What is new/changed?

CD 782 - Sharing Offender-Related Information; and
SOP 700-09 - Release Procedures

CD 782 has been amended to provide offenders the opportunity to comment on the relevancy of information proposed for sharing with police when its release is required under Section 25(3) of the CCRA.

SOP 700-09 now includes the procedures to follow when providing the offender with an opportunity to comment on the relevancy of this information, as well as the factors to be considered when making a decision on the offender's representations.

Other changes to the CD include the addition of the requirement to share information packages 90 days prior to release at warrant expiry date, or as soon as is practicable, as per the Interim Instruction dated 2001-02-06.

While there is still a requirement to share the Notification of Provision of Information to Police Prior to Warrant Expiry Date form with the NPB, the requirement to share the complete information package has been removed from the CD.

What is the purpose of the change?

To ensure offenders are provided with an opportunity to make representations on the relevancy of information proposed for sharing with police as per Section 25(3) of the CCRA.

How was it developed?

The issue of providing offenders with an opportunity to comment on the relevancy of information proposed for sharing with police was raised by the Office of the Correctional Investigator.

The revised policy documents were developed as a result of discussions with the OCI and in consultation with the Correctional Operations and Programs Sector, the Policy, Planning and Co-ordination Sector and Legal Services.

Accountability?

Institutional Heads and Area Managers in the community are accountable for ensuring implementation.

Who will be affected by the policy?

Staff and managers in institutions and the community involved in the case management process.

Expected cost?

None.

Other impacts?

CSC/SCC Form 1225 - Notification of Provision of Information to Police Prior to Warrant Expiry Date has been revised to reflect the policy changes.
