COMMISSIONER'S DIRECTIVE 568-8 - AUTHORITY FOR AND USE OF VIDEO SURVEILLANCE IN SUPPORT OF INVESTIGATIONS

What is new/changed?

There is a change in authority with regard to the decision-maker in cases where covert video surveillance is contemplated.

Why was the policy changed?

The Government Security Policy permits the use of video surveillance in support of access control measures and for the protection of government facilities, personnel and operations and, consequently, it is employed extensively in the institutional environment of CSC.

However, the use of video surveillance, especially covert video surveillance for non-routine investigative purposes, must respect the right of an individual to a reasonable expectation of privacy in accordance with the principles set out in the Canadian Charter of Rights and Freedoms and the Privacy Act.

The policy establishes and defines the authority and process to engage in the use of video surveillance in support of investigations. The Commissioner will only exercise this authority in very exceptional cases.

How was it developed?

The policy was developed following a review of current practices and the need to ensure that CSC is compliant in this area. The basis of the CD is Treasury Board Secretariat's Security Policy Implementation Notice no. 1999-01 regarding video surveillance and the memorandum from the Acting Commissioner dated October 26, 2004. The Departmental Security Division consulted with Security Operations, Assistant Deputy Commissioners of Operations, Regional Security, Performance Assurance and Legal Services at CSC.

Accountabilities?

The Regional Deputy Commissioners, Sector Heads, Institutional Heads and District Directors must ensure that this type of equipment is not used unless the decision-making process is completed.
