Millstream Flour Mills (1991) Corporation Pleads Guilty to Violating the Food and Drugs Act

On September 16, 2003, Millstream Flour Mills (1991) Corporation entered a guilty plea in Victoria Provincial Court to one count of violating the Food and Drugs Act. The company was fined $8,500 and ordered to pay a victim surcharge of 15 per cent for unlawfully labelling, packaging, and selling “Millstream Granola with Raisins” in a manner that was false, misleading or deceptive or likely to create an erroneous impression regarding its character, composition, or safety.

The offence was investigated by the Canadian Food Inspection Agency following a complaint that a woman had consumed “Millstream Granola with Raisins” and had suffered a severe allergic reaction. The inspection and subsequent investigation revealed that the labelling on the granola package failed to declare the presence of sunflower seeds to which the complainant had an allergy.

Section 5(1) of the Food and Drugs Act reads:

No person shall label, package, treat, process, sell or advertise any food in a manner that is false, misleading or deceptive or is likely to create an erroneous impression regarding its character, value, quantity, composition, merit or safety.
