License Agreement for Use of Environment Canada GRIB Data Product

LIMITED USE DATA PRODUCT LICENSE AGREEMENT

GRANT OF LICENSE

The Government of Canada (Environment Canada) is the owner of all Intellectual Property Rights (including copyright) associated to this Data Product. You are granted a limited, non-exclusive, non-assignable and non-transferable license to use this Data Product subject to the terms below. This license is not a sale of any or all of the owner's rights. This Data Product may only be used by you, and you may not rent, lease, lend, sub-license or transfer the data product or any of your rights under this agreement to anyone else, except under the following terms and conditions.

REDISTRIBUTION RESTRICTIONS

You are authorized to further distribute the data including any portion of it, contained in this Data Product under the following conditions only. No fee will be charged explicitly for this Environment Canada product to any party to whom it is distributed. (Charges for value-added services are permitted.) If the information contained in the data is left unmodified (in any derivative product) then Environment Canada must be accredited as the source of the product that is distributed. In the case of redistribution via the Internet, an approved Environment Canada logo is presented at the point of access to the product. Redistribution to any other party is only permitted when that party has agreed to the terms of this License.

NO WARRANTIES

Environment Canada does not warrant the quality, accuracy, or completeness of any information or data. Such information and data are provided on an "AS IS" basis without warranty or condition of any nature. Environment Canada disclaims all other warranties, expressed or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose, with respect to the data retrieved from this product, and any accompanying materials.

RESTRICTION AND LIMITATION OF LIABILITY

In no event shall Environment Canada be liable for any damages whatsoever arising out of or in connection with the use of, or inability to use this Environment Canada Data Product, even if Environment Canada has been advised of the possibility of such damages. This is a comprehensive limitation of liability that applies to all damages of any kind including (without limitation) compensatory, direct, indirect or consequential damages, loss of data, income, or profit, loss of or damage to property, and claims of third parties.

RESPONSIBLE USE

Should the Data Product be used in a scientific study Environment Canada will be accredited as the source of the data and should be informed of the study. It is YOUR RESPONSIBILITY to ensure that your use of this Data Product complies with these terms and to seek prior written permission from Environment Canada and pay any additional fees or royalties, as may be required, for any uses not permitted or not specified in this agreement.

UNLAWFUL USE IS PROHIBITED

For the purpose of this license, "unlawful use" is interpreted broadly to include actions that could result in sanctions of different kinds in a court of law. This includes criminal offences or failure to observe statutory requirements. The following examples of "unlawful use" of the Data Product considered as "criminal offences" include but are not limited to:

  • used in association with any child pornography;
  • used in disseminating messages that promote hatred or incite violence against identifiable groups;
  • used in association with hacking and other crimes related to computer security, which include gaining unauthorized access to a computer system; trying to defeat the security features of the electronic networks; spreading viruses with the intent to cause harm; destroying, altering or encrypting data without authorization and with the intent of making it inaccessible to others with a lawful need to access it; and interfering with others' lawful use of data and computers.

UNACCEPTABLE USE

Unacceptable activity is prohibited. The following examples of "unacceptable use " of the Data Product, include but are not limited to:

  • used in association with actions that may cause congestion and disruption of networks and systems;
  • used in association with abusive, sexist or racist messages to individuals;
  • used in association with literature that incites hatred against identifiable groups; or
  • used in distributing, publishing or possessing for the purpose of distributing or publicly displaying any obscene material, and whose main focus is pornography, nudity, and sexual acts.

ACCEPTANCE OF THIS AGREEMENT

Any use whatsoever of this Data Product shall constitute your acceptance of the terms of this agreement.
