An Order is instructions, decisions or directions given by the Minister(s) which are authorized by legislation. These can vary from simple commands to complex and reasoned decisions.

Ministerial Orders approved for pre-publication by the Clerk of the Privy Council are published in Part I of the Canada Gazette. In fact, section 332 of CEPA 1999 requires that every order made by the Minister of the Environment under CEPA 1999 must be published in Part I of the Canada Gazette, and be subject to a 60-day period during which anyone may comment, file a notice of objection or request a board of review. Following public consultations, the final Order is published in Part II of the Canada Gazette.

An Order-in-Council is an official government decision made by the Cabinet (Privy Council) to make, amend or repeal a regulation. An Order-in-Council must specify the provisions of the Act that constitute the statutory authority for the regulations being made, amended or repealed. An Order-in-Council can also be an executive order, decree or proclamation made by the Governor-in-Council (Privy Council) authorizing an administrative action.

CEPA 1999 provides for the making of Interim Orders in specific circumstances where immediate action is required to deal with a significant danger to the environment or to human life or health.

Canada Gazette notices, orders and regulations are presented in three formats: Adobe PDF format, HTML (Hypertext Markup Language) and ASCII (American Standard for Computer Information Interchange). The on-line PDF format of the Canada Gazette is official as of April 1, 2003. The electronic versions of the Canada Gazette, Parts I, II and III prior to April 1, 2003, are not the official publications. For all purposes of interpreting and applying the law, users should consult the appropriate official publication (PDF from April 1, 2003 or print prior to April 1, 2003) of the Canada Gazette, Parts I, II and III.
