[1]                We are all of the view that this appeal should be allowed, the order of the judge set aside, and the order of the prothonotary restored. We accept submissions of the appellant that the disputed questions are relevant to claims made in the pleadings, either to the allegation of common enterprise or to the computation of damages, assuming that damages may be measured by reference to the respondents' profits.
