Notice is hereby given that, pursuant to the provisions of Part 7, Division 3, of the Canadian Environmental Protection Act, 1999, Permit No. 4543-2-03358 is approved.

1. Permittee: Fraser River Pile & Dredge Ltd., New Westminster, British Columbia.

2. Type of Permit: To load waste and other matter for the purpose of disposal at sea and to dispose of waste and other matter at sea.

3. Term of Permit: Permit is valid from April 17, 2005, to April 16, 2006.

4. Loading Site(s):

5. Disposal Site(s):

(a) Cape Mudge Disposal Site: 49°57.70' N; 125°05.00' W, at a depth of not less than 200 m;

(b) Comox (Cape Lazo) Disposal Site: 49°41.70' N; 124°44.50' W, at a depth of not less than 190 m;

(c) Five Finger Island Disposal Site: 49°15.20' N; 123°54.60' W, at a depth of not less than 280 m;

(d) Haro Strait Disposal Site: 48°41.00' N; 123°16.40' W, at a depth of not less than 200 m;

(n) Watts Point Disposal Site: 49°38.50' N; 123°14.10' W, at a depth of not less than 230 m.

The following position-fixing procedures must be followed to ensure disposal at the designated disposal site:

(i) The vessel must inform the appropriate Marine Communications and Traffic Services (MCTS) Centre upon departure from the loading site that it is heading for a disposal site;

(ii) Upon arrival at the disposal site and prior to disposal, the vessel must again call the appropriate MCTS Centre to confirm its position. Disposal can proceed if the vessel is on the disposal site. If the vessel is not within the disposal site boundaries, the MCTS Centre will direct it to the site and advise when disposal can proceed; and

(iii) The vessel will inform the appropriate MCTS Centre when disposal has been completed prior to leaving the disposal site.

6. Route to Disposal Site(s): Direct.

7. Method of Loading and Disposal: Loading by clamshell dredge or suction cutter dredge and pipeline, with disposal by hopper barge or end dumping.

8. Rate of Disposal: As required by normal operations.

9. Total Quantity to Be Disposed of: Not to exceed 70 000 m3.

10. Waste and Other Matter to Be Disposed of:

(a) Dredged material consisting of silt, sand, rock, wood wastes and other material typical to the approved loading site, except logs and usable wood; and

(b) Non-reusable concrete and steel pipe fitted with concrete.

10.1. The Permittee must ensure that every reasonable effort has been made to prevent the deposition of log bundling strand into material approved for loading and disposal at sea and/or remove log bundling strand from material approved for loading and disposal at sea.

11. Requirements and Restrictions:

11.1. The Permittee must notify the permit-issuing office in writing and receive written approval for each loading site prior to any loading or disposal. The written notification must include the following information:

(i) the co-ordinates of the proposed loading site;

(ii) a site map showing the proposed loading site relative to known landmarks or streets;

(iii) a figure showing the legal water lots impacted by the proposed dredging or loading activities, giving the spatial delineations of the proposed dredge site within these water lots;

(iv) all analytical data available for the proposed loading site;

(v) the nature and quantity of the material to be loaded and disposed of;

(vi) the proposed dates on which the loading and disposal will take place; and

(vii) site history for proposed loading site.

Additional requirements may be requested by the permit-issuing office.

11.2. The Permittee must ensure that all contractors involved in the loading or disposal activity for which the permit is issued are made aware of any restrictions or conditions identified in the permit and of the possible consequences of any violation of these conditions. A copy of the permit and the letter of transmittal must be carried on all towing vessels and loading platforms or equipment involved in disposal at sea activities. A copy of the written approval for the appropriate loading site must be displayed with each copy of the permit posted at the loading sites.

11.3. The fee prescribed by the Ocean Dumping Permit Fee Regulations (Site Monitoring) shall be paid by the Permittee in accordance with those Regulations.

11.4. Contact must be made with the Canadian Coast Guard, Regional Marine Information Centre, regarding the issuance of a "Notice to Shipping." The Permittee should contact the Regional Manager, Regional Marine Information Centre, 350-555 West Hastings Street, Vancouver, British Columbia V6B 5G3, (604) 666-6012 (telephone), (604) 666-8453 (facsimile), RMIC-PACIFIC@PAC.DFO-MPO.GC.CA (electronic mail).

11.5. Any enforcement officer designated pursuant to subsection 217(1) of the Canadian Environmental Protection Act, 1999 shall be permitted to mount an electronic tracking device on any vessel that is engaged in the disposal at sea activities authorized by this permit. The Permittee shall take all reasonable measures to ensure there is no tampering with the tracking device and no interference with its operation. The tracking device shall be removed only by an enforcement officer or by a person with the written consent of an enforcement officer.

11.6. The Permittee must report to the Regional Director, Environmental Protection Branch, Pacific and Yukon Region, within 10 days of completion of the loading at each loading site, the nature and quantity of material disposed of pursuant to the permit and the dates on which the activity occurred.

11.7. The Permittee must submit to the Regional Director, Environmental Protection Branch, within 30 days of the expiry of the permit, a list of all work completed pursuant to the permit, the nature and quantity of material disposed of and the dates on which the activity occurred.

11. Waste and Other Matter to Be Disposed of: Dredged material.

12. Requirements and Restrictions:

12.1. The Permittee shall notify in writing the following individuals at least 48 hours prior to each occasion that dredging equipment is mobilized to a loading site. The notification shall include the equipment to be used, the name of the contractor, the contact for the contractor, and the expected period of dredging.

Proof of payment of the remaining balance of $14,570 shall be submitted to Mr. Adrian MacDonald, identified in paragraph 12.1, prior to October 10, 2005.

12.3. Procedures to accurately measure or estimate quantities of dredged material disposed of at each disposal site shall be submitted to Mr. Adrian MacDonald, identified in paragraph 12.1. The procedures shall be approved by Environment Canada prior the commencement of the first dredging operation to be conducted under this permit.

12.4. The Permittee shall prepare an environmental protection plan relating to the dredging and ocean disposal activities authorized by this permit. The plan shall be approved by Environment Canada prior the commencement of the first dredging operation to be conducted under this permit. Modifications to the plan shall be made only with the written approval of Environment Canada.

12.5. A written report shall be submitted to Mr. Adrian MacDonald, identified in paragraph 12.1, within 30 days of either the completion of the work or the expiry of the permit, whichever comes first. This report shall contain the following information: the quantity of material disposed of and the dates on which the loading and disposal activities occurred for each site.

12.6. It is required that the Permittee admit any enforcement officer designated pursuant to subsection 217(1) of the Canadian Environmental Protection Act, 1999, to any place, ship, aircraft, platform or structure directly related to the loading or disposal at sea referred to under this permit, at any reasonable time throughout the duration of this permit.

12.7. A copy of this permit and of documents and drawings referenced in this permit shall be available on-site at all times when dredging operations are underway.

12.8. The dredging and disposal at sea authorized by this permit shall only be carried out by the Permittee or by any person with written approval from the Permittee.

11. Waste and Other Matter to Be Disposed of: Dredged material.

12. Requirements and Restrictions:

12.1. The Permittee shall notify in writing the following individuals at least 48 hours prior to each occasion that dredging equipment is mobilized to a loading site. The notification shall include the equipment to be used, the name of the contractor, the contact for the contractor, and the expected period of dredging.

12.2. The fee prescribed by the Ocean Dumping Permit Fee Regulations (Site Monitoring) shall be paid by the Permittee in accordance with those Regulations. Proof of payment of the remaining balance of $7,050 shall be submitted Mr. Adrian MacDonald, identified in paragraph 12.1, prior to October 10, 2005.

12.3. Procedures to accurately measure or estimate quantities of dredged material disposed of at each disposal site shall be submitted to Mr. Adrian MacDonald, identified in paragraph 12.1. The procedures shall be approved by Environment Canada prior the commencement of the first dredging operation to be conducted under this permit.

12.4. The Permittee shall prepare an environmental protection plan relating to the dredging and disposal at sea activities authorized by this permit. The plan shall be approved by Environment Canada prior the commencement of the first dredging operation to be conducted under this permit. Modifications to the plan shall be made only with the written approval of Environment Canada.

12.5. A written report shall be submitted to Mr. Adrian MacDonald, identified in paragraph 12.1, within 30 days of either the completion of the work or the expiry of the permit, whichever comes first. This report shall contain the following information: the quantity of material disposed of and the dates on which the loading and disposal activities occurred for each site.

12.6. It is required that the Permittee admit any enforcement officer designated pursuant to subsection 217(1) of the Canadian Environmental Protection Act, 1999 to any place, ship, aircraft, platform or structure directly related to the loading or disposal at sea referred to under this permit, at any reasonable time throughout the duration of this permit.

12.7. A copy of this permit and of the documents and drawings referenced in this permit shall be available on site at all times when dredging operations are underway.

12.8. The dredging and disposal at sea authorized by this permit shall only be carried out by the Permittee or by a person with written approval from the Permittee.

2. Type of Permit: To load and dispose of fish waste and other organic matter resulting from industrial fish-processing operations.

3. Term of Permit: Permit is valid from April 30, 2005, to April 29, 2006.

4. Loading Site(s): 49°39.00' N, 54°45.80' W, Twillingate, Newfoundland and Labrador.

5. Disposal Site(s): 49°41.83' N, 54°45.50' W, at an approximate depth of 80 m.

6. Route to Disposal Site: Most direct navigational route from the loading site to the disposal site.

7. Equipment: Vessels, barges or other floating equipment complying with all applicable rules regarding safety and navigation and capable of containing all waste cargo during loading and transit to the approved disposal site.

8. Method of Disposal: The material to be disposed of shall be discharged from the equipment or vessel while steaming within 300 m of the approved disposal site. Disposal will take place in a manner which will promote the greatest degree of dispersion. All vessels will operate at maximum safe speed while discharging offal.

9. Rate of Disposal: As required by normal operations.

10. Total Quantity to Be Disposed of: Not to exceed 2 500 tonnes.

11. Waste and Other Matter to Be Disposed of: Fish waste and other organic matter resulting from industrial fish-processing operations.

12.1. 12.2. A written report shall be submitted to Mr. Rick Wadman, identified in paragraph 12.1, within 30 days of either the completion of the work or the expiry of the permit, whichever comes first. This report shall contain the following information: the quantity and type of material disposed of pursuant to the permit and the dates on which the loading and disposal activities occurred.

12.3. It is required that the Permittee admit any enforcement officer designated pursuant to subsection 217(1) of the Canadian Environmental Protection Act, 1999 to any place, ship, or anthropogenic structure directly related to the loading or disposal at sea referred to under this permit, at any reasonable time throughout the duration of this permit.

12.4. The loading and transit of material to be disposed of at the disposal site must be conducted in such a manner that no material enters the marine environment. Material spilled at any place other than the permitted disposal site must be retrieved. All wastes must be contained on shore while the barge is away from the loading site.

12.5. The material to be disposed of shall be covered by netting or other material to prevent access by gulls, except during direct loading or disposal of the material.

12.6. This permit must be displayed in an area of the plant accessible to the public.

12.7. Vessels operating under the authority of this permit must carry and display a radar-reflecting device at all times mounted on the highest practical location.

12.8. The loading or disposal at sea conducted under this permit shall not be carried out without written authorization from the Permittee.

12.9. Material loaded for the purpose of disposal at sea may not be held aboard any vessel for more than 96 hours without the written consent of an enforcement officer designated pursuant to subsection 217(1) of the Canadian Environmental Protection Act, 1999.

This notice comes into force on March 12, 2005, and remains in force until March 12, 2008. Pursuant to subsection 46(8) of the Canadian Environmental Protection Act, 1999, persons to whom this notice applies shall keep copies of the required information, together with any calculations, measurements and other data on which the information is based, at the facility to which it relates or at that facility's parent company, located in Canada, for a period of three years from the date this notice comes into force.

SCHEDULE 2: CRITERIA FOR REPORTING

Persons who must report

All persons who operate a facility that emits, in calendar year 2005, 100 thousand metric tons (tonnes) of carbon dioxide equivalent (100 kt CO2 eq) or more (the "reporting threshold") of GHGs, measured as the sum total mass of each of the six gases or gas species in Table 1 of Schedule 1, multiplied by their respective Global Warming Potentials (GWPs), as set out in Table 2 of Schedule 1, shall be subject to the reporting requirements set out in this notice.

For the purposes of determining whether a facility meets or exceeds the above reporting threshold, the following equation and explanatory notes are to be used:

E = total emissions of a particular gas or gas species from the facility in the calendar year 2005, expressed in tonnes

GWP = global warming potential of the same gas or gas species

Note 1: emissions of individual species of HFCs and PFCs must be quantified separately and then multiplied by their global warming potentials outlined in Table 2 of Schedule 1.

Note 2: CO2 emissions from combustion of biomass fuels shall not be included in this determination of total emissions for the purposes of establishing whether a facility meets or exceeds the reporting threshold. However, they should be quantified and reported as part of the reportable greenhouse gas emissions information, and indicated separately, as set out in the Reportable Information requirements below.

Reporting facilities are encouraged to use quantification methods for estimating emissions that are consistent with the guidelines approved for use by the United Nations Framework Convention on Climate Change (UNFCCC) for the preparation of National Greenhouse Gas Inventories by Annex 1 Parties (Decision 18/CP.8), and the annex to that decision contained in FCCC/ CP/2002/8.

If the person who operates the facility that is subject to reporting changes during the calendar year, the person who operates the facility, as of December 31 of the calendar year, must report for the entire calendar year. If operations at a facility are terminated in any calendar year, the last operator of that facility is required to report for the portion of the calendar year during which the facility was in operation.

SCHEDULE 3: REPORTABLE INFORMATION

Facility information that must be reported

  • The reporting company's legal and trade name, business number, facility name (if applicable) and address;
  • The two- and four-digit North American Industry Classification System (NAICS) codes and the six-digit NAICS Canada code;
  • The NPRI identification number (if applicable);
  • The name, position, address and telephone number of the public contact (if applicable);
  • The Statement of Certification including the name, position and address of the official signing it; and
  • The legal names of the Canadian parent companies if applicable, their addresses, their percentage of ownership of the reporting company (where available), their business number (where applicable) and Dun and Bradstreet number (where applicable).

GHG emissions information that must be reported

For the GHGs listed in Table 1 of Schedule 1, the following information is to be reported for each facility that is subject to reporting:

  • The quantity in tonnes of direct emissions of the following three gases: carbon dioxide, methane and nitrous oxide, reported by the following source categories: Stationary Fuel Combustion, Industrial Process, Venting and Flaring, Other Fugitive, Waste and Wastewater, and On-site Transportation;
  • The quantity in tonnes of carbon dioxide emissions from biomass combustion shall be reported in a separate notation, and not included as part of the total emissions from these categories. Carbon dioxide emissions from biomass waste and wastewater decomposition need not be reported, nor included in the total emissions;

Note: Table 3, below, provides a representative template for reporting of these gases.

SCHEDULE 4: DEFINITIONS

The following definitions apply to this notice and its Schedules:

  • "Direct Emissions" means emissions from those sources that are actually located at the reporting facility. « émissions directes »
  • "Facility" means a contiguous facility, a pipeline transportation system, or an offshore installation. « installation »:
° "Contiguous Facility" meaning all buildings, equipment, structures and stationary items that are located on a single site or on contiguous or adjacent sites and that are owned or operated by the same person and that function as a single integrated site and includes wastewater collection systems that discharge treated or untreated wastewater into surface waters. « installation contiguë »

° "Equipment" includes transportation machinery integral to the production process(es) carried on at the facility. « équipement »

° "Pipeline Transportation System" meaning all pipelines transporting processed natural gas and their associated installations including storage facilities but excluding straddle plants or other processing installations that are under single ownership within a province or territory. « gazoducs »

° "Offshore Installation" meaning an offshore drilling unit, production platform or ship, or sub-sea installation attached or anchored to the continental shelf of Canada in connection with the exploitation of oil or gas. « installation extracôtière »

  • "Reporting Company" means a person or company that operates one or more facilities that is/are subject to reporting requirements under this notice. « société déclarante »
  • "Statement of Certification" means a document (electronic or hardcopy) with company letterhead and signature of an authorized company official stating that the information contained in the attached emission report is accurate and complete, to the best of their knowledge. « attestation »
  • "Stationary Fuel Combustion" means a non-vehicular combustion source, in which fuel is burned for the purpose of producing energy. « combustion stationnaire de combustible »
  • "Industrial Process Emissions" means emissions from an industrial process involving chemical reactions other than combustion, and not for the purpose of supplying energy. Note: In instances where industrial process emissions are produced in combination with fuel combusted for energy purposes, the emission should be categorized according to the primary purpose of the activity, 'energy' or 'process'. (see footnote 1) « émissions liées aux procédés industriels »
  • "Venting Emissions" are defined as intentional release to the atmosphere of a waste gas or liquid stream. These include, but are not limited to, emissions of casing gas, associated (or solution) gas, treater, stabilizer, dehydrator off-gas, blanket gas, and emissions from pneumatic devices which use natural gas as a driver, compressor start-up, pipeline and other blowdowns, and metering and regulation station control loops. « émissions d'évacuation »
  • "Flaring Emissions" are defined as intentional releases of gases from industrial activities from the controlled combustion of a gas and or liquid stream produced on site not for the purpose of producing energy. They may arise from waste petroleum incineration, hazardous emission prevention systems (whether in pilot or active mode), well testing, natural gas gathering system, processing plant operations, crude oil production, pipeline operations, petroleum refining and chemical fertilizer and steel production. « émissions de torchage »
  • "Other Fugitive Emissions" are defined as intentional or unintentional releases of gases from industrial activities. In particular, they may arise from the production, processing, transmission, storage and use of solid, liquid or gaseous fuels. « autres émissions fugitives »
  • "Waste and Wastewater Emissions" from disposal of waste and waste or wastewater treatment. Sources of emissions from on-site waste disposal and waste or wastewater treatment at a facility may include landfilling of solid waste, flaring of landfill gas, treatment of liquid waste and waste incineration. « émissions des déchets et des eaux usées »
  • "On-site Transportation Emissions" refers to any direct emissions from machinery used for the on-site transportation of products and material integral to the production process. « émissions liées au transport sur le site »

EXPLANATORY NOTE

In order to support its international obligations under the Kyoto Protocol and the formulation of domestic climate change policy, the Government of Canada is committed to requiring the reporting of greenhouse gas emissions. This information will ensure that the Government is able to measure, track and report progress on the reduction of greenhouse gases (GHG).

In March of 2004, the Government of Canada announced the first phase of a mandatory reporting system. The first phase focuses on a limited number of emitters and basic reporting requirements. The reporting requirements of this notice are a continuation of the first phase and form part of a collaborative process with Canada's provinces and territories to arrive at a harmonized reporting system that will meet the information needs of all levels of government, provide Canadians with reliable and timely information on GHG emissions and support the proposed Large Final Emitters regime.

Notice of a proposed amendment to the bulk oil cargo fees applicable to the Quebec/Maritime Region, the Newfoundland Region and the Great Lakes Region charged by Eastern Canada Response Corporation Ltd. pursuant to an arrangement required by paragraphs 660.2(2)(b) and 660.2(4)(b) of the Canada Shipping Act.

Description

Eastern Canada Response Corporation Ltd. (ECRC) currently is a certified response organization pursuant to subsection 660.4(1) of the Act in respect of a rated capability of 10 000 tonnes and a geographic area covering the Canadian waters south of 60° north latitude in the provinces of Newfoundland and Labrador, Prince Edward Island, Nova Scotia, New Brunswick, Quebec, Ontario, Manitoba, Saskatchewan and Alberta, excluding the waters in the primary areas of response associated with the designated ports of Saint John, New Brunswick, and Point Tupper, Nova Scotia. It includes but is not limited to the waters of the Atlantic Provinces, the waters of James Bay, Hudson Bay and Ungava Bay and the waters in the province of Quebec, including the St. Lawrence River, the waters of the Canadian Great Lakes system and connecting channels within the province of Ontario, including Lake Superior, the St. Mary's River, Lake Huron, the St. Clair River, Lake St. Clair, the Detroit River, Lake Erie, Lake Ontario, the St. Lawrence River, the waters of Lake Winnipeg, the waters of Athabasca River from Fort McMurray to Lake Athabasca and the waters of Lake Athabasca.

Definitions

1. In this notice of fees

"Act" means the Canada Shipping Act. (Loi)

"Asphalt" means a derivate of oil that is commercially described as road or paving asphalt or unblended roofers flux, that has a specific gravity equal to or greater than one, that is solid at 15 degrees Celsius and that sinks to the bottom as a solid when immersed in water. (asphalte)

"Atlantic Provinces" means Nova Scotia, New Brunswick, Prince Edward Island and Newfoundland and Labrador. (provinces de l'Atlantique)

"BOCF" means bulk oil cargo fee (DPPV)

"designated oil handling facility" means an oil handling facility that is designated pursuant to subsection 660.2(8) of the Act and is located in ECRC's geographic area. (installation de manutention d'hydrocarbures agréée)

"ECRC" means Eastern Canada Response Corporation Ltd., a company formed as a result of the amalgamation of Eastern Canada Response Corporation Ltd., Great Lakes Response Corporation of Canada and Canadian Marine Response Management Corporation, effective January 1, 1999. (SIMEC)

"Great Lakes Region" means the area covered by the Canadian Great Lakes system and connecting channels within the Province of Ontario, including Lake Superior, the St. Mary's River, Lake Huron, the St. Clair River, Lake St. Clair, the Detroit River, Lake Erie, Lake Ontario, the St. Lawrence River from Kingston, Ontario, to a line drawn between Butternut Bay (latitude 44°31'12" N and longitude 75°46'54" W) on the Canadian side to Oak Point (latitude 44°30'48" N and longitude 75°45' 20" W) on the U.S. side of the St. Lawrence River, Lake Winnipeg, Athabasca River from Fort McMurray to Lake Athabasca and the waters of Lake Athabasca. (région des Grands Lacs)

"Newfoundland Region" means the province of Newfoundland and Labrador. (région de Terre-Neuve)

"Quebec/Maritime Region" means the area covered by the waters of James Bay, Hudson Bay and Ungava Bay, the waters in the province of Quebec and that portion of the St. Lawrence River in the province of Ontario to a line drawn between Butternut Bay (latitude 44°31'12" N and longitude 75°46'54" W) on the Canadian side to Oak Point (latitude 44°30'48" N and longitude 75°45'20" W) on the U.S. side of the St. Lawrence River and in the Atlantic Provinces, excluding the waters north of the 60th parallel of latitude and the primary areas of response associated with the designated ports of Saint John, New Brunswick, and Point Tupper, Nova Scotia, and excluding Newfoundland and Labrador. "ship" means a ship within the meaning of section 660.2(1) of the Act. (navire)

"ship (bulk oil)" means a ship that is constructed or adapted primarily to carry bulk oil in its cargo spaces. (navire (avec produits pétroliers en vrac))

Bulk Oil Cargo Fees

2. This part applies to the loading and unloading of oil at oil handling facilities located in each of the following regions.

Quebec/Maritime Region

3. The total BOCF payable by a designated oil handling facility that has an arrangement with ECRC shall be determined by multiplying the total number of tonnes of bulk oil unloaded and (in the case of bulk oil intended for international destinations and destinations north of 60° north latitude) loaded at the designated oil handling facility, by the BOCF per tonne for each type of oil set out in sections 5 and 6 of this part.

4. The total BOCF payable by a ship (bulk oil) shall be determined as follows:

(a) in the case of bulk oil loaded onto the ship (bulk oil) and intended for international destinations and destinations north of 60° north latitude, by multiplying the total number of tonnes of bulk oil loaded at an oil handling facility that does not have an arrangement with ECRC, by the BOCF per tonne for each type of oil set out in sections 5 and 6 of this part; and

(b) in the case of bulk oil unloaded from the ship (bulk oil), by multiplying the total number of tonnes of bulk oil unloaded at an oil handling facility that does not have an arrangement with ECRC, by the BOCF per tonne for each type of oil set out in sections 5 and 6 of this part.

5. The BOCF applicable in respect of oil other than asphalt is

(a) an amended fee of twenty cents (20.0˘) per tonne, plus all applicable taxes from the date of this publication to December 31, 2005; and

(b) an amended fee of twenty-eight and five-tenths cents (28.5˘) per tonne, plus all applicable taxes from January 1, 2006.

6. The BOCF applicable in respect of asphalt is

(a) an amended fee of ten cents (10.0˘) per tonne, plus all applicable taxes from the date of this publication to December 31, 2005; and

(b) an amended fee of fourteen and twenty-five hundredths cents (14.25˘) per tonne, plus all applicable taxes from January 1, 2006.

Newfoundland Region

7. The total BOCF payable by a designated oil handling facility that has an arrangement with ECRC shall be determined by multiplying the total number of tonnes of bulk oil unloaded and (in the case of bulk oil intended for international destinations and destinations north of 60° north latitude) loaded at the designated oil handling facility, by the BOCF per tonne for each type of oil set out in sections 9 and 10 of this part.

8. The total BOCF payable by a ship (bulk oil) shall be determined as follows:

(a) in the case of bulk oil loaded onto the ship (bulk oil) and intended for international destinations and destinations north of 60° north latitude, by multiplying the total number of tonnes of bulk oil loaded at an oil handling facility that does not have an arrangement with ECRC, by the BOCF per tonne for each type of oil set out in sections 9 and 10 of this part; and

(b) in the case of bulk oil unloaded from the ship (bulk oil), by multiplying the total number of tonnes of bulk oil unloaded at an oil handling facility that does not have an arrangement with ECRC, by the BOCF per tonne for each type of oil set out in sections 9 and 10 of this part.

9. The BOCF applicable in respect of oil other than asphalt is

(a) an amended fee of six and three-hundredths cents (6.03˘) per tonne, plus all applicable taxes from the date of this publication to December 31, 2005; and

(b) an amended fee of six and twenty-five hundredths cents (6.25˘) per tonne, plus all applicable taxes from January 1, 2006.

10. The BOCF applicable in respect of asphalt is

(a) an amended fee of three and fifteen-thousandths cents (3.015˘) per tonne, plus all applicable taxes from the date of this publication to December 31, 2005; and

(b) an amended fee of three and one hundred and twenty-five thousandths cents (3.125˘) per tonne, plus all applicable taxes from January 1, 2006.

Great Lakes Region

11. The total BOCF payable by a designated oil handling facility that has an arrangement with ECRC shall be determined by multiplying the total number of tonnes of bulk oil unloaded and (in the case of bulk oil intended for international destinations and destinations north of 60° north latitude) loaded at the designated oil handling facility, by the BOCF per tonne for each type of oil set out in sections 13 and 14 of this part.

12. The total BOCF payable by a ship (bulk oil) shall be determined as follows:

(a) in the case of bulk oil loaded onto the ship (bulk oil) and intended for international destinations and destinations north of 60° north latitude, by multiplying the total number of tonnes of bulk oil loaded at an oil handling facility that does not have an arrangement with ECRC, by the BOCF per tonne for each type of oil set out in sections 13 and 14 of this part; and

(b) in the case of bulk oil unloaded from the ship (bulk oil), by multiplying the total number of tonnes of bulk oil unloaded at an oil handling facility that does not have an arrangement with ECRC, by the BOCF per tonne for each type of oil set out in sections 13 and 14 of this part.

13. The BOCF applicable in respect of oil other than asphalt is

(a) an amended fee of forty-three cents (43.0˘) per tonne, plus all applicable taxes from the date of this publication to December 31, 2005; and

(b) an amended fee of sixty cents (60.0˘) per tonne, plus all applicable taxes from January 1, 2006.

14. The BOCF applicable in respect of asphalt is

(a) an amended fee of twenty-one and five-tenths cents (21.5˘) per tonne, plus all applicable taxes from the date of this publication to December 31, 2005; and

(b) an amended fee of thirty cents (30.0˘) per tonne, plus all applicable taxes from January 1, 2006.
