Court Fines Malabar Super Spice Company Ltd. $1,000 for contravening the Meat Inspection Act and Orders Forfeiture of Seized Meat Product Valued at $2,000

On June 16, 2004 Malabar Super Spice Company Ltd., a company based at 459 Enfield Rd., Burlington, Ontario, pled guilty in Provincial Court in Dartmouth, Nova Scotia, to one count of contravening subsection 8 (a) of the Meat Inspection Act.

An investigation conducted by the Canadian Food Inspection Agency (CFIA) determined that on or about September 16, 2003, the accused conveyed pork natural casings from its unregistered facility in Ontario to Nova Scotia. Only federally registered establishments are permitted to send meat products between provinces.

Section 8 (a) of the Meat Inspection Act states:

No person shall send or convey a meat product from one province to another unless it was prepared or stored in a registered establishment that was operated in accordance with this Act and the regulations.

The Court sentenced the accused to a fine of $1,000 and ordered the forfeiture of seized meat product valued at $2,000.

CFIA prosecution bulletins report on legal proceedings in which a conviction has been obtained. In publishing them, we are seeking to increase awareness of the Agency’s role in enforcing the Acts and Regulations for which it is responsible. Under its mandate, CFIA provides Canadian businesses and consumers with inspection and related services that contribute to improving the overall integrity of the food safety, animal health and plant protection systems.
