Media : News Releases and Media Advisories Media AdvisoryCanadian Transportation Agency to Hold Public Hearing on Certain Fees Levied by Nanaimo Port AuthorityNANAIMO, BRITISH COLUMBIA - May 8, 2006 - The Canadian Transportation Agency will hold a public hearing in Nanaimo, British Columbia beginning on May 9, 2006, on complaints by Neil Surry et al., Kenmore Air Harbor Inc., Amigo Airways Corp. and Seair Seaplanes Ltd. regarding certain passenger fees levied by the Nanaimo Port Authority. In the course of the public hearing, the Agency will hear evidence from interested persons and organizations with respect to complaints that there is unjust discrimination in the fees levied by the Nanaimo Port Authority on passengers travelling on passenger ferry services and float plane services. The hearing is part of the Agency's investigation of these complaints. According to the Canada Marine Act, any interested person may at any time, under subsection 52(1), file a complaint with the Agency that there is unjust discrimination in a fee fixed by a port authority under subsection 49(1), and the Agency shall consider the complaint without delay and report its findings to the port authority, and the port authority shall govern itself accordingly.
The Canadian Transportation Agency is an independent quasi-judicial tribunal that regulates various modes of transportation under Government of Canada jurisdiction, including marine, air and rail. Its procedures are governed by the rules of natural justice which ensure that all parties receive fair and equitable treatment. -30- IMPORTANT NOTE TO ASSIGNMENT EDITORS The Canadian Transportation Agency has, in law, all the powers, rights and privileges of a Superior Court. Due to the quasi-judicial nature of the hearing, panel members will not answer reporters' questions. Reporters may try to interview participants or their representatives before or after the day's session, or during breaks and lunch. A spokesperson for the Agency will be available on site to answer general questions about the Agency and the hearing process. The Agency will permit cameras in the hearing room, to take still photos or footage of the panel members and participants, at specified times and locations only. Reporters may stay throughout the duration of the hearing and may tape-record.
