SUBJECT: Past Service Elections

PURPOSE

1.1 The purpose of this directive is to remind Compensation Specialists and Public Works and Government Services Canada (PWGSC) Pay Offices of the recent amendment to election procedures and to clarify certain issues that have arisen to date.

1.2 This directive also provides notice that effective from June 1, 1997, the Pay Offices will return the "Election Form for Elective Pensionable Service" (PWGSC-TPSGC 2006) to the employing Department or Agency in cases where the new procedures are not followed.

POLICY

2.1 As described in Superannuation Administration Manual (SAM) Special Bulletin 1997-01, effective from January 24, 1997, employing Departments and Agencies are responsible for receiving past service elections on behalf of the Minister of PWGSC and for commencing the past service arrears deduction.

PROCEDURES

3.1 In cases where the employing Department or Agency had already forwarded the PWGSC-TPSGC 2006 to the PWGSC Pay Office, SAM Special Bulletin 1997-01 instructed the Pay Office to complete the PWGSC-TPSGC 2006 and commence the deduction according to the previous procedures.

3.2 Effective from June 1, 1997, PWGSC Pay Offices will no longer accept a PWGSC-TPSGC 2006 forwarded, in error, for certification and commencement of the deduction. The form will be returned to the employing Department or Agency for the appropriate action.

3.3 In order to prevent defaults, it is important that Compensation Specialists follow the procedures outlined in SAM Special Bulletin 1997-01.

3.4 In cases where the contributor makes an election immediately prior to termination, when completing the PWGSC-TPSGC 2006, the Compensation Specialist may indicate the following in Part C, "Deductions Started Eff. From:" SOS Effective (date), No Deductions Taken.

3.5 With the exception that the Compensation Specialist is responsible for certifying the PWGSC-TPSGC 2006, there has been no change to the process to be followed for cash payments. The cash payment must be forwarded directly to Superannuation Directorate.

3.6 The PWGSC Pay Offices will continue to receive the "Elective Service Notice" (PWGSC-TPSGC 2097) once the election has been finalized by Superannuation Directorate. It is important that the past service arrears deductions be taken exactly as instructed on the PWGSC-TPSGC 2097, i.e. in the amount and at the time indicated on the form.
