Millstream Flour Mills ordered to develop an allergen prevention plan

On January 21, 2005, Millstream Flour Mills (1991) Corporation of Victoria, B.C., entered a guilty plea in provincial court to one count of violating the Food and Drugs Act and was fined $7,500.

Millstream Granola with Raisins was sold containing sesame seeds that were not declared on the product label and was also sentenced to probation until December 31, 2005. During the probation period, the company must develop an allergen prevention plan with the goal of implementing a quality control system that prevents similar incidents. The company had previously been convicted in September 2003 for selling Millstream Granola containing undeclared sunflower seeds and was fined $8,500.

Under section 5(1) of the Food and Drugs Act no person shall label, package, treat, process, sell or advertise any food in a manner that is false, misleading, or deceptive or is likely to create an erroneous impression regarding its character, value, quantity, composition, merit or safety.
