Policies / Procedures Guidelines Pertaining to the Approval of Landfill Sites for the
Disposal of International Waste

Requirements for approval of a landfill site by CFIA:
1. |
A current valid permit or license from the appropriate provincial (and
where required regional) environmental authority to operate as a landfill is needed. |
2. |
The CFIA inspector must be satisfied that the landfill site is completely
enclosed, physically situated, or operated so that no ruminant animal or swine has access
to the waste subject to regulation. Landfill sites receiving aircraft or ships' waste
originating in countries other than the USA must be fenced or have geographic barriers
that preclude the entry of such animals. |

The landfill site must be free of domestic and feral animals such as swine,
other domestic livestock and poultry, and wild ruminants such as deer, moose, etc. |
4. |
No livestock or poultry are kept on any premises within 0.5 kilometre of
the perimeter of the site. |
5. |
No agricultural crop production is undertaken within 1.0 kilometre of the
perimeter of the site. |
6. |
No waste can be removed from the landfill site. |
7. |
The route chosen between collection areas of international waste and the
landfill site should be the shortest distance, while avoiding livestock and agricultural
crop areas. The route must be restricted to major roads if possible. An alternate route
must also be on file, should the designated one be unavailable. Exceptional circumstances
where livestock areas and/or agricultural crops cannot be avoided could be approved by the
CFIA if it is clearly demonstrated that there are no other possible routes and as long as
only major roads are used. In these exceptional circumstances, the trucks and containers
must be inspected more often by CBSA officers. |

International waste from aircraft/ships must be completely covered with a
minimum of 1.8 metres of domestic garbage or other standard covering materials.
International waste must be covered as soon as possible and should only be accepted at the
landfill during morning hours to ensure that there will be adequate covering material at
the end of the day. |
9. |
A landfill site requiring the lengthy transportation of garbage through an
area with an intensive livestock population or agricultural crop production will not be
approved. |
Approval of landfill site to receive international waste (performed by CFIA
District Office):
1. |
Landfill site operators or their agents must forward written requests for
international waste disposal site approvals to the local CFIA District Office. |
2. |
An inspection of the site by CFIA staff will determine compliance with the above
requirements. |
3. |
Approvals will be reviewed on a tri-annual basis. If found non-compliant the landfill
site may not be re-approved, or approval may be based on recommended corrective actions. |
Once approval has been obtained, the general procedures pertaining to an
approved landfill site should be:

The CBSA officer must be satisfied that the international waste removed
from the port of entry is transported to the approved landfill in a closed leakproof
container. |
2. |
The containers should be designated for international waste and prominently
numbered to facilitate record keeping. Records must be maintained by the agent, the
trucking contractor moving the waste to the landfill, and the landfill operator. |
3. |
If the waste is not taken directly from the port of entry to the landfill
site, a secure holding area must be approved. Containers require locks or the use of
seals. |
4. |
Waybills and other records pertaining to the storage, transportation, and
disposal of international waste must be maintained on the premises and be available to the
CBSA officer upon request. Waybills will be verified regularly by CBSA officers to ensure
that all trucks leaving the port of entry are arriving at the landfill site. |
5. |
After dumping, the garbage containers must be clean, free of debris and
disinfected with an approved disinfectant at the nearest designated wash area. |
6. |
Any contractor handling international waste should have a spill contingency
plan in case of emergencies. The plan should include the phone number of the CBSA officer.

7. |
In the case of operational non-compliance or unsatisfactory maintenance of
an approved facility, a written warning with a deadline for the completion of corrective
measures will be sent to the landfill operator by the CFIA Area Executive Director.
Continuous non-compliance could result in the removal of approval for the receipt of
international waste. |
