Vol. 137, No. 47 November 22, 2003 Regulations Amending the Benzene in Gasoline Regulations (Miscellaneous Program)Statutory Authority Canadian Environmental Protection Act, 1999 Sponsoring Departments Department of the Environment and Department of Health REGULATORY IMPACT Description Further to recommendations made by the Standing Joint Committee for the Scrutiny of Regulations, the Regulations Amending the Benzene in Gasoline Regulations (Miscellaneous Program) proposed pursuant to subsection 93(1) of the Canadian Environmental Protection Act, 1999, comprise of corrections to inconsistencies between French and English versions of the Benzene in Gasoline Regulations (the Regulations), which were passed in 1997. It is expected that these changes will have a positive impact on the clarity of the Benzene in Gasoline Regulations and will not change the obligations or intent of these Regulations. The purpose of miscellaneous amendments regulations is to simplify the regulatory process as well as to reduce costs. The proposed regulatory amendments align the French and English version of the Regulations with the following amendments: 1. Paragraph (a) of subsection 1(1) of the French version of the Regulations "l'essence automobile" is replaced with "l'essence" to be consistent with "gasoline" in the English version of the Regulations. 2. Subsection 6(3) of the English version of the Regulations "If the Minister...the Minister shall reject it and notify" replaces "Where the Minister...the Minister may reject it by notifying" to be consistent with "Lorsque le ministre ... il la rejette et avise" in the French version of the Regulations. 3. Section 11 of the French version of the Regulations "sur sa demande" replaces "à sa demande" to be consistent with "on the Minister's request" in the English version of the Regulations. 4. Subsection 19(2) of the French version of the Regulations "ni combiné à...entend" replaces "à des additifs ou à...va" to be consistent with "mixed" in the English version of the Regulations. 5. Subsection 22(3) of the French version of the Regulations "au plus tard le 31 mai" replaces "avant le 31 mai" to be with consistent with "by May 31" in the English version of the Regulations. Alternatives As the proposed amendments will provide clarification to the Benzene in Gasoline Regulations, no other alternatives were considered. Benefits and Costs The benefits associated with the proposed amendments include greater clarity in the interpretation of the Benzene in Gasoline Regulations and will not result in any incremental costs to industry, governments or the Canadian public. Consultation Consistent with the requirements of subsection 93(3) of CEPA 1999, on July 25, 2003, the Minister of the Environment gave the National Advisory Committee (CEPA NAC), which consists of representatives of provincial and Aboriginal governments, an opportunity to advise on a draft of the proposed Regulations. No comments were received. Compliance and Enforcement The proposed Regulations will not alter the manner in which the Benzene in Gasoline Regulations are enforced. Any person may, within 60 days after the date of publication of this notice, file with the Minister of the Environment comments with respect to the proposed Regulations or a notice of objection requesting that a board of review be established under section 333 of that Act and stating the reasons for the objection. All comments and notices must cite the Canada Gazette, Part I, and the date of publication of this notice, and be addressed to the Director General, Air Pollution Prevention Directorate, Environmental Protection Service, Department of the Environment, Ottawa, Ontario K1A 0H3. REGULATIONS AMENDING THE BENZENE IN GASOLINE REGULATIONS (MISCELLANEOUS PROGRAM) AMENDMENTS 1. Paragraph (a) of the definition "essence" in subsection 1(1) of the French version of the Benzene in Gasoline Regulations (see footnote 1) is replaced by the following: a) tout combustible vendu ou présenté comme de l'essence; 2. Subsection 6(3) of the English version of the Regulations is replaced by the following: (3) If the Minister determines that the alternative method is not equivalent to the normally applicable method, the Minister shall reject it and notify the primary supplier to that effect. 3. The portion of section 11 of the French version of the Regulations before paragraph (a) is replaced by the following: 11.
