Data Release Agreement

between Her Majesty the Queen in the Right of Canada, as represented by the Prairie Farm Rehabilitation Administration of Agriculture and Agri-Food Canada, hereafter referred to as "PFRA"

hereafter referred to as the "USER"

PFRA has provided the user with a geographic data set hereafter referred to as the "PFRA data"

  1. By downloading the PFRA data, the USER accepts the terms and conditions of this Agreement.
  2. The PFRA data will be released to the USER upon completion of the registration form.
  3. The USER allows PFRA to contact the USER regarding data updates, or to provide information on the use of the data.
  4. The USER acknowledges that PFRA has provided the data to the USER at no charge.
  5. Copyright and all other intellectual property rights of the publications of PFRA, including all material on this web site, belong exclusively to Her Majesty the Queen in Right of Canada as represented by PFRA. No person may copy, transfer, print, distribute, redistribution by any means (or otherwise use this material for profit), except in accordance with the terms of this Data Release Agreement and with the express written consent of PFRA.
  6. The USER shall, each time the PFRA data or a portion of the PFRA data is used, provide proper acknowledgements of the source of this data.
  7. PFRA makes no representations nor warranties respecting the PFRA data.
  8. Her Majesty the Queen in the Right of Canada shall NOT be responsible and shall be exempted from any liability in all respects in connection with the PFRA data, regardless of any inaccuracies, omissions or errors contained therein or any problems connected therewith.
  9. The USER shall indemnify and save harmless Her Majesty the Queen in the Right of Canada, Her servants and employees from and against and be responsible for any claim, demand, damage, loss, cost, expense, including solicitor/client and administrative fee and disbursement, action, cause of action, or other proceedings, including settlement, compromise or judgement, arising out ot or resulting from, or attributable to directly or indirectly, the download or use of the PFRA data, the action, omission, performance, breach, remedying or performance or breach on the part of the User in connection with this Agreement.
  10. PFRA is satisfied that PFRA data are compliant with Year 2000 standards; however, PFRA does not guarantee that the same will be compliant with Year 2000 standards under all conditions or for all Users. PFRA recommends that the User test the data for Year 2000 compliance under the User's own conditions.
  11. Any breach of any of the paragraphs herein may result in PFRA refusing to provide any further PFRA data from the date of breach.
