Ontario Company Fined $12,000 for Offences Under the Food and Drugs Act

Convictions were registered against 1639779 Ontario Inc. in Provincial Court in Toronto on April 24, 2006, resulting in a $12,000.00 fine. The fine was the result of guilty pleas to two offences under the Food and Drugs Act.

In August 2004, a Canadian Food Inspection Agency investigation found borate contamination in a sample of Rommens Heydary BLC Beluga Caviar. The ingestion of borates can cause nausea, vomiting and digestive upset. The sale of food that is poisonous or harmful is prohibited by paragraph 4(a) of the Food and Drugs Act.

DNA testing on the "Rommens Heydary BLC Beluga Caviar" sample also determined that it was not from the Beluga species. Its label was misleading regarding its composition, contrary to subsection 5(1) of the Food and Drugs Act. As the price of caviar depends upon its species, consumers rely upon labels to make an informed decision about what they buy.
