2. Type of Permit: To load and dispose of dredged material.

5. Disposal Site(s):

(b) North Lake, Prince Edward Island: 46°28.10' N, 62°03.73' W (NAD83). 6. Route to Disposal Site(s):

(a) Grahams Pond: Via pipeline;

(b) North Lake: Via pipeline and trucks;

(c) Red Head: Via pipeline; and

(d) Tracadie Harbour: Via pipeline and sidecasting.

7. Equipment:

(a) Grahams Pond: Suction dredges;

(b) North Pond: Suction dredges and land-based heavy equipment;

(c) Red Head: Suction dredges; and

(d) Tracadie Harbour: Suction dredges and land-based heavy equipment.

8. Method of Disposal:

(a) Suction dredge via pipeline; and

(b) Land-based heavy equipment: Sidecasting and end dumping and leveling.

9. Rate of Disposal: As required by normal operations.

10. Total Quantity to Be Disposed of:

(a) Grahams Pond: Not to exceed 8 000 m3 place measure;

(b) North Lake: Not to exceed 8 000 m3 place measure;

(c) Red Head: Not to exceed 20 000 m3 place measure; and

(d) Tracadie Harbour: Not to exceed 5 000 m3 place measure.

11. Waste and Other Matter to Be Disposed of: Dredged material.

12. Requirements and Restrictions:

12.1. The Permittee shall notify in writing the following individuals at least 48 hours prior to each occasion that dredging equipment is mobilized to a loading site. The notification shall include the equipment to be used, the name of the contractor, the contact for the contractor, and the expected period of dredging.

12.2. The fee prescribed by the Ocean Dumping Permit Fee Regulations (Site Monitoring) shall be paid by the Permittee in accordance with those Regulations. Proof of payment of the remaining balance of $9,635 shall be submitted to Mr. Adrian MacDonald, identified in paragraph 12.1, prior to October 11, 2004.

12.3. Procedures to accurately measure or estimate quantities of dredged material disposed of at each disposal site shall be submitted to Mr. Adrian MacDonald, identified in paragraph 12.1. The procedures shall be approved by the Department of the Environment prior to the commencement of the first dredging operation to be conducted under this permit.

12.4. The Permittee shall prepare an environmental protection plan relating to the dredging and ocean disposal activities authorized by this permit. The plan shall be approved by the Department of the Environment prior to the commencement of the first dredging operation to be conducted under this permit. Modifications to the plan shall be made only with the written approval of the Department of the Environment.

12.5. A written report shall be submitted to Mr. Adrian MacDonald, identified in paragraph 12.1, within 30 days of either the completion of the work or the expiry of the permit, whichever comes first. This report shall contain the following information: the quantity of material disposed of and the date on which the loading and disposal activities occurred for each site.

12.6. It is required that the Permittee admit any enforcement officer designated pursuant to subsection 217(1) of the Canadian Environmental Protection Act, 1999, to any place, ship, aircraft, platform or anthropogenic structure directly related to the loading or disposal at sea referred to under this permit, at any reasonable time throughout the duration of this permit.

12.7. A copy of this permit and of documents and drawings referenced in this permit shall be available on-site at all times when dredging operations are under way.

12.8. The dredging and disposal at sea authorized by this permit shall only be carried out by the Permittee or by any person with written approval from the Permittee.

(e) Howards Cove: Via pipeline.

8. Method of Disposal:

(a) Suction dredge via pipeline.

(b) Barge-mounted mechanical dredges: Sidecasting and dumping to take place within 100 metres of the coordinates defining the disposal site.

9. Rate of Disposal: As required by normal operations.

(a) Covehead: Not to exceed 5 000 m3 place measure.

(b) Darnley Basin: Not to exceed 10 000 m3 place measure.

Significant New Activity Notice No. 12445

Significant New Activity Notice

(Section 110 of the Canadian Environmental
Protection Act, 1999
)

Whereas the Ministers of the Environment and of Health have assessed information in respect of the living organism Fungus Fusarium species strain CK 46-8;

Whereas the living organism is not on the Domestic Substances List;

And whereas the Ministers suspect that a significant new activity in relation to the living organism by virtue of its composition, may result in the living organism becoming toxic, as set out in section 64 of the Canadian Environmental Protection Act, 1999 (CEPA 1999);

Therefore, the Minister of the Environment indicates, pursuant to section 110 of CEPA 1999, that subsection 106(4) of the same Act applies with respect to the living organism.

A significant new activity involving the living organism is any activity that does not include

(a) use of the living organism within a contained facility, the latter as defined in subsection 2(1) of the New Substances Notification Regulations, in the production of a metabolite to be used as starting material for the production of a veterinary drug;

(b) filtration through 0.2 micron filters of all gaseous wastes and disinfection of the filters to destroy 99.999 percent of the living organism;

(c) disinfection of all liquid and solid wastes to destroy 99.999 percent of the living organism prior to transport and incineration of these wastes, as set out in paragraphs (d) and (e);

(d) transportation of all disinfected liquid and solid wastes to the incineration facility using a conveyance, as defined in section 216 of the Act, constructed or equipped to contain leaks, spills or other such releases during transport; or

(e) incineration of all disinfected liquid and solid wastes, at no less than 900°C by a facility authorized by the laws, regulations and other requirements of the jurisdiction where the incineration will take place.

A person that proposes to use this substance for a significant new activity set out in this notice shall provide to the Minister, at least 90 days prior to the commencement of the proposed significant new activity, the following information:

(1) A description of the proposed significant new activity in relation to the living organism;

(2) A description of the mode of action of the living organism in relation to a use other than that set out in paragraph (a) above;

(3) The data from antibiotic susceptibility testing performed on the living organism;

(4) A description of any disinfection method with a disinfection efficacy other than that referred to in paragraph (b) for the destruction of the living organism from the filters, and the efficacy of that method;

(5) A description of any disinfection method with a disinfection efficacy other than that referred to in paragraph (c) above for the treatment of liquid or solid wastes prior to incineration, and the efficacy of that method;

(6) A description of any other method to transport all disinfected liquid and solid wastes as described in paragraph (d) above and rationale for the choice; and

(7) A description of any method of disposal for all disinfected liquid and solid wastes other than that referred to in paragraph (e) above and the efficacy of that method.

The above information will be assessed within 90 days of its being provided to the Minister.

EXPLANATORY NOTE

(This explanatory note is not part of the
Significant New Activity Notice.)

A Significant New Activity Notice (SNAc Notice) is a legal document pursuant to subsections 85(1) or 110(1) of the Canadian Environmental Protection Act, 1999 (CEPA 1999) issued by the Minister, that lists the activities for a given substance in Canada for which there has been no finding of toxic under the CEPA 1999. The SNAc Notice sets out the appropriate information that must be sent to the Minister for assessment prior to the commencement of a new activity as described in the SNAc Notice.

Substances that are not listed on the Domestic Substances List can only be imported or manufactured by the person who has met the requirements under sections 81 or 106 of CEPA 1999. Under sections 86 or 111 of CEPA 1999, in circumstances where a SNAc Notice is issued for a new substance, it is the responsibility of every person who transfers the physical possession or control of the substance to notify all persons to whom the possession or control is transferred of the obligation to comply with the SNAc Notice, and of the obligation to notify any new activity and all other information as described in the SNAc Notice. It is the responsibility of the users of the substance to be aware of and comply with the SNAc Notice, and to submit a SNAc notification to the Minister prior to the commencement of a significant new activity associated with the substance.

A SNAc Notice does not constitute an endorsement by the Minister with respect to the substance to which it relates, nor does it constitute an exemption from the application of any other laws or regulations or other statutory instruments that may also apply to the substance or activities involving or in respect of the substance.

WHEREAS Letters Patent were issued by the Minister of Transport for the St. John's Port Authority (the "Authority") under the authority of the Canada Marine Act effective May 1, 1999;

WHEREAS Schedule B of the Letters Patent describes the federal real property managed by the Authority;

WHEREAS the Board of Directors of the Authority has requested the Minister of Transport to issue Supplementary Letters Patent to delete from Part I of Schedule B of the Letters Patent the federal real property described below;

NOW THEREFORE under the authority of section 9 of the Canada Marine Act, the Letters Patent are amended by deleting the federal real property described below from Part I of Schedule B of the Letters Patent:

AND all that parcel of land shown as Parcel 99-1 on Public Works and Government Services Canada Plan S-4100-12 being more particularly described as follows:

Beginning at a point being the most northerly corner of Parcel 99-1 hereinafter described, said point being S 27°58'45" W a distance of 175.863 metres and S 48°54'52" W a distance of 53.793 metres from Crown Land Monument No. 026206;

Thence S 42°28'31" E a distance of 32.814 metres to an iron pin;

Thence S 37°06'11" W a distance of 89.595 metres to an iron pin;

Thence S 43°29'31" W a distance of 56.446 metres to an iron pin;

Thence S 43°29'20" W a distance of 50.627 metres to an iron pin;

Thence S 45°32'29" W a distance of 72.689 metres to an iron pin;

Thence S 42°29'22" W a distance of 82.391 metres to an iron pin;

Thence N 37°49'31" W a distance of 99.842 metres to a capped iron pin;

Thence N 53°01'43" E a distance of 100.940 metres to a capped iron pin;

Thence S 43°00'47" E a distance of 3.168 metres to a non-monumented point;

Thence N 54°40'55" E a distance of 35.055 metres to a non-monumented point;

Thence N 45°05'25" E a distance of 64.516 metres to a non-monumented point;

The above-described Parcel 99-1 contains an area of 2.3520 hectares more or less.

All bearings are grid referenced to Longitude 53°00' West the central meridian of MTM Zone 1. NAD83 values.

CANADA MARINE ACT

Vancouver Port Authority — Supplementary Letters Patent

BY THE MINISTER OF TRANSPORT

WHEREAS Letters Patent were issued by the Minister of Transport for the Vancouver Port Authority (the "Authority") under the authority of the Canada Marine Act effective March 1, 1999;

WHEREAS Schedule B of the Letters Patent describes the federal real property managed by the Authority;

AND WHEREAS the board of directors of the Authority has requested the Minister of Transport to issue Supplementary Letters Patent to add to Schedule B of the Letters Patent the real property described in Annex A hereto;

NOW THEREFORE under the authority of section 9 the Canada Marine Act, the Letters Patent are amended by adding the real property described in Annex A hereto to the end of the list of properties described in paragraph 2 of Schedule B of the Letters Patent and before the "save and except" provision that concludes paragraph 2.

These Supplementary Letters Patent are to be effective on the date of registration in the Vancouver/New Westminster Land Title Office of the transfer documents evidencing the transfer of the real property described in Annex A hereto from Canadian Pacific Railway Company to Her Majesty the Queen in right of Canada.

Annex A

That part of Block "A", except portions in Reference Plan 19952 and Plan LMP8263, District Lots 181 and 196, Group 1, New Westminster District, Plan 19584 comprising an area of 232 square metres more or less and that part of Parcel "B", Blocks H, K, 48 and 49, District Lots 181 and 182, Group 1, New Westminster District, Plan LMP44768 comprising an area of 170 square metres more or less, all of which is shown in heavy outline on an unregistered statutory right of way plan, marginally noted C 5017-97 D and titled "Statutory Right of Way Plan over portions of District Lots 181 and 182, Group 1, New Westminster District", signed by Robert Reese B.C.L.S. and dated the 26th day of July 2000.

This plan is kept in the office of the Vancouver Port Authority.

Ship-source Oil Pollution Fund

Pursuant to section 91 (see footnote a) of the Marine Liability Act (the Act) and the Marine Liability Regulations made pursuant to paragraph 91(3)(b) (see footnote b) of the Act, the maximum aggregate liability of the Ship-source Oil Pollution Fund in respect of any particular occurrence during the fiscal year commencing April 1, 2004, will be $143,599,686.20.

Ship-source Oil Pollution Fund

Pursuant to section 94 (see footnote c) of the Marine Liability Act (the Act) and the Marine Liability Regulations made pursuant to paragraph 94(3)(b) (see footnote d) of the Act, the amount of the levy in respect of payments into the Ship-source Oil Pollution Fund required by subsection 93(2) (see footnote e) of the Act would be 43.06 cents if the levy were to be imposed pursuant to subsection 95(1) (see footnote f) of the Act during the fiscal year commencing April 1, 2004.
