Court Fines Halifax Seafood Limited $3,000 for contravening the Fish Inspection Regulations

On June 15, 2004 Halifax Seafood Limited, a fish importing company based at 85 Spinnaker Drive, Halifax, Nova Scotia, pled guilty in Provincial Court in Halifax, Nova Scotia to contravening paragraph 6. (2)(e) and paragraph 6.1 (3)(a) of the Fish Inspection Regulations.

An investigation conducted by the Canadian Food Inspection Agency (CFIA) determined that between November 3, 2002 and November 22, 2002 the accused unlawfully failed to notify the CFIA within 48 hours of the arrival of a shipment of imported fish and unlawfully failed to maintain records indicating the name and address to whom each shipment was sent by the accused as well as the date of expedition.

Paragraph 6. (2)(e) of the Fish Inspection Regulations states:

No person shall import into Canada or attempt to import into Canada any fish unless written notification of each shipment of fish to be imported or that is imported is provided to an inspector either prior to the importation or within 48 hours following the importation

Paragraph 6. 1(3) (a) of the Fish Inspection Regulations states:

An importer of fish shall maintain, at an address in Canada and for not less than three years, a record in English or French of the name and address of the person to whom each shipment of fish was shipped from the importer and the date on which the fish was shipped;

The Court sentenced the accused to fines respectively of $2,000 and $1,000.

CFIA prosecution bulletins report on legal proceedings in which a conviction has been obtained. In publishing them, we are seeking to increase awareness of the Agency’s role in enforcing the Acts and Regulations for which it is responsible. Under its mandate, CFIA provides Canadian businesses and consumers with inspection and related services that contribute to improving the overall integrity of the food safety, animal health and plant protection systems.
