Canada is party to three international agreements dealing with the export and import of hazardous waste and prescribed non-hazardous waste. As part of its international obligations under the Basel Convention and the Organization for Economic Cooperation and Development (OECD) Council Decision C(90)178, Canada is required to work towards developing its capacity to reduce its exports of hazardous wastes.
In particular, s. 188 of CEPA 1999, allows the Minister of the Environment to require submission of plans for the reduction or phase-out of exports of wastes destined for final disposal in another country, and the implementation of those plans. The nature of requirements for the plans would be set down in regulations made under s. 191 of the Act. The regulations would take into account:
- the benefit of using the closest disposal facility, even if that facility is in another country; and
- any changes in the quantity of goods whose production results in the creation of hazardous wastes.
