Prohibition of Certain Toxic Substances Regulations, 2005 (SOR/SOR/2005-41)
The Prohibition of Certain Toxic Substances Regulations, 2005 (hereafter referred to as the Regulations) are made pursuant to subsection 93(1) of the Canadian Environmental Protection Act, 1999 (CEPA 1999). The Regulations repeal the Prohibition of Certain Toxic Substances Regulations, 2003 (hereafter referred to as the 2003 Regulations).
The Regulations prohibit the manufacture, use, sale, offer for sale and import of the toxic substances listed in Schedules 1 and 2 to the Regulations. Schedule 1 lists prohibited toxic substances subject to total prohibition, with the exception of incidental presence. Schedule 2 includes toxic substances that are subject to prohibitions related to concentration or use. The 2003 Regulations included only one schedule that subjected all listed toxic substances to the same regulatory requirements. As such, the restructured Regulations facilitate more flexible management of the scheduled toxic substances, by providing more targeted regulatory controls. They also facilitate the addition of new toxic substances to the two Schedules in the future.
