Environment Specialty Products Convicted of Charges Under Canadian Ozone Regulations
Oshawa, June 25, 2002 - Environment Specialty Products of Pickering, Ontario was convicted on June 17, 2002 in the Ontario Court of Justice, Oshawa with one count of violating the Ozone- depleting Substances Regulations, 1998, made pursuant to the Canadian Environmental Protection Act.
At a sentencing hearing, which concluded on June 19, 2002, evidence was heard that the Company illegally imported hydrochlorofuorocarbons (HCFCs), which are restricted because of their potential to harm the ozone layer. Companies which import HCFCs must do so under strict conditions and only in specified amounts. In convicting the company, the court found that Environment Specialty Products deliberately exceeded its consumption allowance for the 1998 control period.
Environment Specialty Products was fined $35,000, with 90 days to pay.
Charges against Company president, William Northam were dropped.
The charges were laid by Environment Canada after an investigation by the Ontario Regional Office of Environment Canada's Environmental Protection Branch.
