CANADIAN ENVIRONMENTAL PROTECTION ACT
Notice is hereby given that, pursuant to the provisions of Part VI of the Canadian Environmental Protection Act, Permit No. 4543-2-03232 is approved.
1. Permittee: Pacifica Papers Inc., Powell River, British Columbia.
2. Type of Permit: To dump or load dredged material.
3. Term of Permit: Permit is valid from September 9, 1999, to September 8, 2000.
4. Loading Site(s): Pacifica Paper Inc. Pulp and Paper Mill Site, Powell River, British Columbia, at approximately 49°52.00' N, 124°33.00' W.
5. Dump Site(s): Malaspina Strait Disposal Site: 49°45.00' N, 124°27.00' W, at a depth of not less than 320 m.
The following position fixing procedures must be followed to ensure disposal
at the designated dump site:
(i) The vessel must call the Vancouver Vessel
Traffic Management (VTM) Centre on departure and inform the VTM that it
is heading for a disposal site;
(ii) Upon arrival at the disposal site, and prior to dumping, the
vessel must again call the VTM to confirm its position. Dumping can
proceed if the vessel is on the disposal site. If the vessel is not
within the disposal site boundaries, the VTM will direct it to the site
and advise that dumping can proceed; and
(iii) The vessel will inform the VTM when dumping has been completed
prior to leaving the disposal site.
6. Route to Dump Site(s): Direct.
7. Method of Loading and Dumping: Loading by clamshell dredge with disposal by bottom dump scow, or by end dumping.
8. Rate of Dumping: As required by normal operations.
9. Total Quantity to be Dumped: Not to exceed 20 000 m3.
10. Material to be Dumped: Dredged material and other approved materials typical of the loading site.
11. Requirements and Restrictions: The Permittee must notify the permit issuing office before commencement of the project as to the dates on which the loading or ocean disposal will occur.
The Permittee must ensure that all contractors involved in the loading or dumping activity for which the permit is issued are made aware of any restrictions or conditions identified in the permit and of the possible consequences of any violation of these conditions. A copy of the permit and the letter of transmittal must be carried on all towing vessels and loading platforms or equipment involved in ocean dumping activities.
Contact must be made with the Canadian Coast Guard regarding the issuance of a Notice of Shipping. The Permittee should contact the District Manager, Canadian Coast Guard, Vessel Traffic Services, Kapilano 100 Building, Room 1205, 100 Park Royal S, West Vancouver, British Columbia V7T 1A2, (604) 666-8453 (Facsimile).
Any inspector designated pursuant to subsection 99(1) of the Canadian Environmental Protection Act shall be permitted to mount an electronic tracking device on any vessel that is engaged in the ocean disposal activities authorized by this permit. The Permittee shall take all reasonable measures to ensure there is no tampering with the tracking device and no interference with its operation. The tracking device shall be removed only by an inspector or by a person with the written consent of an inspector.
The Permittee must submit to the Regional Director, Environmental Protection, within 30 days of the expiry of the permit, a list of all work completed pursuant to the permit, the nature and quantity of material disposed of and the dates on which the activity occurred.

Food and Drug Regulations Amendment
Interim Marketing Authorization
Provision currently exists in the Food and Drug Regulations for the use of cellulose as an anticaking agent in grated or shredded cheese at levels up to 2 percent. Health Canada has received a submission to permit the use of powdered cellulose as a bulking agent in a variety of foods. The specific types of foods and the maximum levels of use are:
(1) Sweet baked goods: 8 percent
(2) Batter and breading: 1 percent
(3) Seasonings: 3 percent
(4) Foods in tablet form: 50 percent
(5) Confectionery (energy reduced): 25 percent
(6) Edible ices (except standardized products): 3 percent
(7) Icings: 1 percent
(8) Fillings: 0.5 percent
Evaluation of available data supports the safety and effectiveness of these uses for powdered cellulose.
These uses of powdered cellulose will benefit both the industry and the consumer by permitting a wider choice of bulking agents in the production of unstandardized bakery products and energy reduced foods and by providing better quality products.
Therefore, it is the intention of Health Canada to amend the Food and Drug Regulations to permit the use of powdered cellulose as a bulking agent in these foods at the maximum levels of use indicated above.
As a means to improve the responsiveness of the regulatory system, an Interim Marketing Authorization (IMA) is being issued to permit the immediate use of powdered cellulose as indicated above while the regulatory process to amend the Regulations formally is undertaken.

Food and Drug Regulations Amendment
Interim Marketing Authorization
Provision currently exists in the Food and Drug Regulations for the use of disodium and calcium disodium EDTA (Calcium Disodium Ethylenediaminetetraacetate) as sequestering agents in a variety of foods products at levels ranging from 25 to 340 mg/kg. Health Canada has received a submission to extend the use of disodium and calcium disodium EDTA as sequestering agents in pasteurized sous-vide potatoes at a maximum level of use of 100 parts per million (ppm). Evaluation of available data supports the safety and effectiveness of this use for disodium and calcium disodium EDTA.
This use of disodium and calcium disodium EDTA will benefit both the industry and the consumer by permitting the use of an alternative to sulphiting agents to prevent the formation of undesirable colour formation in the potato product during processing and storage.
Therefore, it is the intention of Health Canada to amend the Food and Drug Regulations to permit the use of disodium and calcium disodium EDTA as sequestering agents in pasteurized sous-vide potatoes at a maximum level of use of 100 ppm.
As a means to improve the responsiveness of the regulatory system, an Interim Marketing Authorization (IMA) is being issued to permit the immediate use of disodium and calcium disodium EDTA as indicated above while the regulatory process to amend the Regulations formally is undertaken.

Food and Drug Regulations Amendment
Interim Marketing Authorization
Provision currently exists in the Food and Drug Regulations for the use of disodium EDTA (Disodium Ethylenediamine- tetraacetate) as a sequestering agent in a variety of food products at levels ranging from 25 to 340 mg/kg. Health Canada has received a submission to extend the use of disodium EDTA as a stabilizing agent in aqueous suspensions of colour lake pigments used in coating confectionery tablets. Evaluation of available data supports the safety and effectiveness of this use for disodium EDTA.
This use of disodium EDTA will be beneficial because it will provide a more efficient and economical method for uniform dispersion of colour in coatings for confectionery products.
Therefore, it is the intention of Health Canada to amend the Food and Drug Regulations to permit the extended use of disodium EDTA as a stabilizing agent in aqueous suspensions of colour lake preparations for use in coatings for confectionery pieces at levels of 1 percent of the colour preparation.
As a means to improve the responsiveness of the regulatory system, an Interim Marketing Authorization (IMA) is being issued to permit the immediate use of disodium EDTA as indicated above while the regulatory process to amend the Regulations formally is undertaken.

Food and Drug Regulations Amendment
Interim Marketing Authorization
Provision currently exists in the Food and Drug Regulations for the use of lipase enzyme from Mucor miehei in the modification of triglycerides at levels consistent with good manufacturing practice. Health Canada has received a submission to permit the use of lipase enzyme from Mucor miehei in cheese. Evaluation of available data supports the safety and effectiveness of this use of lipase enzyme from Mucor miehei.
The use of the lipase enzyme as indicated above will benefit both the industry and the consumer by providing an alternative and more efficient method for the production of varietal cheeses, thus improving yield, productivity and availability of cheeses.
Therefore, it is the intention of Health Canada to amend the Food and Drug Regulations to permit the use of lipase enzyme from Mucor miehei in cheese at a level of use consistent with good manufacturing practice.
As a means to improve the responsiveness of the regulatory system, an Interim Marketing Authorization (IMA) is being issued to permit the immediate use of this enzyme as indicated above while the regulatory process to amend the Regulations formally is undertaken.

Food and Drug Regulations Amendment
Interim Marketing Authorization
Provision currently exists in the Food and Drug Regulations for the use of sodium erythorbate and sodium tripolyphosphate in a wide variety of foods. Health Canada has received a submission to permit the use of sodium erythorbate and sodium tripolyphosphate in canned clams at maximum levels of use of 350 ppm and 5 000 ppm, respectively. Evaluation of available data supports the safety and effectiveness of the use of these food additives in this application.
The use of sodium erythorbate in canned clams will provide the industry a safe alternative to sulphites. The use of sodium tripolyphosphate will permit production of a higher quality product. Consumers will also benefit from the use of these substances in canned clams because of the availability of a product that is more tender and visually appealing in colour without the presence of sulphites.
Therefore, it is the intention of Health Canada to amend the Food and Drug Regulations to permit the use of sodium erythorbate and sodium tripolyphosphate in canned clams at maximum levels of use of 350 ppm and 5 000 ppm, respectively.

Interim Marketing Authorization
Provision currently exists in the Food and Drug Regulations for the use of sodium stearoyl-2-lactylate as an emulsifying agent in a variety of foods at levels of use ranging from 0.05 to 2 percent. Health Canada has received a submission to permit the use of sodium stearoyl-2-lactylate as an emulsifying agent in salad dressings, including French dressing, and soups at levels of 0.4 percent and 0.2 percent of the finished product, respectively. Evaluation of available data supports the safety and effectiveness of these uses for sodium stearoyl-2-lactylate.
These uses of sodium stearoyl-2-lactylate will benefit both the industry and the consumer by permitting a wider choice of emulsifying agents in the production of foods and by providing better quality products.
Therefore, it is the intention of Health Canada to amend the Food and Drug Regulations to permit the use of sodium stearoyl-2-lactylate as an emulsifying agent in salad dressings, including French dressing, and soups at maximum levels of use of 0.4 percent and 0.2 percent of the finished product, respectively.

Food and Drug Regulations Amendment
Interim Marketing Authorization
Imidacloprid is registered under the Pest Control Products Act as an insecticide for the control of Colorado potato beetles, flea beetles, aphids and other insect pests on apples, potatoes and tomatoes. Maximum Residue Limits (MRLs) have been established under the Food and Drugs Act for residues of imidacloprid and its metabolites resulting from these uses in Canada and other countries at 6 parts per million (ppm) in tomato paste, at 3.5 ppm in lettuce and brassica crops, at 3 ppm in tomato puree, at 1.5 ppm in grapes, at 1 ppm in peppers, tomatoes and tomato juice, at 0.6 ppm in pears, at 0.5 ppm in apples, at 0.3 ppm in potatoes, at 0.2 ppm in mangoes and at 0.05 ppm in canola oil and cottonseed oil. By virtue of subsection B.15.002(1) of the Food and Drug Regulations, the MRL for other foods is 0.1 ppm.
The Pest Management Regulatory Agency (PMRA), of Health Canada, has recently approved an application to amend the registration of imidacloprid in order to allow its use for the control of aphids and whiteflies on greenhouse cucumber. The PMRA has also been requested to establish MRLs for residues of imidacloprid and its metabolites resulting from this use in cucumber in order to permit the import and sale of food containing these residues.
Before making a registration decision regarding a new use of a pest control product, the PMRA conducts the appropriate assessment of the risks and value of the product specific to its proposed use. The registration of the pest control product will be amended if: the data requirements for assessing value and safety have been adequately addressed; the evaluation indicates that the product has merit and value; and the human health and environmental risks associated with its proposed use are acceptable.
After the review of all available data, the PMRA has determined that an MRL of 0.5 ppm for imidacloprid, including metabolites, in cucumber would not pose an unacceptable health risk to the public.
The use of imidacloprid on cucumber will provide joint benefits to consumers and the agricultural industry as a result of improved management of pests. In addition, this use will contribute to a safe, abundant and affordable food supply.
Therefore, it is the intention of the PMRA to recommend that the Food and Drug Regulations be amended to establish an MRL for imidacloprid, including metabolites, of 0.5 ppm in cucumber.
As a means to improve the responsiveness of the regulatory system, an Interim Marketing Authorization IMA is being issued to permit the immediate sale of cucumber with an MRL for imidacloprid, including metabolites, of 0.5 ppm while the regulatory process to amend the Regulations is undertaken.

Interim Marketing Authorization
Iprodione is registered under the Pest Control Products Act as a fungicide for the control of rots, spots, molds, mildew and blights on many crops as a seed treatment, pre-plant, pre-emergent, or post-harvest treatment. Maximum Residue Limits (MRLs) have been established under the Food and Drugs Act for residues of iprodione and its isomers/metabolites resulting from these uses at 60 parts per million (ppm) in raisins, at 15 ppm in lettuce, at 10 ppm in grapes, peaches and raspberries, at 5 ppm in carrots, cherries, strawberries and wine, at 3 ppm in apricots, at 2 ppm in plums and prunes, at 0.5 ppm in cucumbers, kiwi fruit and tomatoes, and at 0.3 ppm in beans. By virtue of subsection B.15.002(1) of the Food and Drug Regulations, the MRL for other foods is 0.1 ppm.

Interim Marketing Authorization
Propiconazole is registered under the Pest Control Products Act as a fungicide for the control of various fungi on cereals, fruit and green forage crops. Maximum Residue Limits (MRLs) have been established under the Food and Drugs Act for residues of propiconazole and all metabolites containing the 2,4-dichlorophenyl-1-methyl substituted moiety resulting from this use at 0.05 parts per million (ppm) in barley, oats and wheat. MRLs have also been established at 2 ppm in liver and kidney of cattle to cover residues in food derived from animals fed with crops treated with propiconazole. By virtue of subsection B.15.002(1) of the Food and Drug Regulations, the MRL for other foods is 0.1 ppm.

The PMRA has also been requested to establish MRLs for residues of propiconazole and its metabolites resulting from this use in stone fruit, in order to permit the import and sale of food containing these residues.
Before making a registration decision regarding a new use of a pest control product, the PMRA conducts the appropriate assessment of the risks and value of the product specific to its proposed use. The registration of the pest control product will be amended if: the data requirements for assessing value and safety have been adequately addressed; the evaluation indicates that the product has merit and value; and the human health and environmental risks associated with its proposed use are acceptable.

Therefore, it is the intention of the PMRA to recommend that the Food and Drug Regulations be amended to establish an MRL for propiconazole, including metabolites, of 1 ppm on stone fruit.
As a means to improve the responsiveness of the regulatory system, an Interim Marketing Authorization is being issued to permit the immediate sale of stone fruit with an MRL for propiconazole and its metabolites of 1 ppm while the regulatory process to amend the Regulations is undertaken.
