Plan established under a collective agreement
In some cases, a pension plan may be established under a collective agreement. This is the case, for example, where the plan text is part of the collective agreement or an appendix to the agreement as well as the case where a collective agreement provides that the benefits under the plan will be maintained for the duration of the agreement.
However, just because a company has a union does not necessarily mean that the pension plan was established under the collective agreement.
Generally, where a plan is established under a collective agreement, the employer must reach an agreement with the union before amending the plan.
A union can also be a plan's sponsor
If the union, rather than the employer, is the plan sponsor, the union generally reserves to itself the right to amend or terminate the plan.
