Notice is hereby given that, pursuant to the provisions of Part 7, Division 3, of the Canadian Environmental Protection Act, 1999, Permit No. 4543-2-03388 is approved.

1. Permittee: Fraser River Pile & Dredge Ltd., New Westminster, British Columbia.

2. Type of Permit: To load waste and other matter for the purpose of disposal at sea and to dispose of waste and other matter at sea.

3. Term of Permit: Permit is valid from June 12, 2006, to June 11, 2007.

4. Loading Site(s): Golden Ears Bridge, Langley, British Columbia, at approximately 49°11.98' N, 122°40.00' W and 49°11.62' N, 122°39.62' W.

5. Disposal Site(s): Point Grey Disposal Site: 49°15.40' N, 123°22.10' W, at a depth of not less than 210 m.

The following position-fixing procedures must be followed to ensure disposal at the designated disposal site:

(i) The vessel must inform the appropriate Marine Communications and Traffic Services (MCTS) Centre upon departure from the loading site that it is heading for a disposal site;

(ii) Upon arrival at the disposal site and prior to disposal, the vessel must again call the appropriate MCTS Centre to confirm its position. Disposal can proceed if the vessel is on the designated site. If the vessel is not within the disposal site boundaries, the MCTS Centre will direct it to the site and advise when disposal can proceed;

(iii) The vessel must inform the appropriate MCTS Centre when disposal has been completed prior to leaving the disposal site.

6. Route to Disposal Site(s): Direct.

7. Method of Loading and Disposal: Clamshell dredging with disposal by bottom dump scow or end dumping.

8. Rate of Disposal: As required by normal operations.

9. Total Quantity to Be Disposed of: Not to exceed 25 000 m3.

10. Waste and Other Matter to Be Disposed of: Dredged material consisting of silt, sand, rock and other approved material typical to the approved loading site, except logs and usable wood.

10.1. The Permittee must ensure that every reasonable effort has been made to prevent the deposition of log bundling strand into material approved for loading and disposal at sea and/or remove log bundling strand from material approved for loading and disposal at sea.

11. Requirements and Restrictions:

11.1. The Permittee must notify the permit-issuing office before commencement of the project as to the dates on which the loading or dumping will occur.

11.2. The Permittee must ensure that all contractors involved in the loading or disposal activity for which the permit is issued are made aware of any restrictions or conditions identified in the permit and of the possible consequences of any violation of these conditions. A copy of the permit and of the letter of transmittal must be carried on all towing vessels and loading platforms or equipment involved in disposal at sea activities.

11.3. The fee prescribed by the Ocean Dumping Permit Fee Regulations (Site Monitoring) shall be paid by the Permittee in accordance with those Regulations.

11.4. Contact must be made with the Canadian Coast Guard, Regional Marine Information Centre, regarding the issuance of a "Notice to Shipping." 11.5. Any enforcement officer designated pursuant to subsection 217(1) of the Canadian Environmental Protection Act, 1999 shall be permitted to mount an electronic tracking device on any vessel that is engaged in the disposal at sea activities authorized by this permit. The Permittee shall take all reasonable measures to ensure that there is no tampering with the tracking device and no interference with its operation. The tracking device shall be removed only by an enforcement officer or by a person with the written consent of an enforcement officer.

11.6. The Permittee must submit to the Regional Director, Environmental Protection Operations Directorate, within 30 days of the expiry of the permit, a list of all work completed pursuant to the permit, the nature and quantity of material disposed of and the dates on which the activity occurred.

Notice is hereby given that, pursuant to the provisions of Part 7, Division 3, of the Canadian Environmental Protection Act, 1999, Permit No. 4543-2-06369 is approved.

1. Permittee: Charlottetown Harbour Authority Incorporated, Charlottetown, Prince Edward Island.

2. Type of Permit: To load and dispose of dredged material.

3. Term of Permit: Permit is valid from June 12, 2006, to June 11, 2007.

4. Loading Site(s):

(a) Charlottetown Marine Terminal: 46°13.93' N, 63°07.03' W (NAD83), as described in "Appendix A, Drawing No. 90980-1 – Plan View of Proposed Dredge Area (March 14, 2006)," submitted in support of the permit application; and

6. Route to Disposal Site(s): Most direct navigational route from the loading site to the disposal site or most direct route from the loading site to the disposal site via the temporary upland storage site described in "Appendix A, Drawing No. 90980-10 – Temporary Storage Area (May 3, 2006)," submitted in support of the permit application.

7. Equipment: Clam dredge and towed or self-propelled barges and any land-based equipment required to transfer the material to and from the temporary upland storage site described in "Appendix A, Drawing No. 90980-10 – Temporary Storage Area (May 3, 2006)," submitted in support of the permit application.

8. Method of Disposal: All disposal shall occur in accordance with the environmental protection plan required by paragraph 12.3 of this permit.

9. Rate of Disposal: As required by normal operations.

10. Total Quantity to Be Disposed of: Not to exceed 28 000 m3 scow measure.

11. Material to Be Disposed of: Dredged material consisting of gravel, sand, silt, and clay.

12. Requirements and Restrictions:

12.1. The Permittee shall notify in writing the following individuals at least 48 hours prior to each occasion that dredging equipment is mobilized to a loading site. The notification shall include the equipment to be used, the name of the contractor, the contact for the contractor, and the expected period of dredging.

12.2. The fee prescribed by the Ocean Dumping Permit Fee Regulations (Site Monitoring) shall be paid by the Permittee in accordance with those Regulations. Proof of payment of the remaining balance of $7,050 shall be submitted to Mr. Scott Lewis, identified in paragraph 12.1, prior to December 5, 2006.

12.3. An environmental protection plan (EPP) designed to address concerns relating to shellfish and other fisheries resources, water quality, wildlife, navigation, gear conflicts, and spill prevention shall be submitted to Mr. Scott Lewis, identified in paragraph 12.1. The EPP shall include a dredged material disposal plan addressing procedures to accurately measure or estimate quantities of dredged material to be disposed of, the volume of material intended to be disposed of at each disposal site, and a schedule for the use of each disposal site. The EPP shall be approved by Environment Canada prior to the commencement of the first dredging operation to be conducted under this permit. Modifications to the EPP require written approval from Environment Canada.

12.4. A written report shall be submitted to Mr. Scott Lewis, identified in paragraph 12.1, within 30 days of either the completion of the work or the expiry of the permit, whichever comes first. This report shall contain the following information: the quantity and type of material disposed of pursuant to the permit, the equipment used and the dates on which the loading and disposal activities occurred.

12.5. It is required that the Permittee admit any inspector designated pursuant to subsection 217(1) of the Canadian Environmental Protection Act, 1999 to any place, ship, aircraft, platform or anthropogenic structure directly related to the loading or disposal referred to under this permit, at any reasonable time throughout the duration of this permit.

12.6. Any inspector designated pursuant to subsection 217(1) of the Canadian Environmental Protection Act, 1999 shall be permitted to mount an electronic tracking device on any vessel engaged in loading and disposal activities authorized by this permit. The Permittee shall take all reasonable measures to ensure that there is no tampering with the tracking device and no interference with its operation. The tracking device shall only be removed with the written consent of an inspector.

12.7. A copy of this permit and of the documents and drawings referenced therein shall be available on-site at all times when dredging operations are underway.

12.8. The dredging and disposal at sea authorized by this permit shall only be carried out by the Permittee or by a person with written approval from the Permittee.

Notice to anyone engaged in the use of methyl bromide

The Parties to the Montreal Protocol on Substances that Deplete the Ozone Layer have agreed to phase out the production and consumption of methyl bromide. The Ninth Meeting of the Parties decided to allow for possible exemptions to these production/consumption phase-out dates in order to meet the marketplace demand for uses that are considered "critical."

The Parties have established criteria and a procedure to assess nominations for "critical" use exemptions. Canada, as a Party to the Montreal Protocol, is expected to ensure that the requirements of this international treaty are implemented in Canada.

Pursuant to subparagraphs 68(a)(ix) and 68(a)(xiii) of the Canadian Environmental Protection Act, 1999, the annex of the following notice describes the criteria, process and schedule that the Department of the Environment will use to determine the relevance of nominations received for an exemption for a "critical" use of methyl bromide, as agreed to under the Montreal Protocol on Substances that Deplete the Ozone Layer.

If the nomination is accepted by the Parties to the Montreal Protocol, the Party in possession of the exemption authorizes the applicant to acquire the methyl bromide according to the terms of the decision. The decision is implemented in respect to the regulatory provisions for methyl bromide and allows the production or importation of new methyl bromide after the phase-out date. The use of methyl bromide present in Canada before the phase-out date or the use of recycled or reclaimed methyl bromide does not require an application for exemption.

Users of methyl bromide are hereby invited to submit, prior to July 29, 2006, their nominations for such "critical" use exemptions for exemptions for the years 2008 and 2009, as described in the annex to this notice.

I. Introduction

The Fourth Meeting of the Parties to the Montreal Protocol on Substances that Deplete the Ozone Layer agreed to add methyl bromide to the list of ozone-depleting substances subject to control. The Seventh Meeting of the Parties agreed to phase out the production and consumption (see footnote 1) of methyl bromide by January 1, 2010. The Ninth Meeting of the Parties revised the phase-out date to January 1, 2005, and established interim reduction steps.

The Ninth Meeting of the Parties agreed to allow for possible exemptions to this production/consumption phase-out date in order to meet the marketplace demand for uses that are considered "critical." The Parties established (Decision IX/6) criteria to assess nominations for "critical" use exemptions. The Parties also agreed (Decision IX/7) to allow the use, in response to an emergency event, of quantities not exceeding 20 tonnes of methyl bromide.

Canada, as a Party to the Montreal Protocol, is expected to ensure that the requirements of this international treaty are implemented in Canada. Canada has developed a domestic control program to do so. In 1995, Canada's Ozone Layer Protection Program was revised, and it was decided to phase out methyl bromide by January 1, 2001.

In 1998, because of the change in position of Canada's major trading partners regarding their domestic phase-out date, Canada changed its position and decided to adopt the international phase-out schedule.

II. Criteria for "critical" use

For the implementation in Canada of the Montreal Protocol requirements, a use of methyl bromide shall qualify as "critical" if and only if the following conditions are met:

(1) The specific use is "critical" because the lack of availability of methyl bromide for that use would result in a significant market disruption; (see footnote 2) and

(2) There are no technically and economically feasible alternatives or substitutes available (see footnote 3) to the user that are acceptable from the standpoint of environment and health and are suitable to the crops and circumstances of the nomination.

Furthermore, consumption, if any, of methyl bromide for "critical" uses after the phase-out date shall be permitted only if the following conditions are met:

(1) All technically and economically feasible steps have been taken to minimize the "critical" use and any associated emission of methyl bromide;

(2) The methyl bromide is not available in sufficient quantity and quality from existing stocks of banked or recycled methyl bromide; and

(3) It is demonstrated that an appropriate effort is being made to evaluate, commercialize and secure national regulatory approval of alternatives and substitutes. It must be demonstrated (see footnote 4) that research programs are in place to develop and deploy alternatives and substitutes.

III. Process

The process that leads to decisions on "critical" use exemptions consists of a domestic process and an international process.

The domestic process is as follows:

(01) An organisation (user) in Canada makes an application for a "critical" use exemption to Environment Canada. This application must fulfill the information requirements identified in section V of this document.

(02) Environment Canada sends the application to the Methyl Bromide Critical Use Advisory Committee. The Advisory Committee consists of independent experts who are knowledgeable on the alternatives available and pest problems faced by the sector for which the exemption is requested.

The Advisory Committee will, at a minimum, consist of representatives from

The purpose of the Advisory Committee is to advise and evaluate applications and forward to Environment Canada its recommendations concerning the applications.

(03) The Advisory Committee submits its recommendation to Environment Canada, including conditions on how the substance should be used.

(04) Environment Canada makes a decision, in consultation with Agriculture and Agri-Food Canada when an agricultural sector is implicated, and informs the applicant.

(05) The applicant can appeal to the Minister of the Environment, to the attention of the Director, Industrial Sectors Division, if the applicant is not satisfied with the decision.

The international process is as follows:

(06) Nomination: Canada submits its "critical" use nomination to the Ozone Secretariat of the United Nations Environment Programme (UNEP) by January 24 of the year in which a decision is required; earlier submissions are encouraged. (see footnote 5) The nomination would be valid for a period commencing on January 1 of the year following the decision or as specified in the decision.

(07) Assignment: The Ozone Secretariat forwards the nominations to the Technology and Economic Assessment Panel (TEAP).

(08) Review: The TEAP reviews the nomination to determine if it meets the criteria for a "critical" use established by Decision IX/6 and either recommends the nomination to the Open-Ended Working Group (OEWG) of the Parties to the Montreal Protocol or reports that it is unable to recommend the nomination. The TEAP report to the OEWG is due by mid-May of the year of decision.

(09) Evaluation: The OEWG reviews the TEAP report and recommends a decision for consideration by the Parties.

(10) Decision: The Meeting of the Parties decides whether to allow production for "critical" use in accordance with the Montreal Protocol. The Parties may attach conditions to their approval.

(11) National decision: The Party in possession of a "critical" use exemption authorizes the applicant to acquire the methyl bromide according to the terms of the decision.

(12) Execution of authorization: The applicant exercises its authorization to use methyl bromide, according to the terms of the decision.

Note: The Montreal Protocol authorizes but does not require production; each applicant must locate a willing supplier and negotiate supply.

IV. Timetable

The domestic timetable for the submission of nominations for "critical" use exemption is as follows:

The international timetable for the submission of nominations for "critical" use exemption is as follows:

January 24 Deadline for submissions of nominations to the Ozone Secretariat. Nominations received after January 31 will be considered for the next year.
Mid-May The TEAP publishes its evaluation and the Ozone Secretariat mails it to the Parties.
June-July The OEWG meets and recommends whether or not the nomination should be approved. The OEWG drafts the decision, if applicable.
October-November-December The Parties meet and decide whether or not to grant the exemption for "critical" use.

V. Information requirements

The forms call for information in the following areas:

  • market significance of use;
  • alternatives/substitutes to use;
  • steps to minimize use;
  • steps to minimize emissions;
  • recycling and stockpiling;
  • research efforts;
  • historical use; and
  • requested quantity per year.

Note that

  • A separate application should be submitted for each commodity/use for which the applicant is seeking an exemption.
  • The amount of methyl bromide requested in the application for "critical" use exemption cannot exceed the average quantity of methyl bromide used in the two years prior to the first year for which the use is nominated for exemption.
  • The TEAP recommended to the Parties that nominations which were granted multi-year exemptions be reviewed annually for quantities required and biennially for essentiality.

VI. Canadian assessment of nominations

Only the Government of Canada, as a Party to the Protocol, may nominate "critical" use exemptions for Canada. Organizations and/or individuals interested in obtaining an exemption for methyl bromide after 2004 are hereby invited to submit nominations to Environment Canada.

The Department of the Environment will evaluate all nominations received in order to decide whether to support them for international review using the following process and schedule.

(1) Applicants for "critical" use exemptions must demonstrate that all elements of the "critical" use criteria described above have been met. Applications must contain all the information elements.

(2) Nominations will be rigorously evaluated in consultation with independent recognized experts, other government departments and non-government organizations that will have complete access to all submitted information.

(3) The final decision to accept any nomination or to forward any nomination for international consideration rests with the Government of Canada.

Food and Drug Regulations — Amendments

Interim Marketing Authorization

Maximum Residue Limits (MRLs) have been established under the Food and Drugs Act for residues of pyrimethanil at 8 parts per million (p.p.m.) in raisins, 5 p.p.m. in grapes and 0.05 p.p.m. in imported bananas. By virtue of subsection B.15.002(1) of the Food and Drug Regulations, the MRL for other foods is 0.1 p.p.m.

The Pest Management Regulatory Agency (PMRA) of Health Canada has been requested to establish MRLs for residues of pyrimethanil, including its metabolites, in imported citrus fruit and pome fruit, in order to permit the import and sale of food containing these residues.

In order to determine whether proposed MRLs are safe, the PMRA conducts a dietary risk assessment. The MRLs will be established if the data requirements for assessing safety have been adequately addressed and the human health risks associated with the proposed MRLs are acceptable.

After the review of all available data, the PMRA has determined that MRLs of 10 p.p.m. in citrus fruit (i.e. calamondins, citrus citron, citrus hybrids, grapefruits, kumquats, lemons, limes, oranges, pummelos, satsuma mandarins and tangerines) and 3 p.p.m. in pome fruit (i.e. apples, crabapples, loquats, mayhaws, oriental pears, pears and quinces) would not pose an unacceptable health risk to the public.

The proposed regulatory amendment will contribute to a safe, abundant and affordable food supply by allowing the importation and sale of food commodities containing acceptable levels of pesticide residues.

Therefore, it is the intention of the PMRA to recommend that the Food and Drug Regulations be amended to establish MRLs for pyrimethanil, including its metabolites, of 10 p.p.m. in citrus fruit (i.e. calamondins, citrus citron, citrus hybrids, grapefruits, kumquats, lemons, limes, oranges, pummelos, satsuma mandarins and tangerines) and 3 p.p.m. in pome fruit (i.e. apples, crabapples, loquats, mayhaws, oriental pears, pears and quinces).

As a means to improve the responsiveness of the regulatory system, an Interim Marketing Authorization (IMA) is being issued to permit the immediate sale of citrus fruit (i.e. calamondins, citrus citron, citrus hybrids, grapefruits, kumquats, lemons, limes, oranges, pummelos, satsuma mandarins and tangerines) and pome fruit (i.e. apples, crabapples, loquats, mayhaws, oriental pears, pears and quinces) with MRLs for pyrimethanil, including its metabolites, of 10 p.p.m. and 3 p.p.m. respectively, while the regulatory process to amend the Regulations is undertaken.

Food and Drug Regulations — Amendments

Interim Marketing Authorization

Maximum Residue Limits (MRLs) have been established under the Food and Drugs Act for residues of cyprodinil at 3 parts per million (p.p.m.) in raisins, 2 p.p.m. in grapes and stone fruit, 0.1 p.p.m. in pome fruit and 0.02 p.p.m. in almonds. By virtue of subsection B.15.002(1) of the Food and Drug Regulations, the MRL for other foods is 0.1 p.p.m.

The Pest Management Regulatory Agency (PMRA) of Health Canada has been requested to establish MRLs for residues of cyprodinil in strawberries, in order to permit the import and sale of food containing these residues.

In order to determine whether proposed MRLs are safe, the PMRA conducts a dietary risk assessment. The MRLs will be established if the data requirements for assessing safety have been adequately addressed and the human health risks associated with the proposed MRLs are acceptable.

After the review of all available data, the PMRA has determined that a MRL of 3.5 p.p.m. in strawberries would not pose an unacceptable health risk to the public.

The proposed regulatory amendment will contribute to a safe, abundant and affordable food supply by allowing the importation and sale of food commodities containing acceptable levels of pesticide residues.

Therefore, it is the intention of the PMRA to recommend that the Food and Drug Regulations be amended to establish a MRL for cyprodinil of 3.5 p.p.m. in strawberries.

As a means to improve the responsiveness of the regulatory system, an Interim Marketing Authorization (IMA) is being issued to permit the immediate sale of strawberries with a MRL for cyprodinil of 3.5 p.p.m. while the regulatory process to amend the Regulations is undertaken.

The Minister of Indian Affairs and Northern Development hereby gives notice, pursuant to section 15 of the Canada Petroleum Resources Act (CPRA), R.S. 1985, c. 36, 2nd Supplement, of the bids which have been selected in response to the 2006 Beaufort Sea/Mackenzie Delta Call for Bids. The following is a summary of the terms and conditions of the exploration licences being issued to the winning bidders as indicated above:

1. The exploration licences confer, relative to the lands, the right to explore for and the exclusive right to drill and test for petroleum; the exclusive right to develop those frontier lands in order to produce petroleum; and the exclusive right, subject to compliance with the other provisions of the Act, to obtain a production licence.

2. The term of the exploration licences issued in the Beaufort Sea/Mackenzie Delta area will be nine years consisting of two consecutive periods of five and four years each.

3. Each interest owner shall drill one well prior to the end of Period I. That is, within the first four or five years of the term, as a condition precedent to obtaining tenure to Period II which comprises the last four years of the licence. Failure to drill a well shall result in the reversion to Crown reserve, at the end of Period I, of the lands not subject to a significant discovery licence or a production licence.

4. The interest holders submitted their issuance fees and posted work deposits equivalent to 25% of the bid submitted for each parcel. A reduction of the deposit will be made as allowable expenditures, as defined in the Call for Bids, are incurred on the lands in Period I of the term.

5. Rentals will be applicable only in Period II at a rate of $3.00 per hectare in respect of the first year, $5.50 in the second year and $8.00 in the third and fourth year. A reduction of rentals will be made as allowable expenditures, as defined in the Call for Bids, are incurred during Period II of the term.

6. Other terms and conditions referred to in the licences include provisions respecting indemnity, liability, successors and assigns, notice, waiver and relief, appointment of representative and agreement by interest owner.

7. This notice announces the release of Standard Radio System Plan (SRSP) — Technical Requirements for Fixed Line-of-Sight Radio Systems Operating in the Band 7125-7725 MHz (SRSP-307.1, Issue 5). This Standard states the minimum technical requirements for the efficient use of the frequency band 7 125-7 725 MHz by low, medium, and high-capacity (LC, MC and HC) digital point-to-point radio systems in the fixed service. This Standard replaces SRSP-307.1, Issue 4.

This document has been coordinated with the Radio Advisory Board of Canada (RABC).
