Significant New Activity Notice

(Section 85 of the Canadian Environmental
Protection Act, 1999
)

Whereas the Ministers of the Environment and of Health have assessed information in respect of the substance Siloxanes and Silicones, 3-[(2-aminoethyl)amino]-2-methylpropyl Me, di-Me, reaction products with N,N,N-trimethyloxiranemethanaminium chloride, Chemical Abstracts Service No. 495403-02-6,

Whereas the substance is not on the Domestic Substances List,

And whereas the Ministers suspect that a significant new activity in relation to the substance may result in the substance becoming toxic according to the Canadian Environmental Protection Act, 1999,

Therefore the Minister of the Environment indicates, pursuant to section 85 of that Act, that subsection 81(4) of the same Act applies with respect to the substance.

A significant new activity involving the substance is any use in personal care products at final concentrations greater than 4 percent.

A person that proposes a significant new activity set out in this notice for this substance shall provide the Minister of the Environment, at least 90 days prior the commencement of the proposed significant new activity, with the following information:

(1) A description of the proposed significant new activity in relation to the substance;

(2) All information prescribed by Schedule VI of the New Substances Notification Regulations;

(3) Subitems 3(1) to 3(4) prescribed by Schedule VII of these Regulations;

(4) The concentration of the substance in the final product; and

(5) Data on skin sensitization in humans at the proposed maximum concentration, or a justified equivalent.

The above information will be assessed within 90 days of its being provided to the Minister of the Environment.

EXPLANATORY NOTE

(This explanatory note is not part of the
Significant New Activity Notice.)

A Significant New Activity Notice (SNAc Notice) is a legal document pursuant to subsection 81(4) of the Canadian Environmental Protection Act, 1999 (CEPA 1999) issued by the Minister, that lists the activities for a given substance in Canada for which there has been no finding of toxicity under the CEPA 1999. The SNAc Notice sets out the appropriate information that must be sent to the Minister for assessment prior to the commencement of a new activity as described in the SNAc Notice.

Substances that are not listed on the Domestic Substances List can only be imported or manufactured by the person who has met the requirements under sections 81 or 106 of the CEPA 1999. Under section 86 of the CEPA 1999, in circumstances where a SNAc Notice is issued for a new substance, it is the responsibility of every person who transfers the physical possession or control of the substance to notify all persons to whom the possession or control is transferred of the obligation to comply with the SNAc Notice and of the obligation to notify any new activity and all other information as described in the SNAc Notice. It is the responsibility of the users of the substance to be aware of and comply with the SNAc Notice and to submit a SNAc notification to the Minister prior to the commencement of a significant new activity associated with the substance.

A SNAc Notice does not constitute an endorsement from Environment Canada of the substance to which it relates nor an exemption from any other laws or regulations that are in force in Canada and that may apply to this substance or activities involving the substance.

Interest rates

In accordance with subsection 13(3) of the Canada Student Loans Regulations, notice is hereby given that, pursuant to subsections 13(1) and 13(2) respectively, the Minister of State styled Minister of Human Resources and Skills Development has fixed the Class "A" rate of interest at 4.375 percent and the Class "B" rate of interest at 5.250 percent for the loan year ending on July 31, 2005.

RADIOCOMMUNICATION ACT

Notice No. SMBR-003-04 — Amendments to the FM multiplex sub-carrier standards

The Department announces amendments to the FM multiplex sub-carrier technical standards.

The departmental standards for FM multiplex sub-carriers are in section C-7.3.3 of Broadcasting Procedures and Rules, Part 3 (BPR-3), and in section A-2.2.4 of Annex A of Broadcasting Equipment Technical Standards 6 (BETS-6). The FM multiplex sub-carriers are used to provide radiocommunication services such as radio paging and alphanumeric data transmission. The sub-carriers are also used to provide data services related to the FM broadcasting program. The current standards limit the modulation of multiplex sub-carriers in the FM baseband to control the spillover of the FM emissions in the adjacent channel and to minimize the impact of the multiplex sub-carriers on the main audio channel.

The Radio Broadcast Data System (RBDS) sub-carrier is a standard multiplex sub-carrier. The RBDS offers a wide range of implementation options such as Program Identification (PI), Program Service (PS) name, Alternative Frequency (AF) list, Traffic Program (TP) identification and Traffic Announcement (TA) signal. Today, an increasing number of FM stations in Canada use the RBDS, and car radios with RBDS functionality are available from different manufacturers at prices that are only slightly higher than those of conventional radios. As a consequence of the widespread deployment of the RBDS sub-carrier, the capacity available to other multiplex operations is becoming limited.

Amendment

To enable the deployment of additional sub-carrier services, the Department proposes to make the multiplex sub-carrier standards more flexible by relaxing the restriction on the percentage of modulation below 76 kHz. It is proposed to amend BPR-3 and BETS-6 along the following technical principles:

Monophonic transmission

The modulation of the carrier by the arithmetic sum of all sub-carriers between 20 and 99 kHz shall not exceed 30 percent referenced to 75 kHz modulation deviation, and the modulation of the carrier by the arithmetic sum of all sub-carriers above 76 kHz shall not exceed 10 percent.

Stereophonic transmission

The modulation of the carrier by the arithmetic sum of all sub-carriers between 53 and 99 kHz shall not exceed 20 percent referenced to 75 kHz modulation deviation, and the modulation of the carrier by the arithmetic sum of all sub-carriers above 76 kHz shall not exceed 10 percent.

The Department will amend BPR-3 and BETS-6 documents in the coming months to reflect the above changes to the technical standards governing FM multiplex sub-carriers.

TELECOMMUNICATIONS ACT

Notice No. SMSE-014-04 — CS-03, Issue 9

Notice is hereby given that Industry Canada is releasing Issue 9 of Compliance Specification 03 (CS-03). This issue includes the following changes:

1. All amendments made to CS-03, Issue 8, namely

Amendment 1 — April 4, 1998

Amendment 2 — March 27, 1999

Amendment 3 — November 27, 1999

Amendment 4 — March 3, 2001

Amendment 5 — March 9, 2002

Amendment 6 — June 8, 2002

Amendment 7 — July 24, 2004

2. Part III has changed as follows:

(a) The wiring configuration specifications have been deleted and replaced with a reference to the Connector Wiring Configuration Catalog T1.TR.5;

(b) The prefix "CA" in all USOC codes has been replaced with the prefix "RJ"; and

(c) The mechanical specifications have been deleted and replaced with a reference to Section 6.1 of TIA-968-A.

3. Part I, Section 3.4.6

The out-of-band metallic voltage limit for analogue voiceband equipment has been extended from 6 MHz to 30 MHz.

4. Part I, Section 3.10.1

The stuttered dial tone detection requirements have been changed and made the same as TIA-968-A, Section 4.7.8.2.

5. Part I, Section 3.4.1

The maximum transmitted power for signals other than live voice over two-wire and four-wire lossless tie trunks has been relaxed from -15 dBm to -11 dBm.

6. Part I, Table 3.4(c); Part II, Table 3.6: Allowable Net Amplification Between Ports

This table has been revised to reflect the changes made in 5 and 6 above. This table has also been added to Part VI and Part VII to clarify the through transmission requirements.

7. Part II, Section 3.6.3; Part VI, Section 3.5.2; and Part VII, Section 3.2.4

The -12 dBm signal power limit for encoded analogue content has been relaxed as follows:

(a) -6 dBm for V.90 and V.92 modems; and

(b) -9 dBm for all signals other than live voice, V.90 or V.92 modems or network control signals.

8. The requirements for VDSL terminal equipment, issued as Provisional on January 15, 2003, have been incorporated in Part VIII.

Changes 5, 6 and 7 are the same as the technical changes adopted by ACTA in Addendum TIA-968-A-1.

Issue 9 of CS-03 will come into effect upon publication of this notice.

Interested parties should submit their comments within 75 days of the date of publication of this notice. Shortly after the close of the comment period, all comments received will be posted on Industry Canada's Spectrum Management and Telecommunications Web site at http://strategis.gc.ca/spectrum.

The Board of Canada Post is seeking candidates with a proven record as a CEO or a senior executive of a major, multi-faceted, labour-intensive enterprise with full profit and loss accountability; experience with acquisitions and divestitures; capital, technical, financial and human resources leadership; and experience in reporting to and liaising with boards. Requirements for this position include a post-secondary degree from an accredited university. A master's degree in business or a comparable background would be an asset.

Candidates should also bring the ability to effectively conceptualize and implement corporate vision and business strategies to create a sustainable competitive advantage; a global perspective and a broad knowledge and understanding of the trends, practices and policies affecting the postal industry and the external environment, including regulatory agencies; the ability to build and manage a complete, competent and cohesive management team; and knowledge of government and corporate governance structures and public policy issues.

The new President and CEO of Canada Post should have excellent interpersonal, communications, influencing and people leadership skills; demonstrate ethical, trustworthy and conscientious leadership; possess personal credibility and act and speak with consistency and honesty; and manage risk appropriately.

The successful candidate must be prepared to relocate to the National Capital Region, or to a location within reasonable commuting distance, and to travel occasionally.

Proficiency in both official languages is an asset.
