Seasonal agricultural worker

The following specific procedure applies to the hiring of seasonal agricultural workers from Mexico and Commonwealth Caribbean countries. Given the scarcity of local labour in this area, a special program has been put in place to facilitate entry by this category of foreign workers. Recruitment applications for workers from Guatemala are processed under the Pilot Program for Hiring Workers for level C or D jobs.

Procedure

  1. Make sure you meet the eligibility criteria for the program.

  1. You must show to have made a reasonable and satisfactory effort to recruit Canadian citizens or permanent residents in preparation for the coming agricultural season by, among other things:
    - recalling the workers you employed the previous season
    - advertising jobs in local newspapers, electronic media, student employment centres, local employment centres (CLE), agricultural employment centres (CEA) of the Union des producteurs agricoles (UPA), as well as governmental and non-governmental labour market integration services.

  1. You must then inform the CEA-UPA for your region of your labour needs for the agricultural season at least two months prior to the anticipated arrival of the foreign workers. The CEA will explain the procedure to follow and ask you to complete your application and submit the following documents:
    - the work contract for agricultural workers from Mexico (or the Caribbean) employed in Canada, provided by the CEA-UPA and signed by the producer
    - the letter of compliance with municipal regulations or the municipal inspection document or the letter of confirmation of the health and safety inspection of the accommodations supplied to the foreign workers
    - payment of the fees levied by the Gouvernement du Québec to issue a Certificat d’acceptation du Québec (CAQ – Québec Acceptance Certificate)
    - payment of the fees levied by the Government of Canada to process the work permit application.

Be sure to submit all of the required documents in order to avoid delays in the processing of your application.  
     


  USEFUL INFORMATION  
  • At the end of this process, you will be informed of the joint decision of Human Resources and Social Development Canada (HRSDC) and the Ministère de l'Immigration et des Communautés culturelles (MICC).
  • The Fondation des entreprises pour le recrutement de la main-d'œuvre étrangère (FERME) forwards to the MICC the list of foreign agricultural workers who have arrived in Québec and are employed by participating farming enterprises.
