Live-in caregiver already in Québec – Change of employer
The feminine form is used for convenience and designates both men and women.
The following specific procedure applies to a new employer who wishes to hire
a live-in caregiver already in Québec.
Procedure

Read the eligibility
criteria for a live-in caregiver, the elements
in the employment contract that will bind you, and your obligations
as an employer.
Also, read the document entitled Labour
standards in Québec and domestics residing with their employer
(PDF, 580 Kb) for information on the legal aspects of hiring a live-in
caregiver.
Your offer of temporary employment must be approved by Human Resources
and Social Development Canada (HRSDC) and the Ministère de l’Immigration
et des Communautés culturelles (MICC) of Québec.

Complete the HRSDC form Foreign
Live-in Caregiver Application (PDF, 968 Kb) and send it to
the HRSDC Foreign Workers office, accompanied
by the following documents:
- all required supporting documents
- a copy of the live-in caregiver’s last work permit
- a copy of the live-in caregiver’s last notice of assessment or last
information slip for income tax purposes (T4), where applicable
- a copy of the letter of release from the previous employer.

Next, forward the following documents to the MICC:
- a copy of the Foreign Live-in Caregiver Application form sent to the HRSDC,
along with the supporting documents
- the duly completed Live-in
caregiver contract of employment (four signed copies)
- payment of the fees levied to review an offer of temporary employment
- the form Application for a Québec
Acceptance Certificate for Temporary Work (CAQ), duly completed and
signed by the live-in caregiver
- payment of the fees levied to review the CAQ application.
If you live in Montréal: send the documents
to the Direction de la sélection des travailleurs – Validation
des offres d’emploi.
If you live elsewhere in Québec:
send the documents to the Immigration-Québec office serving your region.

Be sure to submit all of the required documents in order
to avoid delays in the processing of your application. |

If you cancel your job offer or terminate the employment contract, you must
notify the MICC and the HRSDC promptly in writing.
Next steps
- In reviewing your application, the MICC may visit your home.
- You will be notified in writing of the joint decision of the HRSDC and
the MICC within 30 days of receipt of all the required documents.
- Your applicant must then send an Application
to change conditions, extend my stay or remain in Canada (PDF, 244 Kb)
to the Case Processing Centre in Vegreville, Alberta. A fee
is charged by Citizenship and Immigration Canada at this stage. Expect to
wait several weeks before the live-in caregiver receives her new work permit.

A live-in caregiver may only work for the employer whose
name appears on her CAQ and work permit, unless she already holds an open
work permit from CIC (a permit issued after completing at least 24 months
of work as a live-in caregiver). |
