing, quality control and archiving of hourly data and forward the air monitoring data as soon as is practicable to EC. In addition, the Northwest Territories will forward data from the Northwest Territories-owned sites listed in Table 1.

2. The Northwest Territories will install sampling equipment as per the sampling schedule and return the sampling media (filters, canisters and cartridges) listed in Table 4, at its own expense, to EC as soon as practicable.

NOVA SCOTIA ANNEX

EC Responsibilities

1. EC agrees to support as herein provided the stations listed in Table 1 as Designated NAPS Sites. As outlined in point 2 below, EC commits to providing to Nova Scotia the monitoring equipment needed to support the measurement of the pollutants as listed in the "Pollutants to Be Monitured" column of Table 1.

2. EC will provide the equipment listed in the "Proposed Instruments" column of Table 1 during the Fiscal Years 2002, 2003 and 2004. This is to be confirmed by means of annual work plans to be agreed upon by June 30th of each Fiscal Year. EC will replace equipment needed to support the measurement of the pollutants listed in Table 1 as the equipment reaches the end of its useful life. By agreement between the parties, further equipment may be added, if deemed necessary, to meet national obligations such as the smog forecast and/or air quality index programs.

3. EC agrees to provide sampling media, as determined in annual work plans, to measure particulate matter and VOCs at the stations listed in Table 1. EC agrees to analyse these sample media and to provide the analytical results to Nova Scotia as soon as is practicable.

4. EC agrees to provide laboratory based calibration services for quality assurance equipment and calibration gases as determined in annual work plans.

5. EC agrees to provide daily continuous analyser calibration supplies as determined in annual work plans.

6. EC agrees to provide field audits as determined in annual work plans.

7. EC agrees to provide assistance and training in instrument maintenance, calibration and repair where required, and as determined in annual work plans.

8. EC agrees to provide training on the quality assurance, quality control, and management of air quality data as outlined in the National Air Pollution Surveillance Network — Quality Assurance and Quality Control Guidelines.

9. EC will archive all the data received from Nova Scotia in the Canada-wide Air Quality Database and all the data in the database will be available to Nova Scotia.

Nova Scotia Responsibilities

1. Nova Scotia agrees to operate Designated NAPS Sites as listed in Table 1, including automated collection, processing, quality control, validation, and archiving of hourly data, and to forward the air monitoring data as soon as is practicable to EC. In addition Nova Scotia agrees to forward validated data from sites listed in Table 2.

2. Nova Scotia agrees to install and operate sampling equipment as per the sampling schedule and return the sampling media, supplied for filter-based particulate and VOC measurements, to EC as soon as practicable and at its own expense.

3. Nova Scotia agrees to provide access to real time data for the Air Quality Prediction Program from sites noted for this purpose in Table 1 and Table 2.

Joint Responsibility

1. Sites and monitors as listed in Table 2 should be considered for inclusion as Designated NAPS Sites in the development of the work plan for the 2003/2004 Fiscal Year.

1. EC agrees to support as herein provided the stations listed in Table 1 as Designated NAPS Sites and agrees to maintain these sites.

2. EC has no current plans to provide any additional monitoring equipment to the Designated NAPS Sites listed in Table 1. However, should additional monitoring equipment be required in the future, EC will identify the equipment to be supplied in an annual work plan, which must be agreed upon by both Parties to this Annex by June 30 of the Fiscal Year in which the equipment is required.

3. Notwithstanding Point 2 above, EC, subject to availability of resources, agrees to repair or replace equipment at the Designated NAPS Sites listed in Table 1 that has suffered major damage which precludes its continued operation, and agrees to replace equipment that fails due to rust out, obsolescence or inadequate technology.

4. EC agrees to provide sampling media (filters) for the equipment at Designated NAPS Site No. 129302 to support non-continuous monitoring for total suspended particulates and particulate matter 10. EC agrees to analyze these sample media and to provide the analytical results to Nunavut as soon as is practicable.

5. EC agrees to provide laboratory-based calibration services for quality assurance equipment and gases, as specified in annual work plans.

6. EC agrees to provide calibration supplies as required.

7. EC agrees to provide field audits of monitoring equipment at the Designated NAPS Sites listed in Table 1, as specified in annual work plans.

8. EC agrees to provide technical assistance in instrument maintenance, calibration and repair, as required.

Nunavut Responsibilities

1. Nunavut, subject to availability of resources, will install, operate, and provide routine repair and maintenance on NAPS monitoring equipment at the Designated NAPS Sites listed in Table 1.

2. Nunavut agrees to collect, process, control the quality and archive data collected from monitoring equipment operating at the Designated NAPS Sites listed in Table 1. Nunavut will forward the quality-assured data to EC as soon as is practicable.

3. Nunavut agrees to install sampling media (filters) in non-continuous sampling equipment, as per the sampling schedule, operating at Designated NAPS Sites listed in Table 1. Furthermore, Nunavut agrees to return the sampling media, at its own expense, to EC for analysis as soon as is practicable.

4. It is agreed that the high-volume air sampler currently in operation at Designated NAPS Site No. 129303 will continue to be operated for one (1) year after the installation of the Partisol PM-10 Air Sampler, after which the former will be dismantled and returned to EC at Nunavut's expense unless one or the other Party is desirous of continuing with its operation.

ONTARIO ANNEX

EC Responsibilities

1. EC agrees to support the stations listed in Table 1 as Designated NAPS Sites. EC has committed to and has purchased air monitoring equipment totalling $554,872 in fiscal year 2001/02.

2. Further, EC agrees to provide monitoring and sampling equipment, spare parts and replacement parts to a total amount of not less than $750 000 per year in Fiscal Years 2002/03, 2003/04 and 2004/05. Details are to be confirmed through annual work plans to be agreed upon by June 30 of each year.

3. EC agrees to the replacement of NAPS equipment due to obsolescence or irreparable damage.

4. EC agrees to replace any defective instrument components valued at $500 or more.

5. EC agrees to provide laboratory-based calibration services for quality assurance equipment and calibration gases, as determined in the work plans.

6. EC agrees to provide daily continuous analyser supplies (zero scrubbers, compressed gas span cylinders), as determined by the work plans.

7. EC agrees to provide training with respect to instrument maintenance, calibration and repair where required and as determined in annual work plans.

8. EC agrees to provide field audits as defined in the work plans.

9. EC agrees to provide all canisters, related hardware, filters, and filter packs for air toxic monitoring. EC agrees to analyse these sample media and to provide analytical results to Ontario within the first four (4) months of the next calendar year.

10. EC agrees to operate the Designated NAPS Site at Ottawa (Rideau/Wurtemburg) for Ontario with Ontario's ambient air monitoring protocols.

Ontario Responsibilities

1. Ontario agrees to operate all Designated NAPS Sites, as listed in Table 1, with the noted exception of the Ottawa (Rideau/Wurtemburg) Site.

2. Ontario agrees to provide automated collection, processing, quality control and archiving of hourly data from Designated NAPS Sites.

3. Ontario agrees to ensure that data from Designated NAPS Sites are fully quality controlled and archived. Ontario agrees to provide an ASCII data set containing all hourly concentration data for the continuous monitoring at Designated NAPS Sites (as listed in Table 1) to EC within six (6) months of the next calendar year.

4. Ontario agrees to provide ozone and PM2.5 data in near real time from selected Designated NAPS Sites in support of the US Environmental Protection Agency/EC air quality mapping exercises.

4. 7. EC agrees to provide daily continuous analyzer calibration supplies (zero scrubbers and compressed span gases), as determined in the annual work plans.

P.E.I. Responsibilities

1. P.E.I. agrees to operate the Designated NAPS Sites (Table 1), including automated collection, processing, quality control and archiving of hourly data, and to forward the air monitoring data as soon as is practicable to EC.

2. P.E.I. agrees to install and operate sampling equipment as per the sampling schedule and return the sampling media, supplied for filter-based particulate measurements, to EC as soon as practicable and at its own expense.

3. P.E.I. agrees to pay for the repair of the equipment listed in Table 1 (including any additional equipment supplied by EC in the future), or for the replacement of defective components, costing less than $500.

4. P.E.I. agrees to provide access to real-time data for the Air Quality Prediction Program from the sites noted for this purpose.

5. P.E.I. agrees to select additional Designated NAPS Sites in consultation with EC.

QUEBEC ANNEX

Any modification or amendment of this Annex requires the signature of both Parties.

Delivery of the NAPS Program within Quebec is a collaborative undertaking by the Province of Quebec and the Ville de Montréal. Quebec, for the purposes of meeting responsibilities under this MOU, will make necessary arrangements with the Ville de Montréal. Such arrangements will not discharge Quebec of its responsibilities under this MOU.

With respect to the management of this Annex and of the annual action plans, Quebec shall be the sole party authorized to deal with EC.

The Parties agree to systematically inform each other, as soon as possible following their implementation, of any steps taken involving the NAPS Program within Quebec.

EC Responsibilities

1. EC agrees to support the stations listed in Table 1 as Designated NAPS Sites.

As stated in article 2 below, EC agrees to provide Quebec with the necessary sampling equipment to measure the pollutants listed in the "Pollutants to Be Monitored" column of Table 1, for the purposes of the programs listed in the "Federal Programs Covered" column of that Table. EC also agrees to maintain these stations in accordance with the provisions set out in the MOU.

2. Subject to resource availability, EC also agrees to provide Quebec with the equipment listed in the column "Sampling Equipment to be Replaced (r) or Added (a)" of Table 1 during the 2002-2003, 2003-2004 and 2004-2005 Fiscal Years.

The details of these operations will be confirmed in the annual action plan to be agreed upon by the Parties prior to June 30 of each Fiscal Year concerned.

Other equipment may be added to the list set out in Table 1 if deemed necessary to meet national requirements of the smog forecast and air quality index programs.

3. EC agrees to replace sampling equipment that has reached the end of its useful life (obsolete, technically inadequate, irreparable damage, too costly to maintain, etc.). Provision of this equipment will be confirmed in the annual work plan.

4. EC agrees to replace any defective sampling equipment components when the unit cost of these components is $500 or higher.

5. In order to facilitate ambient air sampling, EC agrees to provide the sampling media (filters for dichotomous samplers and filters for PAHs, cartridges containing polyurethane foam for PAHs, VOC canisters, filter packs for polar VOCs — aldehydes and ketones) needed to measure various chemical compounds at the stations listed in Table 2.

EC agrees to analyze these sampling media. EC also agrees to provide the analytical results to Quebec, on a monthly basis, within six (6) months of receipt of the samples at the laboratory.

6. EC agrees to provide basic equipment calibration services and calibration gases required for quality assurance, as set out in the annual work plan.

7. EC agrees to provide the sampling supplies (zero filter cartridges, permeation tubes for SO2 samplers, compressed gas cylinders) for the purposes of the daily calibration of the continuous analysers, as set out in the annual work plan.

8. EC agrees to conduct the system or station audits set out in the annual work plan.

9. EC agrees to collaborate in any other quality assurance-related activity (interlaboratory comparison, colocation or intercomparison of equipment, etc.) as set out in the annual work plan.

10. When required or stipulated in the annual work plans, EC agrees to provide the necessary assistance to support technical training concerning the installation, operation, maintenance, calibration and repair of the sampling equipment or for any other activity deemed necessary for the effective operation of the NAPSP.

11. EC agrees to incorporate all data received from Quebec in the Canada-wide Air Quality Database and to make all the data in this database available to Quebec.

Quebec Responsibilities

1. Quebec agrees to select the Designated NAPS Sites in co-operation with EC.

2. Quebec agrees to install at its own expense the sampling equipment provided by EC in accordance with the timetable set out in the annual work plan.

3. Quebec agrees to replace any defective sampling equipment components when the unit cost of these components is less than $500.

4. Quebec agrees to operate the sampling equipment provided by EC in accordance with the applicable rules and standards of the NAPSP.

5. For the Designated NAPS Sites listed in Table 1, Quebec agrees to ensure the operation, including automated collection, processing, quality control and archiving of hourly sampling data. Quebec agrees to provide these data to EC, annually, within 90 days of the end of the calendar year.

6. Quebec similarly agrees to forward to EC the data from the sampling equipment and stations supported exclusively by it and listed in Table 3.

7. For the Designated NAPS Sites listed in Table 2, Quebec agrees to pay the costs of operations to install and retrieve the sampling media provided by EC (described in article 5 of the section entitled "Environment Canada Responsibilities"), and to send them as quickly as possible to the EC laboratory. Quebec agrees to conduct these operations in accordance with the sampling schedule set out in the annual work plan.

8. For the purposes of the Air Quality Prediction Program, Quebec agrees to disseminate in real time, on its FTP site, the hourly data on the pollutants marked with an asterisk in Tables 1 and 3.

9. In order to facilitate ambient air sampling, Quebec agrees to provide the sampling media (filters for TSP, PM10 and PAHs, cartridges containing polyurethane foam for PAHs, filter packs for polar VOCs — aldehydes and ketones) needed to measure various chemical compounds at the stations listed in Table 4. Quebec agrees to analyse these sampling media. In addition, Quebec agrees to provide the analytical results to EC annually, within six (6) months of the end of the calendar year.

10. Notwithstanding of the preceding paragraphs 1 to 10, EC is solely responsible for the maintenance and operation of the stations that it owns in Quebec and for the management and dissemination of the data originating from the same stations. EC also agrees to pay the costs of these activities, unless otherwise agreed by the Parties.

SASKATCHEWAN ANNEX

EC Responsibilities

1. EC agrees to support as herein provided the stations listed in Table 1 as Designated NAPS Sites. EC commits to providing to or purchasing the equipment for the Designated NAPS Sites as listed in Table 2, either as part of the rust-out program, when it becomes more practical for replacement rather than repair, or to keep consistent with the air toxics/CWS program. EC also agrees to maintain these sites as per section 3 of the MOU.

2. EC agrees to expand the Saskatchewan network by providing support for two new Designated NAPS Sites and providing instrumentation and data acquisition systems as listed in Table 4, by March 2003.

3. Further, EC plans to provide the equipment listed in Table 2 in Fiscal Years 2002, 2003 and 2004. This is to be confirmed by means of annual work plans to be agreed upon by June 30th of each Fiscal Year.

4. EC agrees to provide sampling media (filters, filter packs and summa canisters) to measure mass from particulate matter and various chemicals sampled at the stations listed in Table 1. EC agrees to analyse these sample media and to provide the analytical results to Saskatchewan as soon as is practicable.

5. EC agrees to provide laboratory-based calibration services for quality assurance equipment and calibration gases, as determined in annual work plans.

6. EC agrees to provide calibration supplies (zero scrubbers, compressed gas span cylinders) for continuous analysers as determined in annual work plans.

7. EC agrees to provide field audits as determined in annual work plans.

8. EC agrees to provide assistance in instrument maintenance, calibration and repair training where required and as determined in annual work plans.

9. EC agrees to provide training on following the quality assurance and quality control guidelines as outlined in the National Air Pollution Surveillance Network — Quality Assurance and Quality Control Guidelines.

10. EC will place all the data received from Saskatchewan in the Canada-wide Air Quality Data Base, and all the data in CWAQ will be available to Saskatchewan.

Saskatchewan Responsibilities

1. Saskatchewan agrees to operate Designated NAPS Sites as listed in Table 1, including automated collection, processing, quality control and archiving of hourly data and to forward the air monitoring data as soon as is practicable to EC.

2. Saskatchewan agrees to install in sampling equipment as per the sampling schedule and return at its own expense to EC as soon as practicable the sampling media (filters, canisters, cartridges) from stations as listed in Table 3.

3. Saskatchewan agrees to provide access to real time data for the Air Quality Prediction Program from sites noted for this purpose in Table 1.

YUKON ANNEX

EC Responsibilities

1. EC agrees to support as herein provided the stations listed in Table 1 as Designated NAPS Sites, and agrees to maintain the sites in accordance with the MOU.

2. EC has no current plans to provide any additional monitoring equipment to the Designated NAPS Sites listed in Table 1. However, should additional monitoring equipment be required in the future, EC will identify the equipment to be supplied in an annual work plan, which must be agreed upon by both Parties to this Annex by June 30th of the Fiscal Year in which the equipment is required.

3. Notwithstanding Point (2) above, EC, subject to availability of resources, agrees to repair or replace equipment at the Designated NAPS Sites listed in Table 1 that has suffered major damage which precludes its continued operation, and agrees to replace equipment that fails due to rust out, obsolescence or inadequate technology.

4. EC agrees to provide laboratory-based calibration services for quality assurance equipment and gases as specified in annual work plans.

5. EC agrees to provide continuous analyzer calibration supplies (zero scrubbers, compressed gas span cylinders) as required.

6. EC agrees to provide field audits of monitoring equipment at the Designated NAPS Sites listed in Table 1, as specified in annual work plans.

7. EC agrees to place all of the data received from Yukon in the Canada-wide Air Quality Database and all of the data in the Database will be available to Yukon.

8. EC agrees to provide training on the quality assurance, quality control, and management of air quality data as outlined in the National Air Pollution Surveillance Network — Quality Assurance and Quality Control Guidelines.

9. EC agrees to provide the necessary assistance to support technical training concerning the installation, operation, maintenance, calibration and repair of the sampling equipment or for any other activity deemed necessary for the effective operation of the NAPS program.

Yukon Responsibilities

1. Yukon, subject to availability of resources, will install, operate, and provide routine repair and maintenance on NAPS monitoring equipment at the Designated NAPS Sites listed in Table 1.

2. Yukon agrees to collect, process, quality control and archive data collected from continuous monitoring equipment operating at the Designated NAPS Sites listed in Table 1. Yukon will forward the quality-assured data to EC as soon as is practicable.
