New Enforcement Tools and Chief Review Officer Ensure More Effective Environmental Protection


OTTAWA, April 11, 2001 - Enforcement of the Canadian Environmental Protection Act (CEPA) is receiving a boost with the coming into force of Environmental Protection Compliance Orders and the appointment of a Chief Review Officer and Review Officers, Environment Minister David Anderson announced today.

CEPA entitles companies, individuals, and government agencies and departments to request an independent review of Environmental Protection Compliance Orders (EPCOs) issued to them. EPCOs are new tools under CEPA that will allow enforcement officers to put an immediate stop to suspected illegal activity, to prevent a violation from occurring, or to require action to correct the violation.

"Environmental Protection Compliance Orders give our enforcement officers effective tools to deal directly with polluters and put an immediate stop to actions harming our environment", said Minister Anderson. "I am pleased to appoint Margot Priest as the new Chief Review Officer and Louis LaPierre and John Roe as Review Officers under CEPA. This will further reinforce the fair, predictable and consistent enforcement of the Canadian Environmental Protection Act".

The Chief Review Officer and the Review Officers will operate at arms length from Environment Canada. They are mandated under the Act to conduct a review of any EPCO when a person to whom an Order is issued requests a review. This will generally occur where the person:

  • is not satisfied with the terms or conditions of the EPCO;
  • believes that the EPCO has been unjustly imposed; or,
  • disagrees with the scope of the Order.
