The Canadian Transportation Agency denies European Aviation Air Charter's request for review of an Agency decision

OTTAWA - July 5, 2002 - The Canadian Transportation Agency has denied a request by European Aviation Air Charter Limited filed on June 25, 2002 for a review of a portion of an Agency decision.

On June 21, 2002, the Agency denied an application for charter program permits by European Aviation Air Charter Limited on behalf of Univers Gestion Multi Voyage Inc. d/b/a Canada Air Charter for the following programs:

  • Mirabel/Port-au-Prince/Mirabel or Mirabel/Port-au-Prince/Fort-de- France/Mirabel - 28 flights from July 1, 2002 to October 28, 2002;
  • Mirabel/Newark/Mirabel - 30 flights from July 23, 2002 to October 31, 2002.

The request for review dealt with the portion of the decision related to the series of flights between Mirabel and Port-au-Prince, Haiti and/or Fort-de-France, Martinique.

In processing the application, the Agency requested comments from Canadian carriers licensed to operate an international non-scheduled air service with large aircraft. Comments were received from Canadian carriers objecting to the review of the original decision of the Agency and European Aviation Air Charter replied to the comments.

After careful consideration of the application and all the pleadings received concerning this matter, the Agency is of the opinion that there has been no change in the facts or circumstances since the issuance of its decision to allow the Agency to review, rescind or vary its June 21, 2002 decision.

The Canadian Transportation Agency is an independent federal administrative quasi-judicial tribunal whose procedures are governed by the rules of natural justice. The application of these rules will ensure that all parties receive fair and equitable treatment.
