Environmental Charges Laid Against Pickering Firm Under Ozone Regulations
December 7, 2000 - Toronto - Environment Specialty Products of Pickering, Ontario was charged on December 3rd in the Ontario Court of Justice, Oshawa with two counts of violating the Ozone Depleting Substances Regulations, 1998, made pursuant to the Canadian Environmental Protection Act, 1998.
It is alleged that the Company illegally imported hydrochlorofuorocarbons (HCFCs), which are restricted because of their potential to harm the ozone layer. Companies which import HCFCs must do so under strict conditions and only in specified amounts. It is alleged that Environment Specialty Products exceeded its consumption allowance for the 1998 control period and also provided misleading information in its annual report to Environment Canada. The Company's President, William Northam, was also charged.
The next court appearance is Wednesday, December 13th, 2000 in the Ontario Court of Justice, Oshawa.
Contravention of the Canadian Environmental Protection Act, 1998 can result in a fine of up to a maximum of $300,000, or imprisonment for a term not exceeding six months, or both, for a first offence.
The charges were laid by Environment Canada after an investigation by the Ontario Regional Office of Environment Canada's Environmental Protection Branch.
