[1] On February 2, 2001, the Court of Appeal dismissed this application for judicial review with costs. At the request of the respondent, assessment took place without personal appearance of the parties. It should be noted that the applicant did not file any representations with respect to the respondent's bill of costs.
[2] In his bill, the respondent is claiming $1,650.00 for services rendered under column III of Tariff B for items 2 (5 units), 13 (3 units), 14 (2 units), 25 (1 unit) and 26 (4 units). With the exception of item 26, the number of units claimed is allowed. Two units are allowed under item 26 given that the assessment of costs has not been contested. This is also the case for the disbursements, which are allowed in the amount of $433.36. Page: 2 [3] Costs of the respondent resulting from this appeal are assessed and allowed in the amount of $1,863.36. A certificate is issued for that amount.
