Court Fines Albert Hounsell $5000 for violating the Food and Drugs Act.

On November 18th, 2003, Mr. Albert Hounsell plead guilty to a charge of violating subsection 5.(1) of the Food and Drugs Act before the Provincial Court in Trenton, Ontario. Mr. Hounsell was fined five thousand dollars, and given 6 months to pay.

Subsection 5.(1) of the Food and Drugs Act states:

"No person shall label, package, treat, process, sell or advertise any food in a manner that is false, misleading or deceptive or is likely to create an erroneous impression regarding its character, value, quantity, composition, merit or safety."

Mr. Hounsell is a partner of bottled water distributor, Mount Pelion Water. An investigation conducted by the Canadian Food Inspection Agency (CFIA) determined that on or about September 25th, 2000, he misrepresented Mount Pelion brand bottled water as "spring water" on the product's labels, when it was derived from a source other than a spring.

The CFIA is responsible for enforcing a number of Acts of Parliament in order to deliver inspection and related services that contribute to improving the overall integrity of the food safety, plant protection and animal health systems.
