What responsibilities do employers have.

Employers of caregivers have responsibilities that are governed by the:

  • Ontario Ministry of Labour
  • Canada Customs and Revenue Agency (CCRA)
  • Workplace Safety and Insurance Board (WSIB)

The Ontario Ministry of Labour makes the rules pertaining to employment under the guidance of the Employment Standards Act. The Ministry provides the following publications as guides for caregivers and employers:


The CCRA makes the rules pertaining to taxation and the deductions that must be made from an employee's salary.

The WSIB administers Ontario's workplace insurance program for employers and their employees under the Workplace Safety and Insurance Act.

What records must be kept

The Employment Standards Act requires employers to keep records showing:

  • Hours worked daily
  • Hours worked weekly
  • Wages paid
  • Amount of, and reason for, each deduction from an employee's pay

 

What are the rules regarding employee compensation

The Employment Standards Act provides guidelines for employers in matters concerning employee compensation.

Ontario Prevailing Wage Rates and Room and Board Rates

Hours of Work 30 to 48 hours per week
Over 44 Hours per week Paid at time and a half
   
Maximum Room and Board: $85.25 per week

What are the rules regarding time off

The Employment Standards Act requires employers to give employees time off on a weekly and an annual basis.

The following table summarizes the time off entitlements for caregivers.

Requirement Details
Weekly Breaks Employers must give caregivers a minimum of 2 free rest periods each week consisting of:
  • 1 period of 36 hours in a row, and
  • 1 period of 12 hours in a row.
Annual Vacation Employers must give caregivers:
  • Vacation with pay after working with the same employer for 12 full months.
  • A minimum of 2 weeks off work each year.

What are the rules regarding deductions

Federal law requires an employer to make certain deductions from an employee's salary. Detailed information is available on the CRA website. Government of Canada site

The Employment Standards Act governs the maximum amount that may be deducted for room and board.

The following table provides information regarding specific deductions.

Deduction Details
Salary Deductions An employer must deduct and send the following on a regular basis to CCRA:
  • Canada Pension Plan contributions
  • Employment Insurance premiums
  • Income Tax
Room and Board An employer may deduct the following each week for room and board when the worker is paid minimum wage:
  • For a private, locked room: $31.70
  • For meals: $53.55

 

What is the rule regarding registration with the WSIB

The law requires employers to register within 10 days with the Work Place Safety and Insurance Board (WSIB).

Registering with the WSIB provides workplace insurance coverage for workers and gives employers access to experts in health and safety for their business sector.
