About the Land Titles Assurance Fund

The Land Titles Assurance Fund (LTAF) was created to compensate people for financial loss due to real estate fraud and errors of the land registration system.  Legal expenses and costs related to a claim are also covered by the fund.

After a claim is made to the fund, a process is followed to find out if a fraud has happened and if any other parties are responsible for paying the damages caused by the fraud. While priority is given for urgent claims or claims with a personal impact, it is important that the government act responsibly on behalf of the taxpayers of Ontario who fund the LTAF.

 

What's Covered By The Fund?

The fund will compensate:

  • Financial losses as a result of the fraud or error.
  • Legal costs related to the claim.
  • Other reasonable costs related to the claim.

Am I Eligible?

To decide if or when you should make a claim, you may want to get the advice of a lawyer.  You or your lawyer can also call the local land registry office or the Director of Titles to see what can be done about your situation, and how you can make a claim for compensation from the LTAF. 

 

The following claims qualify for coverage:

  • Fraud.
  • Errors and omissions by the land registration system.
  • Errors in recording.
  • Errors in the automated land registration system.
