The Governments of Ontario and Québec agree to add the following Appendix F to the Agreement on the Opening of Public Procurement for Ontario and Québec, signed May 3, 1994:

The provisions of Part IV (Municipal Bus Procurement) of the Ontario-Québec Agreement on Public Procurement and Construction Labour Mobility, signed December 24, 1993, the provisions of which were incorporated in Article 11.3 of the Agreement on the Opening of Public Procurement for Ontario and Québec, signed May 3, 1994, are replaced by the following provisions:

1. This Appendix extends the application of the Agreement on the Opening of Public Procurement for Ontario and Québec, signed May 3, 1994, (the "Agreement") and the attached Appendices to the procurement of municipal buses by the Parties and their municipalities. With respect to municipalities, the obligations outlined in the Agreement are modified by the provisions of Appendix E (Broader Public Sector Procurement of Goods and Services) which becomes effective May 1, 1997, as modified by paragraph 3.

2. The Parties acknowledge that prior to signing this Appendix, both the Government of Ontario and the Government of Québec committed to purchase municipal buses from local sources. The Parties further acknowledge that these purchases are not inconsistent with their commitments under the Agreement, as they existed prior to the date of signature.

3. As of the date of signature and until January 1, 1998, the Parties shall ensure that municipal bus procurements are competitively tendered in a manner that is consistent with Paragraph 4.6 of the Agreement and in a manner that ensures that manufacturers in both provinces may submit bids. As of January 1, 1998, the provisions of Appendix E (Broader Public Sector Procurement of Goods and Services) shall apply to the tendering of municipal bus procurements.

4. As of the date of signature, each Party agrees they shall not grant any subsidy to a municipality for a bus procurement that is not done in accordance with the Agreement. The Parties further agree that they shall not direct municipalities to purchase buses from local sources and shall subsidize the purchase of all municipal buses at the same rate regardless of province of origin.

5. This Appendix comes into effect on the date of signature.
