RESPONSES TO SPECIFIC QUESTIONSQuestion 8: Has your government reviewed and, where necessary, revised its immigration policies which may be inconsistent with international human rights instruments with a view to eliminating all discriminatory policies and practices against migrants? Government of CanadaCitizenship and Immigration Canada Citizenship and Immigration Canada (CIC) has set forth certain standards of admission and procedures for screening applicants. CIC makes every effort to maintain an acceptable balance between the policies and procedures which facilitate admission and those which act as a safeguard against the admission, or prolonged presence, of persons who pose a threat to Canadian society. The process by which an individual is removed from Canada, whether at his or her time of entry or after admission, is prescribed in the Immigration Act. It provides that all persons will be dealt with in accordance with the basic principles of our constitutional and legal systems. In addition to the legislated provisions intended to protect an individual who has been the subject of enforcement action under the Immigration Act, there are a number of administrative safeguards throughout the process which have been designed to ensure that individual case considerations are taken into account. The Department of Citizenship and Immigration believes that its enforcement policies and procedures comply with the spirit of the international human rights instruments.
