Current Regulations

New Substances Fees Regulations (SOR/2002-374)


The New Substances Fees Regulations (NSFR) came into effect on January 1, 2003, under section 328 of the Canadian Environmental Protection Act, 1999 (CEPA 1999). Importers and manufacturers of a new chemical or polymer who notify the government that they are introducing a new substance into Canada must pay a fee, in addition to providing the information prescribed in the CEPA 1999 New Substances Notification Regulations (NSNR).

Environment Canada is responsible for administering the NSFR, which are intended to recover approximately 20% of the New Substances Program's total annual costs.

An industry/government advisory panel has been established and is meeting as required to discuss issues of program delivery and cost recovery under the New Substances Program and to review the fee structure of the NSFR as required.

A "Guide to the New Substances Fees Regulations" is available to provide general guidance to notifiers in understanding the NSFR and to assist in determining the applicable fees for notifying a new substance.

Note: The fees do not apply at this time to a substance that is an animate or inanimate product of biotechnology, or to the notifier of a new substance that is manufactured or imported for a use that is regulated under any other Act of Parliament, including the Food and Drugs Act, the Fisheries Act and the Health of Animals Act.
