GOLDEN NEMATODE REGULATION

Interpretation

1 In this regulation:

"gold nematode" means any specimen of the species of Globodera rostochiensis (Wollenweber) or Globodera pallida (Stone);

"inspector" means an inspector as defined in the Plant Protection Act;

"machinery or equipment" includes a truck, tractor, plough, harrow, planter, digger, grader and any bag or container.

Transportation of soil and plants

2 (1) Unless authorized by the minister, no person shall convey plants, soil or plant parts with soil from

(a) the municipality of Central Saanich to a place outside that municipality, or

(b) a place within the municipality of Central Saanich to another place in that municipality.

(2) The minister may authorize the transportation or movement of soil, plants or plant parts under subsection (1) where soil, plants or plant parts with soil, as the case may be, do not contain any golden nematodes.

Transportation of farm equipment and machinery

3 No person shall convey machinery or equipment that is infested or likely to be infested with golden nematodes from

(a) the municipality of Central Saanich to a place outside that municipality, or

(b) a place within the municipality of Central Saanich to another place in that municipality

unless the farm machinery or farm equipment is disinfected in the manner required by an inspector.

Offence

4 Every person who contravenes this regulation commits an offence and is liable on summary conviction to a fine not exceeding $100 or to imprisonment for a term not exceeding 6 months or to both a fine and imprisonment.
