If the Approving
Officer rejects or does not approve the final submission within 2 months,
you may appeal to the Supreme Court of British Columbia pursuant to
Section 89 of the Land Title Act, provided you are appealing a rejection
of a conventional subdivision. Section 89 of the Land Title Act does
not apply to strata title applications.
Legal challenges to decisions on preliminary applications or strata
title subdivisions can only proceed under the Judicial Review Procedure
Act. You must make this appeal within one month of the date you receive
the letter of rejection, or within one month of the expiration of the
time limited by Section 89 of the Land Title Act. |
