Proposed notice requiring the preparation and implementation of pollution prevention plans in respect of specified toxic substances released from base metals smelters and refineries and zinc plants
PROPOSED NOTICE
For the purposes of section 91 of the Canadian Environmental Protection Act, 1999, the Minister of the Environment proposes to publish the annexed Notice, which will be issued under section 56 of the Act. The Final Notice will require the preparation and implementation of a pollution prevention plan in respect of specified toxic substances that are released from base metals smelters and refineries and zinc plants, all of which are substances specified on the List of Toxic Substances in Schedule 1 of the Act. The Final Notice will apply to persons who own or operate a base metals smelter or refinery or zinc plant in Canada.
Any person may, within 60 days after the date of publication of this Proposed Notice, file with the Minister of the Environment comments with respect to the Proposed Notice. All comments must cite the date of publication of this Notice in the Canada Gazette, Part I, and be addressed to the Director, Minerals and Metals Branch, Environment Canada, Place Vincent Massey, 12th Floor, 351 Saint-Joseph Boulevard, Gatineau, Quebec K1A 0H3. After receiving and considering comments on this Proposed Notice, the Minister of the Environment intends to publish the Final Notice in the Canada Gazette, Part I.

IMPLEMENTATION OF POLLUTION PREVENTION
PLANS IN RESPECT OF SPECIFIED TOXIC
SUBSTANCES RELEASED FROM BASE
METALS SMELTERS AND REFINERIES
AND ZINC PLANTS
Notice is hereby given that, pursuant to section 56 of the Canadian Environmental Protection Act, 1999, the Minister of the Environment requires any person, or class of persons, described in section 2 of this Notice, to prepare and implement a pollution prevention plan in respect to one or more of the following toxic substances:
Particulate matter containing metals that is released in emissions from copper smelters or refineries, or from both;
Particulate matter containing metals that is released in emissions from zinc plants;
Sulphur dioxide, which has the molecular formula SO2;
Respirable particulate matter less than or equal to 10 microns;
Lead;
Mercury;
Inorganic arsenic compounds;
Inorganic cadmium compounds;
Oxidic, sulphidic, and soluble inorganic nickel compounds;
Polychlorinated dibenzo-para-dioxins, that have the molecular
formula C12H(8-n)O2Cln in
which "n" is greater than 2; and
Polychlorinated dibenzofurans, that have the molecular
formula C12H(8-n)OCln in which "n" is
greater than 2.
1. Definitions
"Act" means the Canadian Environmental Protection Act, 1999.
"Base metal" means any of the following metals: copper, zinc, lead, nickel, or cobalt.
"Existing facility" means a facility in Canada that is listed in Table 1 that releases to the environment one or more of the toxic substances listed in this Notice.
"Facility" means an existing or new base metals smelter or refinery or zinc plant that releases to the environment one or more of the toxic substances listed in this Notice.
"New facility" means a facility that starts operation in Canada after January 1, 2005, and that is not a facility listed in Table 1 of this Notice that releases to the environment one or more of the toxic substances listed in this Notice.
"NPRI ID" means the specific Identification Number assigned to facilities under the National Pollutant Release Inventory (NPRI).
"Plan" means a pollution prevention plan.
"Zinc plant" means a zinc smelter or refinery that releases to the environment one or more of the toxic substances listed in this Notice.
2. Person or class of persons required to prepare and implement a pollution prevention plan
This Proposed Notice applies to
(1) Persons who own or operate an existing facility;
(2) All successors or assigns of the persons identified in paragraph (1);
(3) Any person who owns or operates a new facility in at least one calendar year between January 1, 2005, and January 1, 2016; and
(4) All successors or assigns of the persons identified in paragraph (3) that acquire ownership or control of the facility between January 1, 2005, and January 1, 2016.
Where the Notice applies to more than one facility owned or operated by the same person described in paragraph (1) above, an identifier appears in parentheses following the person's name in Table 1 and that identifier appears in Tables 2 to 5 of this Notice.

3. Activities in relation to which the plan is to be prepared
The Minister requires all persons identified in section 2 to prepare and implement a pollution prevention plan in relation to the smelting, refining or both, of any of the base metals which result in the release of one or more of the toxic substances listed in this Notice.
4. Factors to consider in preparing the plan
The Minister requires all persons identified in section 2 to consider the following factors when preparing their pollution prevention plan:
(1) The application of best available techniques for pollution prevention and control to avoid or minimize the creation and release of pollutants and waste and reduce the overall risk to the environment or human health; and
(2) The targets for annual air releases of the substances in Tables 2 to 5 inclusively. Targets in Tables 2 and 3 are identified as two-phasethe first phase ending December 31, 2008, and the second ending December 31, 2015. Tables 4 and 5 contain annual air release targets for December 31, 2008.

(3) Conformance with guidelines, criteria and recommended practices contained
in Environment Canada's Environmental Code of Practice for Base Metals
Smelters (www.ec.gc.ca/nopp/docs/cp/bms/en/index.cfm) [current draft dated
June 2004]. These guidelines, criteria and recommended practices include:
(a) atmospheric and water release guidelines, i.e. Recommendations R203206, R304;
(b) ambient air and water quality criteria, i.e. Recommendations R209, R306.
(4) The Canada-wide Standard for Mercury Emissions Base metal smelting, which sets out
"For existing facilities: application by all primary zinc, lead and copper smelters of best available pollution prevention and control techniques economically achievable to achieve an environmental source performance (atmospheric emission) guideline of 2 g Hg/tonne total production of finished metals;
For new and expanding facilities: application of best available pollution prevention and control techniques to minimize mercury emissions throughout the life-cycle of the minerals in question to achieve an environmental source performance (atmospheric emission) guideline of 0.2 g Hg/tonne production of finished zinc, nickel, and lead and 1 g Hg/tonne production of finished copper, and consideration of a mercury offset program to ensure no "net" emission increases occur;
Existing facilities will be expected to make a determined effort to meet this
standard by 2008, coincident with implementation of the federal Strategic
Options Report, while any new facility will be required to design for
and achieve compliance immediately upon full scale operation." (Canada-wide

(5) Environmental and health studies relevant to the releases, from the facility,
of toxic substances listed in this Notice. Such studies include the Assessment
Report "Releases from primary and secondary copper smelters and
copper refineries" and "Releases from primary and secondary zinc smelters
and zinc refineries" (www.ec.gc.ca/substances/ese/eng/psap/final/CuZn.cfm),
Annual Progress Reports on the Canada-Wide Acid Rain Strategy
for Post-2000 (www.ec.gc.ca/acidrain/res-pub.html), and any available
studies, surveys and data which are specific to the facility.
(6) Giving priority to pollution prevention activities, that is, the use of processes, practices, materials, products, substances or energy that avoid or minimize the creation of pollutants and waste and reduce the overall risk to the environment or human health (definition of "pollution prevention" as found in section 3 of the Act).
(7) The Minister of the Environment intends to promote regulations which will harmonize regulatory requirements for all base metals smelters and refineries and zinc plants in Canada by 2015. These standards will limit releases of Particulate Matter and Sulphur Dioxide from base metals smelters and refineries and zinc plants and will be based on world leading best available techniques for pollution prevention and control.
5. Period within which the plan is to be prepared
(1) For a person subject to the Final Notice on the date of publication in Part I of the Canada Gazette, the Minister requires that the plan be prepared and its implementation initiated within six months of the publication date of the Final Notice.
(2) For a person becoming subject to the Final Notice after the date of publication in Part I of the Canada Gazette, the Minister requires that the plan be prepared and its implementation initiated within six months of becoming subject to the Final Notice.
6. Period within which the plan is to be implemented
The Minister requires that the plan be implemented by December 31, 2015.
7. Content of plan
Persons preparing the plan are to determine the content of their own plan; however, the plan must meet all the requirements of the Final Notice. It must also contain the information required to file the Declaration of Preparation referred to in section 9 and have the capacity to generate the information required to file the Declaration of Implementation referred to in section 10 and the Interim Progress Reports referred to in section 12.
8. Requirement to keep plan
Under section 59 of the Act, all persons identified in section 2 of this Notice shall keep a copy of the plan at the place in Canada in relation to which the plan is prepared. Where a single plan is prepared for more than one facility, a copy of that plan shall be kept at each location.
9. Declaration of Preparation
Under subsection 58(1) of the Act, persons identified in section 2 of this Notice shall file, within 30 days after the end of the period for the preparation of the plan specified in section 5 or extended under section 14, a written Declaration that a Pollution Prevention Plan Has Been Prepared and Is Being Implemented Releases from Base Metals Smelters and Refineries and Zinc Plants using the form given in Schedule 1 of the Final Notice, to the Minister. Where a person has prepared a single plan for more than one facility, a separate Declaration of Preparation must be filed for each of those facilities. Section 18 provides further information on completing and filing this form.
10. Declaration of Implementation
Under subsection 58(2) of the Act, persons identified in section 2 of this Notice shall file, within 30 days after the completion of the implementation of the plan, a written Declaration that a Pollution Prevention Plan Has Been Implemented Releases from Base Metals Smelters and Refineries and Zinc Plants, using the form given in Schedule 5 of the Final Notice, to the Minister. Where a person has prepared a single plan for more than one facility, a separate Declaration of Implementation must be filed for each of those facilities. Section 18 provides further information on completing and filing this form.
11. Filing of amended declarations
Under subsection 58(3) of the Act, where a person specified in section 2 of this Notice has filed a declaration under sections 9 or 10, and the declaration contains information that, at any time after the filing becomes false or misleading, that person shall file an amended declaration to the Minister within 30 days after the time that the information became false or misleading, using the appropriate form referred to in section 9 or 10.
12. Interim Progress Reports
Persons identified in section 2 of this Notice shall file, on or before each of the dates below, a written Interim Progress Report Releases from Base Metals Smelters and Refineries and Zinc Plants, using the form given in Schedule 4 of the Final Notice, to the Minister. If a Declaration of Implementation is submitted before an Interim Progress Report is due, then the requirement to submit such an Interim Progress Report is nullified.

13. Use of a plan prepared or implemented for another purpose
Under subsection 57(1) of the Act, a person may use a pollution prevention plan prepared or implemented for another purpose to satisfy the requirements of sections 2 to 8 of the Final Notice. Under subsection 57(2) of the Act, where a person uses a plan that does not meet all the requirements of the Final Notice, the person shall amend the plan so that it meets all of those requirements or prepare an additional plan that meets the remainder of those requirements. Persons using existing plans must nonetheless file a Declaration of Preparation under section 9 of this Notice, a Declaration of Implementation under section 10, any amended declarations under section 11 where applicable, and any Interim Progress Reports required under section 12.
14. Extension of time
(1) Under subsection 56(3) of the Act, where the Minister is of the opinion that further time is necessary to prepare the plan as specified in section 5 or to implement the plan as specified in section 6, the Minister may extend the period for a person who submits a written Request for Time Extension Releases from Base Metals Smelters and Refineries and Zinc Plants using the form given in Schedule 3 of the Final Notice, before the expiry of the date referred to in the applicable section 5 or section 6 or before the expiry of any extended period.
(2) Where the Minister is of the opinion that further time is necessary to file an Interim Progress Report under section 12, the Minister may extend the date on which the Interim Progress Report must be filed for a person who submits a written Request for Time Extension Releases from Base Metals Smelters and Refineries and Zinc Plants using the form given in Schedule 3 of the Final Notice, before the date referred to in section 12 or before the expiry of any extended period.
15. Application for waiver of factors to consider
Under subsection 56(5) of the Act, the Minister may waive the requirement for a person to consider a factor specified in section 4 of the Final Notice where the Minister is of the opinion that it is not reasonable nor practicable to consider the factor on the basis of reasons provided by that person when submitting a written Request for Waiver of the Requirement to Consider a Factor or Factors Releases from Base Metals Smelters and Refineries and Zinc Plants, using the form given in Schedule 2 of the Final Notice. Such a request must be made before the expiry of the period within which the plan is to be prepared referred to in section 5. Section 18 provides further information on completing and filing this form.

Whereas the Ministers of the Environment and of Health have assessed information in respect of the substance Quaternary amide, polymer with 2-propenoic acid, sodium salt, reaction products with disodium (disulfite),
Whereas the substance is not on the Domestic Substances List,
And whereas the Ministers suspect that a significant new activity in relation to the substance may result in the substance becoming toxic according to the Canadian Environmental Protection Act, 1999,
Therefore the Minister of the Environment indicates, pursuant to section 85 of that Act, that subsection 81(4) of the same Act applies with respect to the substance.
A significant new activity involving the substance is any new activity other than importing it or manufacturing it for use in industrial, commercial or consumer general purpose cleaners or detergents.
A person that proposes a significant new activity set out in this notice for this substance shall provide to the Minister of the Environment, at least 90 days prior to the commencement of the proposed significant new activity, the following information:
(1) A description of the proposed significant new activity in relation to the substance;
(2) All information prescribed by Schedule VI of the New Substances Notification Regulations;
(3) Subitems 3(1) to 3(4) prescribed by Schedule VII of these Regulations; and
(4) The concentration of the substance in the final product.
The above information will be assessed within 90 days of its being provided to the Minister of the Environment.

EXPLANATORY NOTE
(This explanatory note is not part of the Significant New Activity Notice.)
A Significant New Activity Notice (SNAc Notice) is a legal document pursuant to subsection 81(4) of the Canadian Environmental Protection Act, 1999 (CEPA 1999) issued by the Minister, that lists the activities for a given substance in Canada for which there has been no finding of toxicity under CEPA 1999. The SNAc Notice sets out the appropriate information that must be sent to the Minister for assessment prior to the commencement of a new activity as described in the SNAc Notice.
Substances that are not listed on the Domestic Substances List can only be imported or manufactured by the person who has met the requirements under sections 81 or 106 of CEPA 1999. Under section 86 of CEPA 1999, in circumstances where a SNAc Notice is issued for a new substance, it is the responsibility of every person who transfers the physical possession or control of the substance to notify all persons to whom the possession or control is transferred of the obligation to comply with the SNAc Notice, and of the obligation to notify any new activity and all other information as described in the SNAc Notice. It is the responsibility of the users of the substance to be aware of and comply with the SNAc Notice, and to submit a SNAc notification to the Minister prior to the commencement of a significant new activity associated with the substance.
A SNAc Notice does not constitute an endorsement from Environment Canada of the substance to which it relates, or an exemption from any other laws or regulations that are in force in Canada and that may apply to this substance or activities involving the substance.

PUBLIC SERVICE STAFFING TRIBUNAL
Chairperson (full-time position)
The Public Service Staffing Tribunal (PSST) is a new administrative tribunal established by the Public Service Employment Act, as enacted by the Public Service Modernization Act. The mandate of the PSST is to consider and dispose of complaints regarding internal appointments in the public service of Canada, and complaints from employees of the public service who have been notified that they will be laid off. The PSST will also provide mediation services. The PSST will hear complaints, often in the form of oral hearings, from federal public service employees throughout Canada.
The Chairperson is the Chief Executive Officer of the PSST and has supervision over and direction of the work of the Tribunal. This includes hiring the staff of the Tribunal.
Location: National Capital Region
The successful candidate will have experience as a senior manager and will have an acceptable degree from a recognized university, or an acceptable combination of education, training and experience. Experience in the interpretation and application of legislation is required. Experience in setting up a new organization or leading a transition within an existing organization would be desirable. Knowledge of, or experience in, human resources management or employment matters in the public sector is required.

Vice-Chairman (full-time position)
The Commission is an independent agency, created by Parliament, to ensure that complaints made by the public about the conduct of members of the RCMP are examined fairly and impartially. The Commission is not part of the RCMP.
The Commission's goal is to promote excellence in policing through accountability. The mission is to provide civilian oversight of RCMP members' conduct in performing their policing duties so as to hold the RCMP accountable to the public. The mandate is to receive complaints from the public about the conduct of RCMP members, to conduct reviews when complainants are not satisfied with the RCMP's handling of their complaints, to hold hearings and carry out investigations and to report findings and make recommendations.
Location: National Capital Region
Reporting to the Chairman, the Vice-Chairman provides executive support in the management of a small national organization which examines the complaints made by the public about the conduct of members of the RCMP. The Commission Chairman may delegate to the Vice-Chairman any of the Commission Chairman's powers, duties or functions under the Royal Canadian Mounted Police Act, except the power to delegate and the submission of the annual report to the Minister of Public Safety and Emergency Preparedness. In the event of the absence or incapacity of the Commission Chairman or if the office of the Commission Chairman is vacant, the Minister may authorize the Vice-Chairman to exercise the powers and perform the duties and functions of the Commission Chairman.
The successful candidate should have

The selected candidate must be prepared to relocate to the National Capital Region or to a location within commuting distance and to travel across and outside Canada. No member of the RCMP is eligible.
The selected candidate will also be subject to the Conflict of Interest and Post-Employment Code for Public Office Holders. Before or upon assuming their official duties and responsibilities, public office holders appointed on a full-time basis must sign a document certifying that, as a condition of holding office, they will observe the Code. They must also submit to the Office of the Ethics Commissioner, within 60 days of appointment, a Confidential Report in which they disclose all of their assets, liabilities and outside activities. BASIC RATE
Notice is hereby given that, in accordance with subsection 25(7) of the Pension Benefits Standards Regulations, 1985, the Superintendent of Financial Institutions sets the basic rate, established pursuant to subsection 25(5) of the said Regulations, at $12 for the Office year beginning on April 1, 2005. In accordance with subsection 25(6) of the said Regulations, this rate applies to plans with a year-end between October 1, 2004, and September 30, 2005.
