Notice is hereby given that the Governor in Council, pursuant to subsection 64(1)a of the Health of Animals Actb,
proposes to make the annexed Regulations Amending the Health of Animals Regulations.
Interested persons may make representations with respect to the proposed Regulations
within 30 days after the date of publication of this notice. All such representations must
cite the Canada Gazette, Part I, and the date of publication of this notice and
be sent to Dr. Penny Greenwood, Animal Health and Production Division, Canadian Food

1. The Health of Animals Regulations1
are amended by adding the following after section 90: Sampling
91. (1) For the purpose of subsection 6(2) of the Act, the prescribed
manner of supplying a sample of an animal or of any other thing as requested by the
Minister under that subsection is to provide the sample to an inspector, or as directed by
an inspector, with the sample bearing identification traceable to the animal or thing.
(2) The Minister's request under subsection 6(2) of the Act |

(a) shall be in writing; (b) shall be communicated by personal
delivery to the person requested to provide a sample;
(c) shall specify the sample to be provided; and
(d) may specify the circumstances in which the sample is to be provided, the
time at which, or the period within which, it is to be provided, the manner and conditions
in which it is to be provided and the place or places where it is to be provided. |
(3) Every person who owns or has the possession, care or control of an
animal or thing shall permit testing of the animal or thing by an inspector to determine
the presence or absence of disease or contamination with a toxic substance.coming into force
2. These Regulations come into force on the day on which they are registered. |
