As outlined in What We Do, the Payments in Lieu of Taxes Program is mandated by Treasury Board to provide management and consulting services in respect to payments in lieu of taxes to federal departments and certain Crown corporations and agencies. Although we have other internal and external clients, our main clients are departmental custodians of federal real property. Senior officers of the PILT Program valuation staff are assigned particular responsibilities associated with each client custodian, and manage that relationship with respect to PILT.

In 1997, Treasury Board Secretariat "devolved" the funding for all payments made in lieu of realty taxes to the custodians of the property. This meant that PWGSC remained responsible to administer the PILT program by providing valuation services and making the payments to the taxing authorities with the Minister of PWGSC retaining full discretionary power on all PILT payments for departmental properties under the PILT Act. However, the custodian departments retained responsiblity to pay the amounts that were distributed as payments in lieu of taxes to taxing authorities by way of reimbursement to PWGSC.

Since then the relationship between the PILT program and each custodian department has developed into a partnership, supported by a Memorandum of Understanding (MOU) that details responsibilities of each party to ensure the effective and efficient delivery of the PILT Program.

Services to Crown Corporations/Agencies Return to Top

Certain custodian Crown corporations/agencies have been provided authority under the Act and are fully responsible for their own PILT programs, which they administer under authority of the Crown Corporation Payment Regulations. Several of these, including Canada Post WWW, administer every aspect of their PILT programs. Others, such as the National Research Council WWW and some Canadian Port Authorities, retain the service of PWGSC on a fee-for-services basis to provide valuation services and to recommend the amount of payment to be made. The Crown corporation or agency then makes the payment to the taxing authority directly.

Services for Diplomatic and Consular Property Return to Top

The Government of Canada by way of an Order called the Diplomatic, Consular and International Organizations' Property Grants Order established a program of payments in lieu of local taxes and improvement costs on diplomatic property in Canada. This program is intended to provide compensation in respect to properties which are exempted from property taxes by virtue of International law as reflected in the Vienna Convention on Consular Relations. The Department of Foreign Affairs and International Trade (DFAIT) is responsible for the payment which is to be an amount that might be paid pursuant to the PILT Act if the diplomatic property were federal property as defined in that Act.

DFAIT has contracted the PILT Program through a Memorandum of Understanding to provide PILT administration services for all diplomatic properties in Canada excluding Quebec. As part of these services PILT makes the payments to the taxing authority directly and is subsequently reimbursed by DFAIT.
