Ontario Company Fined $5,000 for an Offence Under the Food and Drugs Act

A conviction was registered against Mucci Pac Ltd. in Provincial Court in Leamington on April 11, 2006, resulting in a fine of $5,000. The fine was the result of a guilty plea to one count of violating the Food and Drugs Act.

In November 2005, Canadian Food Inspection Agency inspectors visited the premises of Mucci Pac Ltd. in Kingsville, Ontario to conduct a routine inspection on lots of tomatoes for sale. The inspectors found the tomatoes, which originated from Mexico, being packaged as Product of Canada. The company’s action was contrary to section 5.(1) of the Food and Drugs Act.

Section 5.(1) states:

No person shall label, package, treat, process, sell or advertise any food in a manner that is false, misleading or deceptive or is likely to create an erroneous impression regarding its character, value, quantity, composition, merit or safety.
